NEWVILLE BOROUGH COUNCIL REGULAR MONTHLY MEETING JUNE 29, 2021 AT 7:00 PM The regular monthly meeting oft the Newville Borough Council was. held on' Tuesday, June 29, 2021 at 7:00 PM: in the Newville Borough Office, 4 West Street Newville, Pennsylvania and via Zoom, with broadcast on the Newville Borough You Tube Channel. The meeting was called to order by Council President Scott Penner. Thei invocation was offered by Solicitor Marcus McKnight, followed by the Pledge of Allegiance. Onroll call, the following members were preset: Michael Croutch, Joey Diehl, Jack Ericksen, Robert Darius, and Scott Penner. Mr. Sinkovitz was absent. Also present: Borough Manager Fred Potzer, Mayor Randy Finkey, Chief Todd Koser and Code Enforcement Officer Alexis Gearhart. Visitor: Diane Weidner. Consent Agenda: A motion was made by Mrs. Diehl, seconded by Mr. Darius to approve the Consent Agenda. All were in favor. The motion was passed with five (5)affirmative and zero (0). negative votes. Verbal Reports: Police Chief: ChiefKoser: reported that there was ai total of354 calls for service in the month ofN May 2021. Traffic enforcement for the month were 88 citations. Ofthe 88 citations, 28 were commercial truck citations. There were three parking violations and 37 traffic warnings issued. Patrol vehicle mileage for the month was 2,587 miles. Outstanding warrants were 53. National Night Out will be held August 3, 2021 at 6:00 PM around the fountain. Planning ofthe event is going well but there is a need for help manning the concessions. Ifanyone is ChiefKoser stated that the department is having issue with the 2013 patrol car. Some of the emergency lighting is starting toi fail. The vehicle is eight years old and is three years past its warranty. There are two in the front and two in the back that will need tol be replaced. Each light will cost $80.00 plus installation. The car did pass inspection but ChiefK Koser requested that the interested inj helping, they should contact Chief Koser directly. car have two new: front tires installed before winter. Fire Chief: Fire ChiefBradley Stouffer was not present for the meeting. Mayor: Mayor Randy Finkey stated the financial reports for the month ofl May 2021: Traffic fines $2,245.37; parking fines $35.00; Clerk ofCourt Fines which are the Borough's share of criminal offenses $829.00; for a total of$3,110.12: in fines and revenue. The police department checking account at BELCO was $12,945.70, the police K9 account at. BELCO was $3,446.20, the debit card balance at F&M Trust was $320.91 and the auxiliary police account was $151.00. LEMC: There were no reports to be presented. Borough Solicitor: Mr. McKnight restated thej purpose of Resolution No. 2021-07 which regards the Open Drinking Ordinance No. 58 dated August 5, 1980. The resolution would suspend the enforcement for the outdoor concert set for Friday, July 30, ,2021 from 6:00 PM until Page1of6 8:001 PM on West Big Spring Avenue and West Streets. Mr. McKnight stated that this is linked tol Resolution 2021-04 which suspends the open drinking ordinance. Mr. McKnight recommended that Resolution 2021-04 be tabled until the results and feed back from the police is Mrs. Diehl voiced her opposition to authorizing Resolution 2021-07. She has concerns of feeling uncomfortable with having wine at the venue for the two hours of the concert. Mr. Penner agreed with Mr. McKnight that the concert on July 30th will set the platform for other events. Further discussion led to ar neighboring borough not having issues with their open container ordinance during their concerts. Mr. Potzer explained that the ordinance allows for the Borough Council to grant permission to venues where alcohol could be consumed. It would be up to the Borough Council what event that would be sO that ai resolution would not have to be made every time. Mayor Finkey added that this event is low risk and it should be allowed to go forth. Chief Koser stated that based on the previous concert and what he expects from this concert, he does not foresee any problem. He did state that drinks are allowed only on the street oft the concert and are prohibited from leaving with a beverage beyond that point. Ar motion was made by Mr. Darius, seconded by Mr. Ericksen for Resolution 2021-07 to suspended the open container law for the two hours oft the concert scheduled for July 30, 2021 from 6:00 PM to 8:00 PM. The motion was passed with four (4) affirmative and one (1) Mr. Penner gave clarification on Ordinance 2021-04, explaining that it does not legalize open containers in the streets but gives Borough Council the authority to grant permission ona case by case basis for future special events. A motion to table Ordinance 2021-04 until the August meeting was made by Mr. Penner. All were in favor with five (5) affirmative and (0) Mr. McKnight presented Resolution 2021-08 in which the Federal Government gives monies to municipalities without mandating what to spend it on. Mr. Potzer explained that the first allocation of ARPA funding will be $70,494.71 oft the overall award amount of $140,989.42. The payments will be in two installments, one by June 30, 2021 and the other in June 2022. Mr. Potzer is asking the council for permission to open a new account at Mid Penn Bank to be designated for the Newville Borough ARPA account. Proposed uses of the monies was discussed at previous meetings but aj new qualification applies to recreation programs for storm water project. Another use would be an allocation of$15,400 to the Beautification Amotion was made by Mrs. Diehl, seconded by Mr. Croutch to approve Resolution 2021-08 for the appropriation and