NEWVILLE BOROUGH COUNCIL PUBLIC WORK SESSION MEETING JUNE1,2021 AT 7:00 PM The public work session meeting of the Newville Borough Council was held on Tuesday, June 1, 2021 at 7:00 PM: in the Newville Borough Office, 4 West Street Newville Pennsylvania and vi Zoom, with broadcast on the Newville Borough You Tube channel. The meeting was called to order by Council President Scott Penner. The invocation was offered by Solicitor Marcus McKnight, followed by the pledge of allegiance. On roll call, the following members were present: Joey Diehl, Jack Ericksen, Ed Sinkovitz and Scott Penner. Michael Croutch and Robert Darius were absent. Also present: Borough Solicitor Marcus A. McKnight III, Mayor Randy Finkey, and Borough Manager Fred Potzer. Mr. Croutch joined the meeting at 7:041 PM himself from the meeting.at 8:001 PM. Mr. Ericksen advised the Council, that due to aj prior commitment, he had to excuse Legal Matters: Mr. McKnight made an inquiry to the developer oft the subdivision plan and expects contact on the following day. He does not think he will have the surveyor engineers There is a discussion toj propose an ordinance to decriminalize the use of marijuana in the Borough ofl Newville. This was communicated to Mr. Penner from Mr. William Garland who has worked with Carlisle Borough and is a resident of Newville. Mr. McKnight advised that this Mr. Penner explained that this is not a request for the legalization of marijuana, but for the reduction of penalty from a felony to a misdemeanor for the procession of a small amount of marijuana, less than thirty grams for personal use. Mayor Finkey concurred with Mr. Penner, explaining that this gives the police officers the option ofi issuing a summary level non-traffic citation in lieu of a criminal prosecution. The legalization ofi recreational marijuana rests with report ini time for the next Planning Commission meeting. should be referred to the Administration Committee. the legislature and the governor and not at the local level government. federal level and not even a medical card would be an exemption. with five (5) affirmative and zero (0) negative votes. Mr. Croutch added that ini the trucking industry, any amount ofmarijuana is illegal at the A motion was made by Mr. Sinkovitz, seconded by Mr. Croutch to: refer the ordinance to decriminalize marijuana to the Quality ofLife Committee. All were in favor. The motion passed Lastly on the agenda for legal matters was a proposed ordinance 2021-04 amending the Borough's open container law. Mayor Finkey emphasized that the ballot question was proposed to be able to have special events with the sale of alcohol and businesses selling it have LCB training for those purposes. The ordinance would not allow for the public to bring their own alcoholic beverages but only for purchase from the attending vendor. It was agreed upon to address the final wording of the ordinance at the. June 29,2021 meeting. Economic Development Committee: Mr. Ericksen did not have anything new to report Administration Committee: Mr. Potzer discussed the criteria for the renewal of the healthcare plan. There is aj provision in the current collective bargaining agreement with the since the previous meeting. Page 1 of4 police officers and that is, it must be al PPO plan through Capital Blue Cross. The renewal date isJ July 1, 2021. The current monthly bill with Capital Blue Cross is $18,123 with the renewal increase ofal little over $600 to $18,792 peri month. After discussion of alternate plans, ai motion was: made by Mrs. Diehl, seconded by Mr. Croutch to: renew the same policy with Capital Blue Cross Gold for both the police officers and the full-time borough employees for 2021-2022. All were in favor. The motion passed with five (5) affirmative and zero (0) negative votes. Bids were open on May 25, 2021 for the North Corporation Street CDBG project. New Enterprise from Chambersburg was the only bid received. Their new bid was $195,785 for the scaled back project. The higher cost reflected the increase in building products and oil costs. The borough had anticipated contributing $40,000 and receiving $100,000 grant money for the venture. This leaves a $56,000 deficit. Mr. Potzer has emailed the Cumberland County Redevelopment Authority asking ifthe grant money that has been awarded to the Parsonage Street project this year be combined with the funding for North Corporation Street. This would enable the Borough to have enough monies for the project and almost $10,000 in contingency. The cost has dramatically increased due to seven curved handicapped curbed crossings of which, each oft those cost $6000 to $7000. There is also a lot