Public Comments - No comments. E. Consent Agenda: (1)Minutes a. Discuss and consider approving the minutes from; August 27, 2024 September 10, 2024 (2) Discuss and consider monthly reports from City Departments. After further discussion, a motion was made by Councilmember Lyssy and seconded by Councilmember Rosales to approve the Consent Agenda. The vote was 5 -0 in favor and the motion was declared unanimously passed. F. UNFINISHED BUSINESS (CONSIDER AND ACTUPON): (3) Discuss and take possible action on preparation for Founders Day event on December 14, 2024-1 Haylee went over the preparations for founders day, informed council we have already started receiving parade entries and vendor applications. No (4) Discuss and consider the staff update on the 2024 Street Improvement Project - David Young with WTC informed the Council that they are done with the reconstruction oft the three streets, the seal coat is almost completed, they still have items on the punch list and then they will do a final inspection. NEW BUSINESS (CONSIDER AND ACT UPON): (5) Discuss and take possible action on Mayoral Proclamation declaring the month ofOctober as "Domestic Violence Awareness Month."- Bobbie Jo Roberson with Thriving Hearts Crisis Center presented the proclamation and informed the Council they want tol be located in all counties soon. After further discussion, a motion was made by Councilmember Dziuk and seconded by Councilmember Rosales to approve the Mayoral Proclamation declaring the month of October as "Domestic Violence Awareness Month." The vote was 5-0i in favor and the motion was declared unanimously passed. (6) Discuss and take possible action on whether the city wishes toj proceed with a request from Lee Garcia, Jr to close the city-owned alley located between Travis Street and Bowie Street, Karnes City, Texas -I Lee Garcia informed the Council he would like to close the alley, he does not want anyone walking in it. Councilmember Loya expressed his concerns on if the city would need to add utilities there, we would need to be able to have access to it. DPW Rios informed the Council that Mr. Garcia is considering selling and moving since he just requested al line locate for another area. After further discussion, ai motion was made by Councilmember Loya and seconded by Councimember Rosales have an agreement written by City Attorney to allow Mr. Garcia toj put up a fence but everything would be at his cost, and he would have to allow City full access. Mr. Garcia did not want tol have to pay for anything nor allow city access, the motion was withdrawn by Councilmember Loya and Councilmember Rosales. No action (7) Discuss and consider the report from the Karnes City Economic Development Corporation - Sherry Sommer president of 4B Economic Development Corporation informed the Council that they have approved for the baseball and softball fields fields to (8) Discuss and take possible action to approve the City Manager's recommended list of personal property items as surplus and to authorize the public auction of such items in compliance with Chapter 2.36.110 of the City Code CM Butler presented the 1997 International Fire Truck, this truck has been replaced last year and the fire department does not have any use: fori it. After further discussion, a motion was made by Councilmember. Loya and seconded by Councilmember Lyssy to approve the City Manager's recommended list of personal property item as surplus and to authorize the public auction of such items in compliance with Chapter 2.36.110 of the City Code. The vote was 5-0 in favor and the motion was declared unanimously passed. (9) Discuss and take possible action on the annual indexed price adjustment in the amount of $4,848.18 as provided under the city's agreement for water supplied by PC. Aquatics as the City'salternate water source - Mayor Skloss informed the Council this is a bi-yearly adjustment that is in our contract, the price is based off a CPI formula. After further discussion, a motion was made by Councilmember Dziuk and seconded by Councilmember Hernandez to approve the indexed price adjustment to the was taken. be redone in the newi fiscal year. The vote was 5 -Oini favor and (11) Discuss and take possible action on Resolution 2024-003, establishing pay incentives for employees who obtain professional certifications, licenses, and accredited college and university degrees to better serve the City of Karnes City and to comply with applicable state licensing requirements; and setting an effective date - CM Butler presented the resolution. After further discussion, a motion was made by Councilmember Loya and seconded by Councilmember Rosales to approve resolution 2024-003, establishing pay incentives for employees who obtain professional certifications, licenses, and accredited college and university degrees to better serve the City of Karnes City and to comply with applicable state licensing requirements; and setting an effective date authorize the City Manager to proceed. The vote was 5 -0 in favor and (12) Workshop: Review and Discussion of staff presentation on city's Fiscal Year 2024-2025 Budget and proposed allocation of funds, capital projects, employee wages, and other related budgetary matters - Haylee went over budget, no changes (13) Discuss and take possible action on Ordinance 2024-004, adopting the annual budget for the City of Karnes City for the 2024-2025 fiscal year; making appropriations; repealing ordinances in conflict; and setting an effective date- Mayor Skloss presented the ordinance. After further discussion, ai motion was made by Councilmember. Lyssy and seconded by Councilmember Hernandez to approve ordinance 2024-004 for the fiscal year beginning October 1, 2024 and sending September 30, 2025; adopting the annual budget for the City of Kares City. The vote was 5 -0 in favor and the motion was declared unanimously passed. A second motion was made by Councilmember Hernandez and seconded by Councilmember Rosales to ratify the budget. The vote was 5 -0: in: favor and the motion was declared unanimously passed. (14) Discuss and take possible action on Ordinance 2024-005, setting the ad valorem tax rate at $0.59377 cents per $100.00 valuation for the maintenance and operations and debt services for the municipal government of the City of Karnes City for the 2024-2025 fiscal year; providing for apportioning each levy for specific purpose; and providing when taxes shall become due and when same shall become delinquent ifnot paid - Mayor Skloss presented the ordinance. No action was taken. 31 Minutes 09/24/2024 was made by Councilmember Loya and seconded by Councilmember Dziuk to approve that the property tax rate be increased by the adoption of Ordinance 2024-005 providing for a tax rate of 0.59377 cents per $100, which is effectively a 7.46% increase in taxes, consisting of a maintenance and operations component of 0.318109 and a debt service component of 0.275661. The vote was: 5 -0: ini favor and the motion was declared unanimously passed. (15) Executive Session - The City Council of the City of] Karnes City may convene in Executive Session in accordance with the Texas Open Meetings Act, Texas Government Code, Section 551.071 (Consultations with Attorney) on matters in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State. Bar of Texas clearly requires discussion in closed session) and Section 551.074 (Personnel Matters). (A) Discussion on code compliance position and continuance of professional services agreement for code compliance services. Mayor Skloss and Council convened into executive session at 7:06pm. (16) Return to Open Session - Discuss and take possible action on items discussed in Executive Session - Mayor Skloss and Council reconvened in open session at 7:16pm. After discussion in executive session, a motion was made by Councilmember Loya and seconded by Councilmember Dziuk to approve the continuance of professional services agreement for code compliance service with Kevin Moehrig as discusses in executive session. The vote was 5 -0 in favor and the motion was declared unanimously passed. H.
