Adjournment Borough of Castle Shannon Right-to-Know Law Policy Adopted 2024 pursuant to 65 P.S. $ 67.504(a) Effective Date: 2024 I. Authority The Borough of Castle Shannon ("Borough") adopts this policy pursuant to Section 504(a) ofthe Pennsylvania Righ-to-KnowLaw, 651 PS-$567,101-673104C ("RTKL"). This policy is available to the public at the Borough' 's administrative offices and on its public website along with the RTKL Uniform Request Form. See 651 P.S. $ 67.504(b) (relating to Borough posting requirements under the RTKL). II. Definitions All of the definitions set forth in the RTKL are incorporated into this policy by AORO. The Borough Open Records Officer designated by the Borough pursuant to Business day. The regular business hours of the Borough are Monday through Friday from 8:30 am to 4:00 pm. Business days exclude Saturday and Sunday and a weekday reference. See 65 P.S. $ 67.102. Section IV ofthis policy. on which the Borough is closed for business. III. Borough Website The Boroughi maintains aj public website at htps/porough.caste-shannon.pa.us, Many of the records most commonly requested from the Borough are available on the website. The following information is also posted on the Borough's website: AORO contact information; contact information for the Pennsylvania Office of Open Records (OOR); a form which may be used to file a RTKL request; and a copy of this policy. See 65P.S. $ 67.504(b) (relating toj posting requirements under the RTKL). IV. Submitting a RTKL Request to the Borough A. Open Records Officer. The Borough has designated an AORO to respond tol RTKL requests. Requests must be submitted in writing using the RTKL Uniform Request Form available on the Borough website and on the website of the OOR and must be addressed to the AORO. If a requester chooses not to use the RTKL Uniform Request Form, the request willl be considered an informal request, not subject to the RTKL. This means that the requester cannot pursue the relief and remedies provided for in the RTKL. To allow the Borough to locate requested records and determine whether those records are public, requests for records should be specific and concise and clearly identify, as precisely as possible, the records sought. See 65P.S. $67.703. Requesters should clearly indicate thej preferred method of access paper copies, electronic copies or by inspection. A requester should retain a copy of the request, as a copy of the request is necessary should a requester appeal the C. Receipt of the request. For the purpose of calculating the response deadline, the Borough is deemed to. have received the request on the business day that the AORO receives the request. See 65 P.S. $ 67.901. Any request that is received by the Borough after the close ofregular business hours shall be deemed tol bei received on the next business day. Ift the request is received by a Borough employee other than the AORO, the request willl be forwarded to AORO as soon as practical. Borough response. Admin 9 D. Verbal requests. The Borough will respond to verbal requests for records at its discretion. Requesters submitting verbal requests for records should be aware that they may not pursue the remedies available to ai requester under the RTKL. E. Anonymous requests. The Borough will not respond to anonymous requests for records. Requesters submitting anonymous requests for records may not pursue the F. Response period generally. The Borough has 5 business days to respond to a request for records under the RTKL. If the Borough does not respond, the request is-considered" "deemed denied," and a requester's appeal rights commence. remedies available to a requester under the RTKL. V. Borough Response A. Extension of time for response. The Borough is permitted to take an additional 30 calendar days to respond to any request for the reasons set forth in Section 902 of the RTKL. See 651 P.S. $6 67.902. Ifthe Borough invokes an extension, thel Borough will inform the requester in writing, in accordance with the requirements set forth B. Requester's agreement. to extend the response period. The requester may agree, in writing, to extend the Borough response period. See 65 P.S. $ 67.902(b)(2). The requester must agree to the extension during the initial 5 business-day response period or the extended 30 calendar day responsej period, ifthe Borough has invoked C.7 Tradesecrets. Ifarequest involves records provided to thel Borough bya at third party and the third party previously provided the Borough with a written statement that the record contains a trade secret or confidential proprietary information, the Borough shall provide notice to the third party. See 651 P.S. $ 67.707(b). D. Final. response. The Borough may. grant ai request, partially grant and partially deny ar request, or deny a request in its entirety. The final response of the Borough will be in writing. Should the Borough fail to issue a response within the applicable response period, the request is deemed denied. See 65 P.S. $ 67.901. 