City of Coldspring, Texas Minutes of the Regular Called Council Meeting Monday, November 4, 2024  1. Meeting called to order 7:00 PM  2. Roll call.  Present: Alderman Jessica Sewell, Jennifer Manuel, Dianne Griffith, Nichole Gatewood, Visitors: Michelle Haylock-CVFD, Shawna Holman-CVFD, Greg Magee-City Attorney  Kyle Currie and Mayor. John Benestante  3. No Public Comment  4. Agenda: Mayor Benestante presented the agenda for the meeting. Alderman Kyle Currie made a motion to adopt the agenda, Alderman Jennifer Manuel seconded the motion. Allin 5. Minutes: Mayor Benestante presented the minutes from the regular October 7,2024, meeting. Approval of Bills: The list of bills paid and to be paid were reviewed by the Council for approval. Operation of Treatment Plant and Collections System - Josh Taylor, the city's sewer operator, presented the report on the Operation of the Treatment Plant and Collections Systems. The plant operated at 17 percent capacity fori the month of October and1 flowed an average of 0.46 MGD. Josh updated on Lift Stations 1,2, &4, the generators at each lift station are waiting on injector pumps to be built and shipped to! be fixed. All three generators have had old diesel pumped out and new B. Financial & Legislative Reports- - Mayor John Benestante briefed Council with the current financial profit and loss statements fort the General account, Sewer & Maintenance, Hotel/Motel, Capital Projects, Community Center, Legislative Updates, and Investment Report. Mayor Benestante asked for any comments or questions regarding the profit and loss statements. There were none. C. GRANT/FUND Reports: Mayor. John Benestante briefed Council with the current Grant/Fund Reports for the ARPA (American Rescue Plan Act-COVID-TDEM),  diesel pumped in.    CDBG-MITMOD GL0-9631,000-Sewer Expansion), Texas CDBG(IDAS500,000- Sewer), RCP-GLO-$300,00 Flood Mitgation/Mapping: Studies/Zoning, Transportation. Alternatives Set Aside A0OT.0.00Sceals, Mayor Benestante asked for any comments or questions regarding reports. There were D. City Attorney Reports- City Attorney Greg Magee briefed Council hei is still working ont the Resolution for the Transmission Lines, just waiting to see the path that they Sewer Reports: Briefing on sewer adjustments & sewer cutoffs- A Assistant City Executive Administrator, Amanda Villa briefed Council on the sewer adjustments made to customer accounts ini ther month of October. Amanda also briefed Council that there was one customer account that was locked in the month of October but F. State oft the City Report- -Mayor Benestante briefed Council overt the new  none.  are tryingt to take which is still unclear.  has since been reinstated. happenings around the city.  8. OLDI BUSINESS:  A. Discussion and possible action on loose dog ordinance-City. Attorney Greg Magee discussed with council the loose dog ordinance and to wait until thet first oft the year tos speak with the new Sherriff. No action wast taken at this time. B. Discussion and possible action on Live Oak Street-Mayor Benestante and City Attorney Greg Magee, briefed the Council on Live Oak Street. No action was taken  at1 this time.  C. Discussion and possible action on resolution concerning Street Lane right of way 30-foot easement. After a general discussion, a motion was madet to approve Resolution 2024-4 by Alderman Kyle Currie concerning Street Lane right of way 30- foot easement. This motion was seconded by Jessica Sewell. Alli int favor.  9. NEWBUSINESS:  A. Discussion and possible action to approve a City's Policy for Preventing Use of Prohibited technology. Amotion was made by Jessica Sewell to approve a City Policy for Preventing Use of Prohibited technology. This motion was seconded by B. Discussion and possible action to repeal Ordinances 88-3 and 2006-09 regarding the sales of alcoholic beverages near public and private schools, churches,  Jennifer Manuel. After a discussion with City Attorney Greg Magee, a motion was made by. Jessica Sewell to repeal Ordinances 88-3 and 2006- 09 regarding the sales of alcoholic beverages near public and private schools, churches, hospitals, and daycare facilities, andi to enact Ordinance 2024-03 prohibiting such sales which conforms with current State law. This motion was C. Discussion and possible action to approve Resolution 2024-05 for the submission oft the 2025-2026 Texas Community Development Grant Fund Program Application tot the Texas Department of Agriculture. After: a general discussion a motion was madel by Alderman Nichole Gatewood to approve Resolution 2024-05 fort the submission of the 2025-2026 Texas Community Development Grant Fund Program Application to the Texas Department of Agriculture. This motion was seconded by D. Discussion and possible action to approve the architectural design firm for the new City of Coldspring Community Center. After al brief discussion a motion was made by Nichole Gatewood to approve the architectural design firmi for the new City of Coldspring Community Center. This motion was seconded by Kyle Currie. Allin E. Discussion and possible action on City of Coldspring's: 2025 City Holiday Schedule. Amotion was made by! Dianne Griffith to approve the 2025 City Holiday Schedule.  seconded by. Amotion was made by Jennifer Manuel to approve Resolution 2024-061 fori the City of Coldspring to authorize the State of Texas to close Highway 150 and FM 15141 for the purpose oft the Annual Christmas ont the Square Activities on Saturday, December 14, 2024. This motion was seconded by Kyle Currie. Allin  favor.  G. Discussion and possible action on approving City of Coldspring 2025 Budget.
