Appoint Chairperson Member Berry nominated Member McIntyre. Member Buonasera asked if he was okay with that. Member McIntyre said he has a business background and there are things that come to the board that he feels he's not qualified to do. He looks at it practically as a homeowner. He doesn't want to review from a constitutional position; MOTION was made by Member Berry and seconded by Member Buonasera to appoint they can leave that to attorneys. Member Mcintyre as Chairperson. Motion passed unanimously. 4. Review of DRAFT Ordinance for City Code Chapter 94 City Manager Kyle Riefler gave an overview of the changes and said they are less restrictive. There was a discussion regarding fair market value and the 5-year lookback. The board was supportive of the reduction to a 1-year lookback. Riefler said the FEMA 50% rule relates to substantial damage/substantial improvement and will always apply, but this section of code applied a 5-year lookback only to substantial improvement, not substantial damage. There was discussion on floodplain management and Flood Insurance Rate Maps which was replaced with the Risk Rating 2.0. Chair Mcintyre asked for confirmation this is taking the city 1 year. Riefler confirmed this is taking the lookback from 5 years to 1 year and summarized his permit review and tracking process. There was further discussion regarding fair market value being defined in the flood code. Member Mcintyre opened a discussion on the fence code. Riefler said the substantial change is to allow the fence to extend over the seawall to prevent people Manager Riefler noted the setback change, stating it only applies to one property on Harbor Drive directly south of Bayside Park. It's the only property with a 15 ft side Ad discussion was held regarding 'grandfathering' for homes that may be affected by any code change. Riefler and the planner will make recommendations to council based on what already exists. They can make it more restrictive but have a plan for enforcement. There was additional discussion on right-of-way. The board also discussed hedges and fences as they relate to property bounded in whole or part by any body of water. Additional discussions included the codes regarding views being protected on waterfront property, earth berms, and remodeling permit cost declarations. Chair Mcintyre asked about the sign ordinance at the beginning of the meeting. City Manager Riefler said the council wanted to look at it before it came back to this board. McIntyre said there was a request to simplify the language. Riefler is working with the City Manager Riefler said they need toi fill positions on the board. The next meeting will be when they begin drafting ordinances for the Land Development Code. Mcintyre asked if anyone expressed interest in being on the board. Member Berry said she's been asked if members can attend remotely. Two people are interested, but they have travel plans throughout the summer. Riefler said they would still need to maintain a physical quorum of at least 3 members, SO if3 members can meeti in person the others can planner and attorney. attend remotely.
