Municipal Building - 4000 Main Present: Mayor Margolis, Mayor Pro Tem Winget, Deputy Mayor Pro Tem Shinder, Councilmember Reaves, Councilmember Bowers, Counciimember Britton and Councilmember Schupp CALL TO ORDER 1. Mayor Margolis called the meeting to order at 6:00 p.m. Item 3 followed this item. EXECUTIVE SESSION 2. 2A. The City Council will convene into closed, executive session pursuant to Texas Government Code section 551.071 (Consultation with City Attorney) to receive legal advice regarding alternatives to Convened into closed session at 8:07 p.m. and reconvened into open session at 8:24 p.m. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY OR APPROPRIATE address certain unpermitted accessory structures. Discuss and deliberate on proposed policy to have legal counsel present at meetings of the FA Planning and Zoning Commission and Board of Adjustment. Deputy Mayor Pro Tem Shinder presented this item. Stated the Board of Adjustment and the Planning and Zoning Commission make decisions or recommendations with significant impacts, making it crucial to follow the law to preserve the City's integrity, reputation, and protection from liability. While the City Attorney currently attends meetings only upon request or when! legal issues are anticipated, unforeseen legal matters may arise during deliberations that staff or members mightr tnotrecognize. Regular attendance by! legal counsel could ensure compliance with applicable laws, though counsel could be excused from meetings where no decisions are expected. The discussion covered the cost and how to decide when thel legal counsel should attend meetings. The City Attorney clarified that having legal counsel present at Board of Adjustment. meetings does Consensus was reached to have legal counsel attend the Board of Adjustment meetings. 4B. Discuss and receive feedback on whether to pursue a Memorandum of Agreement with the Dallas Off-Road Bicycle Association (DORBA) to utilize city-owned property for construction and ongoing maintenance of a bicycle trail generally located between Main Street and Miller Heights, east of President George Bush Tumnpike, and consideration of alternate locations for the disc golf course. Martin Mallory and Jacob Nilz, DORBA President, presented this item. DORBA has offered to design and maintain an off-road bicycle and hiking trail through Pecan Grove Park and adjacent city land. The trails will feature different difficulty levels, skills courses for all ages, and a unique nature experience, all managed by volunteers. DORBA requested the City: asphalt ramps on the south curbline of Main Street tot facilitate entry and exit of the trail from the street; piping ofapotable water source to provide a wash and bottle filling station near the south end of the Pecan Grove Park parking lot; and a shade structure at the trailhead to provide a rest area for users. Questions were raised including liability insurance, maintenance, DORBA's funding, safetyissues, the location, potential transfer of operations to an outside company, tree mitigation, path crossings, debris disposal, and alignment of the project with staff capacity and prioritization. not eliminate the possibility of cases proceeding to district court. Discuss and provide feedback on an ordinance in reference to bringing unpermitted structures into compliance. This item followed Item 2A. City of Rowlett 10709 Mayor Pro Tem Winget presented this item. He stated at the June 3 Council Work Session, the Council decidednott tot take action ona any ordinance or code amendment for unpermitted structures, but some councilmembers continued to work toward a resolution on specific instances of unpermitted structures, resulting int three ordinance variations being brought back for consideration. Concerns were voiced about amending an ordinance for specific issues, that litigation written for one usually involves special interests, it puts a burden on staff, and require retroactive changes. The majority of Council agreed to present ordinance option 3t to a future meeting for a vote. The City Attorney suggested one additional change to the last paragraph of the proposed DISCUSS CONSENT AGENDA ITEMS FOR NOVEMBER 19, 2024 CITY COUNCIL MEETING. ordinance. 5.
