Minutes of Regular Meeting Mayor and Council City of Fitzgerald, Georgia November: 11th, 2024 6:00 p.m. APublic Hearing was held ati the Fitzgerald City Hall Council Chambers on November 11, 2024, at 302 E Central Avenue, to give consideration to application 0164 by City of Fitzgerald for an amendment of the zoning ordinance for the City of Fitzgerald. This property is owned by Believer's Worship Center and is located at 113 Jacksonville Highway, Fitzgerald, Georgia, to Mr. Johnnie Dee Swain, Jr., asked to speak in regards to this public hearing. Mr. Swain is in opposition as this is an old industrial property and has never been assessed by the EPD. He also stated that there was insufficient information on the application regarding plans for the area in question. Mr. Swain deemed this at fraud as the applicant did not show upi for the zoning meeting or tonight's council meeting. Also, he stated that the comprehensive plan has not been rezone 2 acres of said property from WLI City to R-6-M City. implemented. With no one else, to speak the public hearing was closed. Mayor and Council met on Monday, November 11, 2024, at 6:00 p.m. at the City Hall Council Chamber, located at 302 East Central Avenue, with Mayor. Jason L. Holt presiding and with Council members Brown, Clemons, D.. Jefferson, Sefferson,l.ohnson, K.J Johnson, Peavey, Roberts and Mayor Holt welcomed everyone and as today is Veteran's Day, asked if any one present served our country. When council members. J.. Johnson and D. Jefferson stood, they received a round of Minutes of previous meeting, October 14, 2024, Regular Council meeting were presented. Mayor Holt entertained a motion for approval. Council member A. Webb made a motion to approve minutes, seconded by Council member Jimmy Johnson. With there being no additions or corrections, Mayor Holt called for a Roll Call Vote: 91 Yes, ONo. Allinj favor, motion approved. Mayor Holt called on Mr. Frankie Terrell of 516 Cypress St. Mr. Terrell came to speak about the possibility of paddle ball being brought into our community. A hand out was given to all council Webb being present. applause. members and administrative staff. There were no communications or petitions. Under reports of city officers, Mayor Holt called attention to the Administrative Report, sharing some highlights from each department. There was also narrative regarding hurricane recovery submitted by city administrator, Kathy Young. Reports of standing committees were given by their respective chairpersons. City Council member Leslie Clemons presented an alcohol license for OHM Namh Shivay, LLC, dba: Supermart Spirits located at 116 Benjamin H Hill Drive, Fitzgerald, GA. This application has been through the proper channels and alli is in order. Motion to approve: L. Clemons, seconded by T. Roberts. City Attorney, Kyle Cook, presented Ordinance # 24-1626, an Ordinance to amend the City of Fitzgerald zoning district map with respect to two acres (2.00), more or less, in five acre tract 1083 in land lot number 301, ini the fourth land district of Ben Hill County, Georgia, ini the City of Fitzgerald, Ben Hill County, Georgia; to rezone said property from W-L-I (City) to R-6-M (City) Council Person Robertsmade a motion to dispense withi full reading, seconded by Council Person Clemons. City Attorney, Kyle Cook, presented an Ordinance Caption to amend the City of Fitzgerald zoning district map with respect to all of city lots numbers7and: 8, in square number 14 inl block number 2, in the City of Fitzgerald, formerly Irwin, now Ben Hill County, Georgia, as shown by the plat of said city made by or for the American Tribune Soldiers Colony Company on file in the office of the Clerk of the Superior Court of Irwin County, Georgia; to rezone said property from R-6 (City) City Attorney, Kyle Cook, presented an Ordinance Caption to amend Chapter 23, "Utilities" of the Code of Ordinances of the City of Fitzgerald, Georgia; to provide for regulation of use of to R-6-M (City) municipal right of ways by public and private utility providers.
