NEWVILLE BOROUGH COUNCIL SPECIALMEETING JULY17.2023 As special meeting oft the Newville Borough Council was held on Tuesday, July 17, 2023 at 7:001 PM in the Newville Borough Office, 4 West Street, Newville Pennsylvania. The meeting was called to order by Council President Scott Penner. The invocation was given by Solicitor Marcus McKnight III, followed by the Pledge of Allegiance. On roll call, the following members were present: Robert Darius, Jack Ericksen via Zoom, Pastor Joel Kindon, Also present: Borough Secretary Jody Hoffman, Solicitor Marcus McKnight, Mayor Michael Croutch, DCED manager. Andrew Sheaf, zoning office Jayson Mellot and residents, Bob Edward Sinkovitz and Scott Penner. and Linda Over, Joe Arnold, Martina White and Vicki Witter. Citizen Comment: Mr. Jayson Mellott, zoning officer for the Borough, discussed the ongoing problem with sewage coming from 27 North High Street. Mr. Mellott feels that the landlord and tenant are both at fault. His understanding is that rocks havel been discarded ini the waste pipe as well as: non- flushable items from the tenants. This has been an on-going problem and the Newville Water and Sewer Authority has been to the property two different times to address the problem. It was also noted that the property owner did not obtain the proper permits to convert it into at two unit from as single family. This was the same property that was cited: for lead paint the previous year. Mr. Sinkovitz felt that too much time has been wasted and it needs to be acted upon immediately. The most recent letter addressing the problem was dated. June 2, 2023. Mr. McKnight will be sending ai new letter ordering one oft the families to vacate as well as copying the police to Mr. Bob Over of 137 West Big Spring Avenue thanked the Borough and its DPW address these matters. employees for providing the service ofl leaf and brush removal. Legal Matters: a. Areview and discussion ofal Resolution 2023-07 of the Newville Borough Council to seek financial aid under the authority of the Municipal Financial Recovery Act 47 of1987 as amended and to ratify and confirm any and all actions Mr. McKnight summarized the Borough's situation for those in attendance. He explained that when it was discovered of the financial problems in December, it was not known at that time the extent oft the situation. The district attorney and the state office ofDCED was contacted. Steps were taken to have ai forensic accounting audit as well as ai management team to analyze income and expenses for recommendations on: fixing the budget. Currently the amount of expenses verses the amount ofincome expected for the rest ofyear are at great odds. There isa Mr. McKnight explained that Act 47 would allow a long term, no interest loan to cover all necessary expenses. There will be additional help from the state in guidance for the 2024 budget Mr. McKnight reported that interviews have taken place in hiring a new borough manager. Grants have been combined with the plan of covering the Trailhead project planned. He taken on behalf ofthel Borough pursuant to the act. concern that all resources will be expended by September. as well as a five-year plan. Page e1of3 also stated that the expenditures outstanding are too large of an amount to ask assistance from the Water and Sewer Authority, who themselves have larger expenditures than previously thought. Mr. McKnight stated that this step has to be taken in order to make ends meet by the end ofthe Martina White commented that a zero-interest rate is great but wondered what the terms would be. Mr. McKnight replied that at this time iti is not known, however with the guidance of the state planners that are already inj place, he would expect three years. The plan is to operate as Andrew Sheaf with DCED explained that in order to apply for the loan, you have tol be in Act 47. First, ai resolution must be received requesting acceptance into the program. A hearing will be conducted, then the Secretary will make a decision. Mr. McKnight added that under this plan, the earned income tax that the borough receives, could be increased next year. Mr. Sheaf explained that to qualify you must meet one of eight different criteria. One oft those includes year. normal as possible. missing MMO payment and also missing any debt services payment. b. Amotion was made by Mr. Sinkovitz, seconded by Pastor Kindon to authorize Solicitor McKnight to draft al letter of determination for municipal financial distress under. Act 47 and authorizing the President of Council and Borough Secretary to sign inj preparation ofthe hearing with DCED. It was explained that the hearing will be conducted by the state and will be held at the Borough Meeting Room. It will be advertised per Sunshine law and open to the public. Testimony will be transcribed by a stenographer and the final report will be provided to the Secretary. Old Business: cannot be done. New Business: An anonymous email regarding feral cats and' TNR in Newville was received by some of the council members.. A booklet was also received explaining out side cats and what can and a. Area Events to close their account at F & MTrust and rename an account to Newville Wheels for Warriors. All were in favor. Motion passed unanimously. b. Amotion was made by Mr. Sinkovitz, seconded by Pastor Kindon to ask the public for assistance in funds for flagger certification of auxiliary police training. All were in favor. . Amotion was: made by Mr. Sinkovitz, seconded by Pastor Kindon to authorize payment toa auxiliary police for the Memorial Day Parade, Senior Parade and Fountain Festival. Per an email from ChiefKoser, he stated that Fire Department Volunteers receive donations to their Fire Companies. His recommendations for compensation is attached. d. DPW will be working with the Newville Borough Police on National Night Out held on August 1, 2023 from 6. PM - 81 PM. He will receive answers to his questions via email. No motions were required. g. Amotion was made by Pastor Kindon, seconded by Mr. Sinkovitz to cancel the Work Session and Monthly Meeting oft the Newville Borough Council on. July 25, 2023 at 6:00 PM due to a lack of quorum.. Amotion wasi made by Pastor Kindon, seconded by Mr. Sinkovitz to move to Executive Session to discuss ai real estate and personnel matter at 8:061 PM. All were in favor.