1. Granting access to records. The Borough may grant a request for records by issuing a response: (1) granting access to inspect Borough records during the Borough's regular business hours; (2) sending copies of the records to the requester; or (3) by notifying the requester that the records are available on the in Section 902(b)(2) oft the RTKL. one. Should the Borough deny or partially deny a request for records through redaction or otherwise, the Borough will inform the requester oft the denial or partial denial in writing. The response will describe the requested records, inform the requester that the Borough does not possess the responsive records or, if the records are exempt from public access, provide a citation to the relevant legal basis for withholding the requested records. The Borough may, ini its discretion, choose to waive some or all of the fees owed on a case-by-case basis. VI. RTKL Appeals A. Generally. To challenge the denial, partial denial, or deemed denial ofar request for Borough records, an appeal may be filed using the OOR appeal form, available at htp/vwvopenrecorspugpVApsals/Appealorm.cim. or by contacting the OOR at the following address: Office of Open Records Commonwealth of Pennsylvania 333 Market St., 16th Floor Harrisburg, PA 17101-2234 openrecords@pagov Criminal investigative records. Requirements of an appeal. All appeals must be filed within 15 business days of the mailing date of the Borough's denial, partial denial, or deemed denial of the request. See 651 PS.567.11010)0). VII. Borough Notification of Third Parties on Appeal Borough must notify third parties. If records affect a legal or security interest of an employee of the Borough; contain confidential, proprietary or trademarked records of aj person or business entity; or are held by a contractor or vendor, the Borough must notify such parties of the appeal immediately and provide proof of that notice to the OOR within 7 business days from the date of the OOR's Official Notice of Appeal. Such notice must be made by (1) providing a copy ofall documents included with the appeal to the OOR; and (2) advising that interested persons may request to participate int the appeal. See 65 P:S.$67.1101(). VIII. Mediation The RTKL requires the OOR to establish an informal mediation process to resolve disputes under the RTKL. 65 P.S. $ 67.1310(a)(6). This is a voluntary process to help parties reach a mutually agreeable settlement on records disputes before the OOR. Mediation, a facilitated conversation between the parties that can serve as a fair and efficient tool to resolve conflict, can save time and expense. When appropriate, the Borough is open toi resolving RTKL disputes through the OOR's mediation process. IX. Adnans CASTLESHANNON BOROUGH MINUTES OF REGULAR MEETING August 26, 2024 The following elected officials were present: N. Kovach, D. Swisher; K. Brannon; J. Emph; W. Oates; D. Seiler; L. Shartle; D. Baumgarten; E. O'Malley. The following appointed officials were present: M. Foote, Borough Manager; D. Biondo, Borough Solicitor; K Truver, Police Chief; J. Public Notice: Ms. Kovach announced that council met in executive session this evening at 6:00 pm for the purpose ofcollecting information or educating agency members about an issue. Public Comment - Agenda Items: Matt Grab, May Street - asked for more information on the May Street Stormwater Project listed on1 the agenda. Mr. Foote answered that this] project has been pursued for over four years to address a storm water issue. The borough has been working on resolving this issue by obtaining appropriate easements and funding. Last fall additional ARPA funding was made available that could be utilized for infrastructure projects. Mr. Callender explained that storm water was collecting at the end ofMay Street, going into a trench drain, and discharging over the hillside into a property downstream. A temporary solution was installed by the public works department, and this storm sewer extension project will address the problem Callender, Borough Engineer. P. Vietmeier, Code Official was absent. permanently. The public comment section was closed. Public Presentation: Heather Emanuele, Arch Avenue stated how attractive Willow Avenue and Castle Shannon Boulevard are with all the shops. Ms. Emanuele contacted the Castle Shannon Revitalization Corporation toj propose a street event and was asked to chair the committee for the first annual Willow Wonderland. The borough and CSRC will work in partnership with the committee for the event. Plans arel being made for vendors, children-friendly activities, and a visit from Santa. The Myrtle Avenue Elementary School Choir will attend to perform. Mr. Foote advised that the committee will be requesting a street closure for the festival at a future meeting. Ms. Shartle stated that she is excited for the community and thanked Ms. Emanuele for chairing Paul Salvayon, resident of Glen Shannon Drive and President of CSRC added that Willow Wonderland will take place on December 7th from 2 pm to 61 pm on Willow and Park Avenue. The event will be family friendly and inclusive of businesses. Ms. Kovach noted that in the past the CSRC sponsored a holiday decorating contest for the businesses and residents, and this idea is being considered. Ms. Kovach will coordinate with Ms. Emanuele to provide contact information from prior CSRC events. Mr. Salvayon said that volunteers for the event are always welcome. Minutes: The minutes of the August 12, 2024 council meeting were presented. Mr. Brannon motioned to approve the minutes. Mr. Swisher seconded; all in favor; motion carried. this activity. 