BOROUGH OF GETTYSBURG TROXELL COUNCIL CHAMBERS 59EASTHIGH STREET, GEITYSBURG, PA 17325 COUNCIL WORK SESSION MINUTES NOVEMBER 25, 2024 President Matthew Moon called the meeting to order at 7:00 PM with the following Councilors present: Vice-President Judith Butterfield, Mr. Peter Bales, Ms. Alisha Sanders, and Mr. Chad-Alan Carr. Councilors absent: Ms. Patricia Lawson, Mr. Christopher Berger, and Mayor Rita Frealing. Staff present included: Borough Solicitor Harold Eastman, Barley Snyder; Borough Manager Charles Gable; Borough Secretary Sara Stull; Planning Director. John Whitmore; and] Public Works Director Robert Harbaugh. Staff not present included: Police Chief Robert Glenny; Coordinator of Historic and Environmental Preservation Debra English; Chad Clabaugh Borough Engineer, C. S. Media-ACCTV. President Matthew Moon announced A Gettysburg Christmas Festival will be held on Friday, December 6th through Sunday, December gth 2024. Information and the schedule of events can be located on1 the Borough Website at itips/www.AGettsburgChnsmassrestival.com, President Matthew Moon announced that the 2025 Budget Proposal is posted on the Borough Website at wwwetyspurgpagov and a copy is available in the Borough office lobby for public review. Special Presentation President Matthew Moon said that McKenzie. Johnson, Co-Responder with the York/Adams Mental Health-Intellectual and Development Disabilities (MH-IDD) Program had a family emergency and was unable to attend tonight's meetings, but will give a presentation at a future meeting. He explained that the mental health co-responder has been collaborating with the police department for about two years and has been successful in working with the public. The program is an important initiative that was funded by grants through WelISpan Health and is a partnership with York/Adams MH-IDD. Public Comment (Restricted to items appearing on the agenda - not tabled items) Nancie Gudmestad, Owner of the Shriver House Museum, 309 Baltimore Street asked that the Council consider closing thej parking spaces in front ofHotel Gettysburg, One Lincoln Square during the Tuba Fest thati is scheduled for the second weekend in] December. She said that they expect approximately 500 people to attend the annual event which would crowd people onto the streets as Council Work Sessionl Minutes November! 25, 2024 Page 1of5 inj prior years. President Matthew Moon said that Borough staff is planning to close these spaces for the Bill Mooney, 151 West High Street expressed his concern about the clutter on1 the sidewalks which includes A-frame signs, store clutter, contractor and political signs. These things obstruct the sidewalks and often times there is not enough space for pedestrians to walk. He is in favor oft the. A- Frame signs that shows events, bands, store specials, etc. He asked ifthere is an ordinance: regulating safety of the people in attendance. the square feet a business can use on1 the sidewalks. Current and Old Business PBS 2016-12 Sidewalk Ordinance Revisions President Matthew Moon said that the Sidewalk Ordinance Revisions was al big project that Borough Council decided to undertake this year. At that time, the Borough did not realize the severity of the conditions of the sidewalks and how costly it would be to repair them. During tonight'si meeting he said that the Council will discuss the sidewalks and how they intersect with the Shade Tree Ordinance, sidewalk clutter and outdoor dining. He said that the Shade Tree Commission was asked this summer toj provide Council with an inventory of the trees, and are present tonight to give a report on their findings. 1. Shade Tree Ordinance. /Procedures David Rice, Chairman of the Shade Tree Commission, 145 West Broadway presented Council with a 2024 Shade Tree Census Report outlining the addresses, species and the condition of the trees and noted that the last survey of trees was completed in 2009 (see attached). He said that he and Shade Tree Member Susan Naugle walked the streets to complete the tree survey which took several months to compile. They also looked at the sidewalks during this time toi record the: sidewalks that are damaged from the trees. Some were heaved-up by one-and-a-halrinches and would need to be shaved down for pedestrian safety. He pointed out that the Public Works Department has begun anew technique when planting trees by placing a root barrier around the tree, and the Shade Tree Commission is also choosing trees more carefully that are less likely to raise the sidewalks. As part ofl last year's Shade Treel budget, they allocated $5,000 oft their $20,000 budget to be used for a pilot program to look for concrete solutions for the sidewalks. He contacted Conewago Construction to prepare a quote to shave sidewalks that are heaved-up and the costs to replace them. The quote was $2,100 per day to review the sidewalks on which they will start on Baltimore Street, which is the worst street in town. They plan to do this work before the end of this year. The Shade Tree Commission's plan for the 2025 season is to include implementing a pilot program to purchase and plant trees on private property where the sidewalks are not suitable for trees. The trees would only bei made available to consenting property owners, and then they would be responsible for any future maintenance or removal oft the tree. He said that they hope that Council will be in favor of the pilot program proposal. President Matthew Moon thanked the Shade Tree Commission members David Rice and Council Work Sessionl Minutes November 25, 2024 Page2of5 Susan Naugle, which are all volunteers, for all the work in compiling street information and completing the tree survey. He said the information will be helpful to review the worst sidewalk areas to make an assessment that could be a capital project for the Borough to undertake. He asked Council members what they thought oft the pilot program that the Shade Tree Commission wants to pursue by working with property owners to place trees on their properties. Councilwoman Sanders said that the pilot program is a great idea and that she would approve the Shade Tree Commission working with property owners to plant trees on their property with the understanding that the home owners would be responsible for the trees. Councilman Carr said that he is grateful for all the volunteer work that the Shade Tree Commission put into this report and he would support the pilot program. He said that his only reservation is that he does not believe that the Shade Tree Commission makes a recommendation to Borough Council to vote on tree placement and feels that this procedure should be considered. bring together both community members and