(b) The operator of a vehicle storage facility or governmental vehicle storage facility may charge the owner of a vehicle stored or parked at the facility: (1) a notification fee set in a reasonable amount for providing (2) an impoundment fee of $20, subject to Section 2303.1552, for (A) is taken by or at the direction of the owner or operator notice under this subchapter, including notice under Section 2303.154(C); any action that: of the facility; and (B) is necessary to preserve, protect, or service a vehicle (3) a - daily storage fee, subject to Section 2303.1552, of: (A) $20 for each day or part of a day the vehicle is stored (B) $35 for each day or part of a day the vehicle is stored (4) any fee that is required to be submitted to a law enforcement stored or parked at the facility; at the facility if the vehicle is not longer than 25 feet; or at the facility if the vehicle is longer than 25 feet; and agency, the agency's authorized agent, or a governmental entity. A daily storage fee may be charged regardless of whether the vehicle is stored for 24 hours of the day, except that a daily storage fee may not be charged for more than one day if the vehicle remains at the facility for less than 12 hours. (e) The operator of a vehicle storage facility or governmental vehicle storage facility may charge a daily storage fee under Subsection (b): (1) for not more than five days before the date notice is mailed or published under this subchapter, if the vehicle is registered in this state; (2) for not more than five days before the date the request for owner information is sent to the appropriate governmental entity as required by this subchapter, if the vehicle is registered in another state; and (3) for each day the vehicle is in storage after the date the notice is mailed or published until the vehicle is removed and all accrued charges are paid. (f) The operator of a vehicle storage facility or governmental vehicle storage facility may not charge an additional fee related to the storage of a vehicle other than a fee authorized by this section or a towing fee authorized by Chapter 2308. (g) This section controls over any conflicting municipal ordinance or charter provision. Even though the vehicle was on the lot for two calendar days, you may only charge one day storage since it is within the 12-hour period. Vehicles Registered in Texas If the vehicle is registered in Texas and you do not send the first notice to the owner and primary lienholder you may ONLYcharge 5 days' storage (failure to send notice is still a violation in and of itself regardless of if you charged storage). Vehicles Not Registered in Texas Ift the vehicle is not registered in Texas, you must send a written request for the MVR from the state it is registered within 5 days of accepting the vehicle or you may ONLYcharge 5 days' storage. This fee covers ALL notices. You cannot charge a separate fee for each notification letter. Ify you notify by publication, and the cost of publication is more than half the cost of the notification fee, you can charge the notification fee and the cost of publication. The notification fee is $50 SO half of that is $25. If the cost of publication exceeds $25 you can charge what it costs to publish it plus $50 notification fee. REVENUE IMPACT: Because of the substantial increase in rates to the Residential class of customers the City should closely scrutinize Atmos's proposed increase as well as its proposed allocation of costs to the customer classes. ACTION REQUIRED BY JANUARY: 20. 2025 The City must take action on Atmos's Statement of Intent by no later than January 20, 2025. Absent such action, Atmos's proposed rates are deemed approved by operation of law. ATMOS' TEXAS MUNICIPALITIES The coalition of cities known as the Atmos Texas Municipalities ("ATM") was organized by a number of municipalities served by Atmos. Alfred R. Herrera, with the law firm of Herrera Law & Associates, PLLC, has previously represented ATM in rate cases involving Atmos. CITY JURISDICTION TOSET ATMOS'S RATES Unless a city ceded its original jurisdiction to the Railroad Commission of Texas, the Gas Utility Regulatory Act $ 103.001 grants a city exclusive original jurisdiction over a gas utility's rates, services, and operations within the city limits. But even ifa city has ceded its jurisdiction to the Railroad Commission, the Gas Utility Regulatory Act S 103.023 ("GURA"), grants a city the statutory right to participate in rate proceedings before the Railroad Commission. RATECASE EXPENSES 2of4 Atmos Energy- - Mid-Tex- 2024, Statement of Intent Cities by statute are entitled to recover their reasonable rate case expenses from the utility. See GURA 8 103.022. Legal counsel and consultants approved by ATM will submit monthly invoices to the coalition-designated city that will be forwarded to ATM for reimbursement. No individual city's budget is negatively affected. OPTIONS FOR CITY ACTION: application to increase rates: The City has three options with respect to the action it takes regarding Atmos's 1. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE Section 1.