of drainage and five inland boxes to be replaced. Mr. Potzer asks that no action takes place on the bid until he hears back from Mr. Chris Raferty, director ofc community development. This most likely will delay the project to! late Mr. Potzer has prepared a letter to Newville Borough residents regarding the changes to the trash collection and recycling program. Included with the letter is the guidelines for trash pick-up and acceptable recyclables as well as the holiday schedule. A motion was made by Mr. Sinkovitz, seconded by Mrs. Diehl to accept the letter as written tol be mailed to the borough residents on. June 14, 2021. All were in favor. The motion passed with five (5) affirmative and Mr. Potzer has reviewed the guideline put forth by the Treasury in using the American Recovery Act funds. He perceives the greatest flexibility can be achieved by showing the maximum loss ofr revenue. That allows the use of federal funds to repay yourself. By showing a surplus of funds in the budget, you can begin to reallocate those funds. Mr. Potzer gavea conservative estimate as follows: Real Estate taxes of $25,000; EIT $20,000; Occupational taxes $3,500; Zoning permits $500; Nontraffic and traffic violations $5,000 and liquid fuels $3,000. Numbers that the borough can substantiate show a $56,500 decline ini revenues due to the pandemic last year. Mr. Croutch suggested giving some sort of premium pay to the employees for their work during the pandemic. Mr. Potzer came up with a one-time bonus amount of $8,000 to be split equally between all the borough employees, including the police officers and clerk, public works, water and sewer and administrative. The funds can all be used to provide assistancei to: nonprofits. The breakdown would be as follows: Western Emergency Management $500, Big Spring Food Bank $500, Neighbors in Christ $500, Beautification Society $500 and The second year ofthe program would be used in water and sewer projects which are fully fundable for the federal monies. Mr. Potzer suggested a matching program between the borough and the authority to automate the water treatment plant. New motors would be installed with variable frequency drives which will lower electrical costs. The frequencies will be tied into the computer system and will prevent the system shutting down during an electrical storm. This summer or early fall. zero (0) negative votes. Economic Development Authority $10,000. will eliminate the need for an operator to come and restart the system. Page 2 of4 Another grant would go to the EDA for a sidewalk program. Mr. Potzer's thoughts are that the money would be loaned out, interest free tol borough residents in a signed agreement and would be paid back within five years. The monies would continuously revolve into other Lastly, monies could be granted to the Beautification Society for the purpose of updating the borough Christmas lighting displays. The current lights have not been replaced since Will Gabig was the state representative for Pennsylvania. He feels this would be good for the morale In summary, there is $66,500 coming ini for 2021 and aj proposed expenditure of $76,500. In2 2022, there will be $66,500 coming in and aj proposed $66,500 going out. Mr. Potzer welcomed other ideas from the council. All monies would be deposited into ai newly opened account at Mid Penn Bank for the purposes stated. No money will be comingled with the general fund. Mr. Potzer asked that no motion be made tonight but have council consider his proposal agreements for the same purpose ofs sidewalk replacements. ofthe community after shut downs oft the previous year. until the next meeting. Parks and Recreation Committee: Mr. Sinkovitz advised the council that the letters were mailed for the Rail Car Museum for the upcoming meeting on June 14, 2021. It was suggested that either Matt Kump or Scott Anderson would be attending as the Big Spring School Mr. Sinkovitz suggested to arrange ai meeting with Mr. Kevin Yost to discuss the plans for the press box at the ball field. There has been no definitive plans or costs discussed to date. When the water fill station was initially discussed for the trailhead, the cost was $4,000. Mr. Potzer has shopped on line and has found a company that deals in hospital and institutional grade equipment for $2,339.00 plus shipping. Public Safety Committee: Mr. Darius was absent for the meeting. Ouality ofLife Committee: Mrs. Diehl reported that the letters have gone out for the Wheels for Warriors Car Show. She will also be working on ai new project, reducing the criminalization of marijuana. Old Business/New Business: There were no items ofc old or new business.