the homeowners to participate ini it. Councilwoman Butterfield said that she: feels the pilot program is a great idea and it would Councilman Bales said that he approves of the pilot program as long as the property owners Shade Tree Member Susan Naugle said that as the Borough Council reviews and updates the Sidewalk Ordinance it would be helpful ifthe Shade Tree Commission could be included ini this process since it intertwines with the tree program. She also noted that the Shade Tree Ordinance needs to be reviewed and updated as well, and that they plan to reach out to other municipalities to consent to maintaining the trees. gather information and copies oft their tree ordinance. President Matthew Moon asked for the Shade Tree Commission to present their recommendations to Borough Council for consideration in the 2025 Legislative Priorities. Manager Gable asked if the Shade Tree Commission is aware of any other communities that plant trees outside of the municipalities rights-of-way; and noted another concern would be about the legality of a tree placed on someone's property that causes damage or hits someone whether the Borough would be responsible. He said that this is something we will need to consider and review. 2. Sidewalk Clutter/A-Frame Signs and Outdoor Dining / Street Furniture President Matthew Moon said that sidewalk clutter has been discussed for several years about how signage can create: impediments, and explained that the sidewalks must be compliant with the Americans with Disabilities Act (ADA). This was discussed briefly during the Sign Ordinance Revision discussions and noted that portable signs located on or near public sidewalks must maintain aminimum width ofi five feet ofunobstructed area between the sign and any other objects that might impede pedestrian traffic. He pointed out that ADA mandates the five-feet width to be compliant. The sidewalk clutter is not only signs but furniture, merchandise, sandwich boards, etc. Borough Council and Staff is currently working with the Borough Solicitor to produce a Citation Ordinance Council' Work Sessionl Minutes November 25, 2024 Page 3of5 that would allow the Code Compliance Officer to address these obstructions and to be able to issue citations. He noted that he has seen sandwich boards in the middle oft the sidewalk and that there is not five feet on either side, SO they are already in violation of the current Sign Ordinance which is often unenforced. Councilman Carr said that it is difficult because not all sidewalks are the same size and Borough needs to maintain the five-feet width to be in compliance with ADA. He said that the Borough may need to take the same approach as the Shade Tree Commission and review each street for the sidewalk size, but then it would not be the same throughout town limiting businesses as to what they are allowed toj place on the sidewalk. He said then this could possibly create al legal issue. President Matthew Moon said that ift the sidewalks are: not wide enough to bei in compliance with ADA then the signs, tables and chairs etc. cannot be placed on those sidewalk areas. He said that we have implemented dimensional standards in the past but also need to empower the Code Compliance Officer to enforce and allow the issuance of citations as a last resort. Manager Gable said that there is currently an Outdoor Dining Ordinance in which a business would apply to the Borough for the placement of tables and chairs in the public right-of- way. The Borough Staffreviews the application and measures the space to: make sure that it is ADA compliant before approval. He said other things to consider would be if someone wants to place just chairs in public right-of-way would they need to get the Borough'sp permission; and noted that tree wells and stairs or step units also impede onto the sidewalks. the enforcement managed for the sidewalk clutter. Councilman Bales asked ift the Code Compliance Officer is not allowed to enforce orl how is President Matthew Moon responded that the Code Compliance Officer can enforce these issues, but what Borough is currently drafting an ordinance that would empower him toi issue citations for repeat offenders. He said that there are some regulations already inj place, but said that they may need to be more stringent. Councilwoman Sanders said that she agreed with Councilman Carr that we should do an assessment oft the sidewalks first because all sidewalks are not the same size. We need to make sure that we are in compliance with ADA for all impediments to include signs, outdoor furniture, clutter, etc. The language in the ordinance should also be cleaned up to make it clear to the businesses as to what is permitted and what is not. Manager Gable said that he agrees that we need to define the space better and what the Councilman Bales expressed his concern that the smaller businesses might get boxed out due tot the limited space, and ifthey get issued citations that could be detrimental to them. He asked about the flags placed along the sidewalks that hang down and hit you as you walk by and wondered ifthe impediments and clutter are and also what types of things that would be allowed. Code Compliance Officer would manage this. President Matthew Moon responded that the Code Compliance Officer has been Council Work Session! Minutes November: 25,2024 Page 4of5 extraordinary about informing people of the issues first and then collaborating with them to get it corrected. The citations would only be issued as a last resort. He said that most oft the flags are in violation by state law stating that they must be seven feet offt the ground. Councilman Carr said that he feels the current guidelines are fine and does not think itr needs to be more stringent as long as we meet the ADA requirements. He said that the Code Compliance Officer needs to be more involved with enforcement, and ifl he is then that presents an issue ifl he is being ignored. President Matthew Moon said at the beginning ofthe year the Code Compliance Officer did enforce certain sidewalk issues, but is now waiting on Council's decision regarding revisions to the Sidewalk Ordinance and about the citation mechanism. Councilman Carr said that the Borough was very loose during the COVID Pandemic, which is understandable, but needs to rein things in and follow our guidelines for ADA compliance. The Council needs to allow the staff and the Code Compliance Officer to educate businesses about the sidewalk regulations. Councilwoman Butterfield said that ADA compliance: is notj just for wheelchair accessibility Councilman Carr agreed and said that everyone needs to be able to navigate the sidewalks but also for pedestrians walkability. with ease.
