MINUTES OF MEETING OF THE CITY COUNCIL SANFORD, NORTH CAROLINA The City Council met at the Sanford Municipal Center, 225 E. Weatherspoon Street, on Tuesday, October 15, 2024, at 5:00 p.m., in Council Chambers. Ordinance Amending the Annual Operating Budgetofthe City of Sanford FY 2024-2025- Fire and Streets Assistant City Manager Beth! Kelly explained that this ordinance re-appropriates insurance proceeds received in the prior fiscal year for the replacement ofai fire-damaged street sweeper, as well asi insurance proceeds received for damaged SCBA equipment in the Fire Department as described inl ExhibitJ. Council Member Taylor made ai motion to approve the Ordinance Amending the Annual Operating Budget - Fire and Streets. Seconded by Mayor Pro Tem Akinosho, the motion carried unanimously. Ordinance Amending the Annual Operating Budget oft the City of Sanford FY 2024-2025- Wastewater Assistant City Manager Beth Kelly explained that this ordinance appropriates funds in the amount Council Member Dabbs made ai motion to approve the Ordinance Amending the Annual Operating Budget - Wastewater Master Plan - Pittsboro. Seconded by Council Member Ferguson, the motion carried Master Plan- Pittsboro (Exhibit K) to$ $52,000 for the Pittsboro Wastewater Master Plan. unanimously. Capital Project Ordinance = Wastewater Master Plan- Pittsboro Service Area (Exhibit L) Assistant City Manager Beth Kelly explained that this Capital Project Ordinance, establishes grant funds that Pittsboro received from the American Rescue Plan Act (ARPA), in the amount of $97,158, as well as ai transfer from their Utility Fund reserves int the amount of$52,000 for the Wastewater Master Plan Capital Project for the Pittsboro service area. Council Member Buckels made a motion to approve the Capital Project Ordinance - Wastewater Master Plan - Pittsboro Service Area. Seconded by Council Member Ferguson, the motion carried Capital Project Ordinance - Robeson Creek Sewer Rehabilitation- Pittsboro Service Area (Exhibit M) Assistant City Manager Beth Kelly explained that this ordinance appropriates grant funds in the Mayor Pro Tem Akinosho made a motion to approve the Capital Project Ordinance - Robeson Creek Sewer Rehabilitation -] Pittsboro Service Area. Seconded by Council Member Ferguson, the motion unanimously. amount of $4,313,810 from ARPA and establishes the capital project. carried unanimously. 2 City Council Meeting October 15, 2024 Ordinance Amending the Annual Operating Budget of the City of Sanford FY 2024-2025 - Various Assistant City Manager Beth Kelly explained that this ordinance re-appropriates funds, which are related to ground breaking and a computer purchase related to Sanford's 150th Celebration, in the amount of$35,500 for the following departments: Governing Body,Administration, and Finance, as shown ont the Departments (Exhibit N) attached Exhibit N. Council Member Rhodes made ai motion to approve the Ordinance Amending the Annual Operating Budget - Various Departments. Seconded by Council Member Buckels, the motion carried unanimously. Ordinance Amending the Annual Operating Budget of the City of Sanford FY 2024-2025 - Faster Fuel Assistant City Manager Beth Kelly explained that this ordinance appropriates the necessary funds to upgrade software that is used for Fleet and Warehouse Departments, which includes a one-time fee, as and Inventory Upgrade for Warehouse and Fleet (Exhibit 0) well as recurring fees. Council Member Dabbs made ai motion to approve the Ordinance Amending the Annual Operating Budget - Faster Fuel and Inventory Upgrade for Warehouse and Fleet. Seconded by Council Member Ferguson, the motion carried unanimously. Extension of Audit Services Contract (Exhibit P) Assistant City Manager Beth Kelly reminded Council that in March of2022, al Request for Proposal (RFP) was executed for audit services but only two proposals were received that included an optional two- year extension. This request is for Council approval oft the two-year extension by Joyce and Company for audit services. Mrs. Kelly added that Joyce and Company have quoted Sanford a not-to-exceed fee of $44,000 for the 2024-2025 audit as described in Exhibit P. She noted that staff coordinates our audit for the Town of Broadway and approval for that extension will also be requested soon. Seconded by Council Member Rhodes, the motion carried unanimously. Sale ofVacant Lot at 1406 Boykin Avenue (Exhibit Q) Mayor Pro Tem Akinosho made a motion to approve the Extension of Audit Services Contract. Community Development Administrator Karen Kennedy reminded everyone that Freddie Johnson, who owns property adjoining 1406 Boykin Avenue, made an offer to purchase the property