1 MAinl Administration: Mr. Foote explained that staff has requested approval to liquidate a 30-year- old piece of equipment due to the cost ofmaintenance and repairs. The public works department plans to rent appropriate equipment for future crack sealing projects. Mr. Seiler motioned to authorize the borough manager to list a 1994 CRAFCO, Inc. Crack Sealing Machine on Municibid, to accept the highest and most responsible bid, and to fully dispose of said piece of Bid Awards, Contracts, and Resolutions: Ms. Kovach reported that the borough received an ARPA grant in the amount of$150,000 to assist in funding the May Street Stormwater Project (Contract No. 24-ST01), and the borough budgeted $90,000 in the capital fund for the project. Mr. Swisher motioned to award the May Street Stormwater Project to. Jet Jack, Inc. as the apparent low bidder in the amount of$194,755.00 subject to the awardee obtaining certifications and review and approval ofs same by the borough solicitor prior to execution oft the agreement by Ms. Kovach reported that the borough budgeted $140,000 in the capital fund for the Library Roof Replacement Project (Contract No. 24-RF-1). Mr. Swisher questioned the maintenance bond for the project. Mr. Callender answered that an 18-month maintenance bond is required, and the asphalt shingles have a 25-year warranty. Ms. Shartle motioned to award the project to Vertex Roofing Contractors, Inc. as the apparent low bidder in the amount of $60,650.00 subject to the awardee obtaining the required insurance certificates, performance, bond, funding agency compliance certifications and review and approval ofs same by the borough solicitor prior to execution oft the agreement by thel borough. Mr. Emph seconded; all in favor; motion carried. Mr. Foote advised that work is progressing at Hamilton Park. The borough is waiting for an inspection on the splashpad. The playground structure is nearly completed, and the playground surface was installed. Next to the new playground structure is a smaller totl lot whose playground surface has significantly deteriorated. Mr. Foote suggested a proposed change order toi install ai new play surface around the tot lot for the safety oft the children. Mr. Emph motioned to authorize the borough manager to approve and execute a change order for the play surface at Upper Hamilton tot lot in the amount of$19,600.00. Mr. Swisher seconded. Ms. Kovach stated that this will create a continuity to the aesthetics ofthe park and referenced the savings in the Ms. Kovach presented Resolution #756 for a Gaming Economic Development Tourism Fund (GEDTF) application to the Redevelopment Authority of Allegheny County ("RAAC") fora grant to fund stairs and a retaining wall at Fountain Street for $500,000.00. This does not require amatch from the borough. Mr. Callender advised that the grant program opened on Monday for infrastructure projects and has a short window ofopportunity. The borough's project is shovel ready as construction drawings have been prepared. Ms. Kovach stated that the original project was for a walkway from Route 88 to Fountain Street to connect to a park walkway. This proposal was rejected by council, and Ms. Kovach questioned if the steps could be removed from thej project. Mr. Callender and Ms. Kovach agreed that thei retaining wall is necessary. The grant proposal included the steps and wall; however, ift the grant award is less that requested, the steps could be removed. Mr. Swisher clarified that the original proposal included steps from Upper Hamilton tol Fountain Street, and this council isi not moving forward with that. Council wants to move forward with thej project and will revisit the scope based on funding. equipment. Mr. Oates seconded; all in favor; motion carried. thel borough. Mr. Emph seconded; all in favor; motion carried. Council Committee Reports Finance - Mr. Swisher reviewed the check registers for August 16thand August 23rda and had no further questions. Mr. Seiler questioned al large expenditure for labor counsel services. Mr. Foote explained the services were: for police collective bargaining, research on a. FMLA situation, and labor grievances. Mr. Seiler questioned aj parade march charge. Mr. Foote answered this expenditure was a financial commitment for bus service for the Memorial Day Parade. Mr. Seiler noted that the check registers usually include expenses for public work truck maintenance and questioned whether a different vendor could be used or ift the work is warranty based. Mr. Foote itemized the work