expenditure of Federal American Rescue Plan Act funding. All were: in favor. The motion was passed with five (5) affirmative and zero (0) negative votes. Mr. McKnight also reviewed Ordinance 2021-03 which authorizes additional penalties for borough truck traffic on restricted streets. Until the study is thoroughly evaluated, he recommended tabling the motion until the work session meeting in August. Finally, Mr. McKnight has had the opportunity to speak with Mr. Carl Bert on several occasions regarding the subdivision and land development plans which will be distributed to the county, the borough and tol Mr. McKnight. Ms. Lotwick would supply the traps, transport the cats to the York SPCA for spay or neutering and rabies shot. The cats would be marked with one ear tipped and returned to the borough. The cost] per cat would be $20.00. Mr. Penner stated that this item is on1 the agenda under: new business and the borough would like to contribute $500 to the Trap, Neuter and Release program. Ms. Gearhart thanked the council for their time and consideration. Borough Manager: Mr. Potzer stated that the application for DEP yard waste equipment grant has been submitted. He has received aj proposal from Stevenson Equipment for the two items requested, al leaf vac and tree chipper, for $229,000. Ninety percent of the grant will be funded by DEP, which means the borough'si match will be $22,900. The general fund account will be $10,000 for the leaf vac and $12,900 for the tree chipper will be from the Highway Aid account. The equipment being replaced is a 1995 truck and 1996 chipper. He has also been working with General Recreation completing the estimate and design work for the splash pad. The total for the project will be $95,000 and will be applying block DPWis finishing curb and crosswalk painting as well as parking space markings. Healthcare renewal is complete for the employees and their new cards have been received. WCCOG: Mr. Croutch reported from Penn Township that there are two entities requesting rezoning from commercial to industrial for new warehouse projects. Those projects have been tabled due to the concern of approving new developments due to PennDOT's unwillingness to upgrade the intersections and ramp access to Interstate 81. Mr. Croutch also stated that Shippensburg Borough is excluding glass from their recycling. All municipalities are facing the same issue with glass and it is now put ini trash. Public Safety Committee: Mr. Darius did not have any newi information at this time. EDA: Mr. Ericksen reviewed the highlights of the EDA meeting ofl May 19, 2021. Mr. Gullotta is focusing on four properties in the borough for redevelopment. They include 1-3 East Main Street, 19 East Main Street and 61 Fairfield Street. Mr. Ericksen also stated that Dr. Pion Mr. Ericksen confirmed that there is a restaurant going in at' 7-9 South High Street. Land use and zoning permits have been approved and has hopes of opening in September oft this year. There was another business interested opening a restaurant or microbrewery at the ShipDaddy sight, but have decided not to at this time. Fivel Hundred copies oft the EDA trifold have been printed and will be available at area banks and ai mailing to businesses. An article highlighting Newville was printed in the Central PA Business Journal. Recreation Committee: Mr. Penner reported for Mr. Sinkovitz, who was absent, that the Fountain Festival has been scheduled this year for October 2, 2021. Page 3of6 Quality ofLife: Mrs. Diehl reported that money donations have started to come in for the Wheels for Warriors. An application for small games of chance license has been sent into the Cumberland County Treasurers Department. Mayor Finkey advised Mrs. Diehl that an IRS approval letter must be sent in to obtain the license and also proof on the advertisements oft the Mrs. Diehl received letter from Mr. William Garland about the decriminalization of marijuana. She had a conversation via phone with Mr. Garland and she doesn'tthink that itis advisable to pursue the request further. She feels this is more a state matter than ai municipality Beautification Committee's: sponsorship. jurisdiction. Administration Committee: Mr. Croutch discussed the request for a grapple bucket for the skid loader requested by the Public Works Department. The main purpose would be for the handling oft trees and tree limbs. A motion was made by Mr. Croutch, seconded by Mr. Darius to approve the purchase oft the grapple bucket. All were in favor. The motion passed with five (5) Mr. Croutch recommended the appointment of Sarah Miller to the Newville Police Civil Service Commission. Mr. Croutch stated that she was interviewed and felt she was well qualified to fill the position. A motion was made by Mr. Croutch, seconded by Mr. Ericksen for the removal of Susan Salisbury and appoint Sarah Miller to fulfill the unexpired term oft the Civil Service Commission position. Old Business: Mr. Potzer remarked that the borough was not in aj position at this time to discuss awarding the bid for the North Corporation Street CDBG project until ai response is received from Cumberland County Redevelopment Authority to merge the funding from Parsonage Street with North Corporation Street. This will need to go through HUD and the county commissioners will have a public hearing. Jim Bulger with New Enterprise has been notified of the delay in awarding the bid. New Business: A motion was made by Mrs. Diehl, seconded by Mr. Darius to accept the bid from Capital Area Paving for paving projects in the borough for the amount of$13,897.00 to be paid from highway aid. All were in favor.
