Benbrook MINUTES OF THE MEETING OF THE BENBROOK CITY COUNCIL THURSDAY, NOVEMBER 21, 2024 The regular meeting ofi the Benbrook City Council was held on November 21, 2024 at 7:30 p.m. in the Council Chambers with the following Council members present: Jason Ward, Mayor Renee Franklin Larry Marshall Dustin Phillips Gary Addison Laura Mackey Keith Tiner Also Present: Jim Hinderaker, City Manager Ethan Cox, Assistant City Manager Beth Fischer, City Secretary Tommy Davis, Fire Chief Eric Crile Daniel Bennett Others: I. Approve minutes of the regular meeting held November 7, 2024 1 Motion by Dr. Marshall, seconded by Mr. Tiner to approve the minutes of the regular meeting held November 7, 2024. OATH OF OFFICE TO NEWLY ELECTED MEMBERS OF CITY COUNCIL VI. SELECTION OF MAYOR PRO-TEM Mayor Ward asked for nominations for Mayor Pro-Tem. Nomination by Mr. Phillips to select Dr. Larry Marshall for the position of Mayor Pro- Tem. Mayor Ward asked if there were any other nominations. No other nominations Vote on the nomination for Dr. Larry Marshall to serve as Mayor Pro-Tem: Ayes: Ms. Franklin, Dr. Marshall, Mr. Phillips, Mayor Ward, Mr. Addison, Ms. Mackey, being made Mayor Ward asked for a roll-call vote. Mr. Tiner Noes: None Motion carries unanimously. VII. PRESENTATION OF MAYOR AND MEMBERS OF CITY COUNCIL CC-2024-06 Resolution designating votes for Tarrant Appraisal District Motion by Mr. Tiner, seconded by Dr. Marshall split 16 votes between Ms. Sayeda Syed and Mr. Gary Losada. Ms. Franklin expressed hers support for Mr. Fred Campos and Mr. Eric Crile with a split vote. Mr. Tiner amended his motion to remove the votes for Mr. Gary Losada and give 8 votes to Mr. Fred Campos and 8 votes to Ms. Sayeda Syed, seconded by Ms. Mackey. Vote on the Motion: Mr. Tiner Noes: None Ayes: Ms. Franklin, Dr. Marshall, Mr. Phillips, Mayor Ward, Mr. Addison, Ms. Mackey Motion carried unanimously. 2 Resolution No. 2404-05 being "AI RESOLUTION AUTHORIZING THE CASTING OF THE CITY OF BENBROOK ALLOCATED VOTES FOR APPOINTMENT ON THE TARRANT APPRAISAL DISTRICT BOARD OF DIRECTORS" VII. REPORTS FROM CITY MANAGER A. GENERAL G-2674 Applications for Boards and Commission Mayor Ward asked the City Council to determine the process for application Motion by Ms. Franklin to interview all new applicants and current board members applying for a different board as the process for evaluation and the interviews to take place on' Wednesday December 11,2 2024 at6 6 PM. Motion seconded' by! Dr. Marshall. evaluations and schedule that process. G-2675 Ordinance amending Chapter 8.08 of the Benbrook Municipal Code Ethan Cox gave the following report: Staff recently reviewed Chapter 8.08 of the Benbrook Municipal Code (BMC) and recommends adopting the attached Ordinance amending the Unsanitary Property Conditions section. The proposed revisions update definitions to include additional nuisances and clarify enforcement procedures. This Ordinance allows the City to enforce unsanitary property conditions relating to high grass and weeds; junk; rubbish; trash; garbage; refuse; junk appliances; and junk machinery. Changes include: Updates and additions to the terms in the definitions. Adds a new section on Miscellaneous Sanitation Nuisances which addresses issues such as stagnant water, sewage overflows, property conditions that result in vermin and/or parasites, and nuisances associated with compost piles. Prohibits the illegal deposit or discharge of liquid waste. Updates language on violation notification procedures. These revisions aim to reduce ambiguity, improve enforcement, and make the regulations easy to understand for both the Code Compliance Officer and the public. 3 The previous revision to Chapter 8.08 - Unsanitary Property Conditions was Motion by Mr. Addison, seconded by Mr. Phillips to adopt Ordinance No. 1505 amending Chapter 8.08 Unsanitary Property Conditions of the Benbrook adopted on January 21, 2016. Ordinance No. 1505 being "AN ORDINANCE AMENDING CHAPTER 8.08 = UNSANITARY PROPERTY CONDITIONS, TITLE 8, HEALTH AND SAFETY, OF THE BENBROOK MUNICIPAL CODE (1985), AS AMENDED, BY REVISING THE CITY'S UNSANITARY PROPERTY CONDITIONS REGULATIONS; PROVIDING FOR VIOLATIONS, PENALTIES AND INJUNCTION; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY CLAUSE: PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE."
