Request for Contraction: Parcel #11823-055-000 & 11823-050-000 Ms. Richard, Planning Director, stated the applicant'owner is Jeff Gregory. Ms. Richard stated the requested action is contraction (de-Annexation) approval. The property is located at 3320 Bradenton Avenue, the parcel size is 6.6t acres, and thej parcel numbers are 11823-055-000 and 11823-050-000. The parcel is contiguous to the City ofLynn Haven with the west and south boundaries. The applicant submitted a water and sewer availability form to the Public Utilities department who responded that City water and sewer are not available to these parcels. The majority oft the parcels have a Conservation land use which isi not permissible to be constructed upon, and a very small amount oft the property has a Low Density Residential land use. The existing uses on the site are ai metal building used as an office and warehouse. Thisisanon- conforming property and was likely grandfathered in when the Future Land Use Map Amendment was implemented. Mr. White asked ift the City is unable to provide utilities, what kind of verification do we. have that the county can provide utilities and are there any conditions for an annexation because of that. Ms. Richard stated that it has been ascertained and the City does not have utilities available to thej property, and she spoke with Bobby Baker, ChiefInfrastructure Director, and iti is his understanding that the County may not be able toj provide utilities, but she is unable to say ift that is correct. Mr. White stated ifthe recommendation is to de-annex this property on the nature of the utilities notl being available, what kind of certification is needed that he can get the utilities, what is the action, and final use. Ms. Myers stated she does not know the circumstances as to why the City is unable to provide utilities, there is a way for utilities to be available but who is paying. Mr. Gregory addressed thel board and stated that iti is not cost effective for the utilities to bei run from Lynn Haven as they want it looped from Azalea Street. He stated he needs utilities for two units and the cost is outrageous, and they have done this previously with aj parcel at the Mr. Murphy asked ift the de-annexation was for tax savings. Mr. Gregory stated no, it is the cost for the water and sewer asi it will cost more to run the utilities from the City than the County to Mr. White asked what is thel long term plan for the parcels. Mr. Gregory stated hei is not sure; several people havel been interested inj purchasing the property. Iti is not conforming, and hel built thel building on the property, hel has a business license, and hel has been in business for twenty years. Hel has tried to sell before, and the City will not give them al business license. Mr. White asked ifhe was wanting to convert to residential. Mr. Gregory stated no, hel has had al business there twenty years and any day the City could shut him down. Mr. Gregory stated the property is not for sale as oftoday, and that for sale sign is for the implements that are for sale. Mr. White asked about the low areas on the eastern side oft the property. Mr. Gregory stated to the east and the south there is a drainage ditch that comes through the property that might have been ai mosquito control ditch at one time, and south ofthat ditch is conservation. Mr. Ashbrook stated the majority of thej property is conservation. Ms. Gregory stated it was not conservation corner 34th and 390. and they were able to get utilities from the County. the property, and it is definitely about dollars and cents. Mr. White stated ifa development order was submitted for the eastern portion oft thej property, the development order would not be allowed because thej properties have a conservation land use. Ms. Richard stated that is correct that development cannot occur on the conservation portion oft thej parcels. There are Future Land Use Maps from 1999 and 2010 indicating conservation on the parcels, trimming is allowed, however, no construction, digging, or fill dirt is allowed on a conservation land use, and ifthat does occur, the FDEP or Northwest Florida Water Management Mr. White asked Mr. Gregory ifhe had spoke with anyone at the County, and ifs so, did they give some. level of certainty. Mr. Gregory stated he has spoken with Mr. Porter about the whole process, and he will see it through before he does anything with the properties. District would get involved. She stated there are: some: items in review, and she is not sure ifany oft the items will bei ready to be presented at the November Planning Commission meeting. She stated regarding the possible special meeting to bel held on Wednesday, October 30th, for the Marina Island Development Agreement, she is waiting on some: information, so keep the meeting date penciled in, and we would let them know ifthe With theryleing n9 further business or discussion, thei meeting adjourned at 5:49pm. meeting will bel held or not.
