Call to Order Mayor Turner called the meeting to order at 6:30 p.m. PRESENT: Mayor Josh Turner, Council Members Nan Bowen, Annie Sutton, Jeremy McClure Also present were City Administrator Kevin Harris, City Attorney Keith Whitaker, and 2. Approve Agenda Motion by Council Member McClure, seconded by Council Member Bowen, and voted, unanimously, to adopt the agenda with an amendment to add Real Estate asan item for discussion during Executive Session. PRESENTATION/S 5. Proclamation proclaiming Cleveland, Georgia a Purple Heart City Mayor Turner read the Proclamation. Motion by Council Member Sutton, seconded by Council Member McDonald, and voted, unanimously, to approve the Proclamation proclaiming Cleveland a Purple Heart City. Lou Zayas, Leigh Ammons, Chris Ammons, and Beth Truelove were in attendance. PUBLIC HEARINGS 6. Public Hearing and consideration of an application by Mountain Craft Builders, requesting re-zoning for approximately 10.68 acres, Tax Map and Parcel CO1E 044A, located at 19 Campbell Street. The current zoning classification is B-2, Highway Commercial District. The requested zoning classification is PR-D, Planned Residential Development. The proposed use of this property is for affordable residential single-family housing participating in the Georgia Rural Workforce Housing Initiative (RHWI). Property is currently owned by the City of Cleveland. Property owned by the City of Cleveland. Larry Adams, Mountain Craft Builders, authorized agent. Mayor Turner stated the item and gave Public Hearing instructions and conduct. Mayor Turner verified with Mr. Adams that he represented Mountain Craft Builders and has submitted the Disclosure of Campaign Contribution Certification that Mr. Adams has not, within the two years immediately preceding his application date, made any contributions aggregating $250.00 or more to any local government official involved in the review or consideration of the application. Mr. Adams confirmed that he had submitted the Disclosure of Campaign Contribution Certification as Mayor Mayor Turner confirmed with Mr. Adams that the property is in good standing with the Tax Commissioner's Office as it is owned by the city and is tax exempt. Economic Development and Planning Director Tom O'Bryant addressed the Mayor and Council Members. He stated that staff recommends approval with conditions and the Planning and Zoning Commission voted in favor to deny the request. Mr. Adams, 401 Tolhurst Road, addressed the Mayor and Council Members in favor of Jonathan Adams, 55 Cantrell Road, addressed the Mayor and Council Members. He Council Member McDonald reiterated to Mr. Adams that the PRD zoning does not allow for rentals, short term or long term. Mr. Adams confirmed that he understood Council Member McDonald also confirmed that Mr. Adams is aware that if a homeowner's association is formed and then terminated, even 30 years in the future, Turner stated. the item. stated that the development will be a non-rental community. that. the property will still fall under the PRD zoning and, if ever sold, will be under the purview of PRD zoning. Mr. Adams confirmed his understanding of Council Member Mr. Obryant stated that the PRD: zoning allows situations where rentals can occur. He said in this case, there will be a condition added. Mr. Adams stated that the condition Mayor Turner asked all in attendance to raise their hand if they were in favor. Three Mayor Turner asked all in attendance to raise their hand if they were in opposition to Mayor Turner confirmed, with the City Clerk, that no one had signed up to speak in favor nor in opposition to the item.