described on the attached Exhibit Q for $5,000. His offer was presented to Council in September 2024, and Council authorized the sale using the upset bid procedure. Public notice of the offer was advertised on September 19, 2024, and since no upset bids were received within the required ten-day period after it was advertised; she requested that Council approve his offer. Council Member Buckels made a motion to approve the sale of the vacant lot at 1406 Boykin Avenue and to authorize the Mayor and City Clerk to sign the deed and Restrictive Covenants and Purchase Agreement. Seconded by Council Member Ferguson, the motion carried unanimously. Appointment to the Historic Preservation Commission (Exhibit R) received after the agenda was prepared, as explained in Exhibit R. City Attorney Susan Patterson explained that three applications for this vaƧancy on the Historic Preservation Commission were included in the agenda package and one additional application was 3 City Council Meeting October 15,2024 Council Member Dabbs nominated Berkley Griffith Hillis to fill the vacancy on the Historic Preservation Commission. Council Member Rhodes moved to close the nominations and appoint Ms. Hillis by acclamation. Seconded by Council Member Ferguson, the motion which carried unanimously. DECISIONS ONPUBLICHEARINGS There were no decisions on public hearings. Recess A recess was taken at 5:15 p.m. and the meeting was reconvened at 5:30 p.m. SPECIAL AGENDA (Exhibit S) Recognition of Sanford 101 Participants Mayor Salmon recognized participants from the most recent thirteen-week Sanford 101 session (Exhibit S) and a short video showing session highlights was presented. Mayor Salmon thanked the participants for theiri interest in the City and presented them with a certificate, as well as a key to the City and she also thanked Public Information Officer Kelly Miller, who coordinated the program. Recess Arecess was taken at 5:50 for photographs and the meeting was reconvened at 6:00 p.m. CASES FOR PUBLICHEARING Public Hearing on Municipal Service District(MSD)! Expenditures (ExhibitT) Mayor Salmon opened the public hearing and Assistant City Manager Beth Kelly reviewed the expenditures. She explained that the salary includes a full-time position (and benefits) and a part-time position. Kelli Laudate addressed Council and thanked everyone for supporting the MSD and this past Saturday's Streetfest celebration. With no other speakers, Mayor Salmon closed the public hearing. Approval ofMSD Expenditures Council Member Rhodes made a motion to approve the MSD expenditures as shown on the attached Exhibit S. Seconded by Council Member Ferguson, the motion carried unanimously. Petition Requesting Contiguous Voluntary Annexation by Pulte Home Company.LLC.of47.36#-Acres (ExhibitU) Mayor Salmon opened the public hearing. Long-Range Planning Administrator David Montgomery explained that this request for annexation was received on June 14, 2024, and the information included int the attached Exhibit T was reviewed. He explained that this areai isi identified. as Suburban Neighborhood Place type and a single-family subdivision is generally in conformance with the. PlanSan Lee Land Use Plan. Staff recommends that this property, if annexed, be assigned to Electoral Ward Number Four. Beth Blackman, with the Timmons Group, 5410Trinity Road, Suite 102, Raleigh, North Carolina, spoke representing the petitioner and reminded everyone that this property was rezoned two years ago. Rod Rudloff, with Pulte Homes, 1225 Crescent Green Dr, Cary, North Carolina, thanked council for considering this application and volunteered to answer any questions. With no other speakers, Mayor Salmon closed the public hearing. 4 City Council Meeting October 15,2024 Ordinance to Extend the Corporate Limits oft the City of Sanford, North Carolina (Exhibit V) Council Member Rhodes made a motion to approve the ordinance to extend the corporate limits of the City of Sanford, North Carolina and assign the annexed area to Electoral Ward Number Four. Seconded by Council Member Dabbs, the motion carried unanimously. OTHER BUSINESS Council Members urged everyone to continue supporting those impacted by the recent flooding in Western North Carolina, as well as those impacted by Hurricane Milton in Florida. CLOSED SESSION Council Member Rhodes made a motion to go into closed session pursuant to N.C.G.S. 143- 318.11(a)(1), (3), to prevent the disclosure ofinformation that is privileged or confidential pursuant to the law oft this State; and (3), to consult with an attorney employed or retained by the public body in order to preserve the attorney-client privilege between the attorney and the public body.