relating to the expenses from Woltz & Wind Ford. Ms. Kovach proposed that with specialized equipment for the dump trucks a qualified service center or dealer is required for repairs, and Mr. Oates agreed that the costs seem in line for the services Mr. Emph motioned to authorize the payment ofall outstanding bills and invoices. Mr. Brannon Public Safety - Mr. Truver stated that the borough currently has seven posts staffed by school crossing guards. The borough employs one: substitute crossing guard, and ChiefTruver requested authorization tol hire a second substitute guard. Mr. Brannon motioned to authorize ChiefTruver to make a conditional offer to Laurie Sutton for the position of crossing guard pending fulfilling all pre-employment screening requirements and required child clearances with compensation in compliance with the Crossing Guard Collective Bargaining Agreement. Mr. Mr. Brannon questioned ifMs. Audrey Turek was still on staff. ChiefTruver answered Ms. Mr. Foote advised that the borough will be bargaining with the crossing guard union this year. In the interest of containing costs, Mr. Foote would like to work with the union directly without utilizing labor counsel. Mr. Swisher clarified that Mr. Foote would enter into bargaining with the crossing guard union only, and not with the police union. Council agreed. Bob Sutton. President oft the Castle Shannon Volunteer Fire Department - presented the August report. August has been an active month in call volume with no majori incidents. In-house fire training was held August 12th where firefighters practiced their skills with the truck - setting up ofthe aerial along with ai review ofthe fire hydrant set up for supplementing the hydrant with an engine. On August 19th, firefighters practiced their skills with Search & Rescue, Maydays and Ladder Operations. The CSVFD responded to twenty-two calls in August: 19 in Castle Shannon; 2 in Baldwin Township; and 1 Mutual Aid - a garage firei in Dormont. performed. seconded; all in favor; motion carried. Turek is 92 years old and still at her crossing guard post. 3 M3 Several firefighters attended the annual summer block party at thel First Presbyterian Church of Castle Shannon on August 17th. The CSFD will bel bringing in a new: member this month who has three modes of firefighting experience. Chief fReffner responded that as always, the CSVFD Mr. Sutton also noted that the new garage doors for the building are expected to arrive at Overhead Door on September 6th. Installation will begin shortly thereafter. The CSVFD has contracted to replace the single pane, non-efficient windows in the station. appreciated the support received from council members. They are using a local contractor - New Horizon. Board Reports Library - Ms. Shartle announced that a dine and donate event will bel held August 28th at the Texas Roadhouse in Bridgeville for the library. The event will be 11 am to 10j pm. The Fall Book Sale will bel held September 12th to 14th, Used books can be donated to the library The Little Pantry is stocked and open to the community. Donations can be dropped off. A Vendor & Craft Show is scheduled for November 23rd. Vendors can sign up at the library. SHACOG-Mr. Seiler attended the. August 15th board meeting. District Justice Ron Arnoni discussed code enforcement. Code officers have a very important job and position holding the residents and businesses accountable for their property in complying with the borough ordinances. Justice Arnoni believes that after a 10-day notice is mailed, ifthe issue is not addressed, a citation should be issued immediately. Justice Arnoni also participates in the LEAD (Leadership, Education, Accountability & Direction) program speaking to students between the grades of7 and 12 with subjects covering drugs, alcohol, and social media issues. Real Estate Tax Collector Report: Ms. O'Malley reported that August 31St is the end of the discount period for school taxes. The tax office will be open on August 31st from 10 am to 4j pm. Public Comment - Non-Agenda Items Ms. Kovach opened thej public comment section oft the Bryan Gigliotti. Poplar Avenue - reported that CSYA Fall Ball registration has been completed, and games will start after Labor Day. Matt Grab, May Street - discussed the fact that recently a contractor closed both Sixth Street and Martha Street which caused difficulties for residents and traffic. There was no communication to residents or traffic control/detour measures inj place. Mr. Grab wondered when the sidewalk would be completed since children are now walking in the streets. Mr. Foote explained that a subcontractor was advised not to close the streets for the paving program and has been put on notice. Mr. Callender noted the contractor is installing concrete curbs and not contracted for sidewalks. Mr. Grab discussed a gas line repair that has opened holes in the sidewalks. Jerry Coombs. Belleville Street - stated that the contractor hit a gas line because they failed to complete a PA One Call. Mr. Foote plans to follow up on Mr. Grab's concerns.
