MINUTES Special Called Meeting NOVEMBER 4, 2024 4:001 PM MERIWETHER COUNTY BOARD OF COMMISSIONERS Commissioners Present: Chairman Gene King, Vice Chairman Adam Worsley, Commissioner StaffPresent: Interim County Administrator. John Gorton, County Clerk Allyson Stephens, Human Resources Director Valerie Chambers, and County Attorney Nathan Lee Rosla Plant, and Commissioner Emmett Collins Commissioners Absent: Commissioner Bryan Threadgill Staff Absent: I. CALL TO ORDER II. ADOPT AGENDA the Agenda. All were in favor. III. NEW BUSINESS The meeting was called to order at 4:00 p.m. by Chairman Gene King Am motion was made by Vice Chairman Worsley and seconded by Commissioner Plant to Adopt 1. Interim County Administrator. John Gorton stated that this is an Employee Appeal Hearing for Mr. Bobby" Craig.. Administrator Gorton stated that the County will present its case Valerie Chambers, Human Resources Director, provided the Board with a packet ofinformation that included 4 items. Exhibit 1 was three anonymous letters, 1 sent to her as Human Resources Director, I sent to the Board of Commissioners, and I sent to the County Administrator at the time, Jarrod McCarthy. Exhibit 2 is the termination counseling for Mr. Bobby Craig and includes all the reasons for termination and policy violations. Exhibit3 is a letter from Mr. John Gorton, Interim County Administrator. This letter was sent to Mr. Craig following his meeting with Mr. Craig and his review ofall the documentation that was on file ini thel HR office, following thei investigation. Exhibit 4 is copies ofe emails that correspond with the anonymous letters in Exhibit 1. These emails are sent from an employee to Bobby Craig. Director Chambers stated Mr. Matthew Brown's name will'be on the emails int the left-hand corner, and he ist the IT. Director. Director Chambers stated that Director Brown found these emails by looking at Mr. Craig's computer, which hel has ai right to do, per Director Chambers, and made copies ofthem fort the investigation. Director Chambers stated that she would like to read the Corrective Counseling as it summarizes what happened, and she feels it would be the best way to explain The reason for the corrective action: "Three fire department employees made allegations of discrimination and al hostile work environment. An investigation by the Meriwether HR Department was. launched in response to these allegations. The investigation has determined the following facts and findings. Three fire department employees sent emails to you complaining about Captain Robert Etheredge which alleged discrimination and al hostile work environment. You received these emails and created a folder on your County computer and saved these emails and then Mr. Craig will be given the opportunity to present his case. the reason for the termination. into that folder. You took no action regarding these complaints. Approximately two months or sol later, after no action was taken, these same employees then sent their three emails anonymously to various County offiçials. A formal investigation was then conducted. When questioned as part oft this investigation, you indicated that you only had knowledge ofone ofthe three emails, despite all three being saved in your County email account and on your County computer, which you use toj performjob duties. Additionally, a fourth anonymous letter was: sent to various County officials alleging that Fire ChiefDanny Stephens had been in a compromising position with a subordinate, that he was incompetent, and should be removed from his position. Afteri investigation, all the concerns regarding Chief Stephens have been determined to be unfounded and without merit. The three employees who sent the initial emails were interviewed and admitted to writing the three emails, which were later mailed anonymously. However, there was conflicting information on who was responsible for the 4th letter, and it was not possible to confirm who was involved, although evidence showed the possibility that more than one individual contributed to writing the/4th letter. However, it is apparent that you received emails complaining of discrimination and ahostile work environment and took no action regarding those complaints. The County has an obligation to act on such complaints, and indeed hasa policy that reported complaints of discrimination are regarded as serious. The concerns about Captain Etheredge were primarily regarding his addressing. job-related tasks that had not been done, but his actions were reported as being discriminatory and to have created al hostile work environment. As a Deputy Chief, you 1 should know that you had an obligation to act in the face ofsuch allegations. Ify you had questions as to how to proceed with such allegations, you could have either referred to the County Policy for guidance or brought the matter to the attention of the HR Department. As Deputy Chief, it is expected that you would adhere to all relevant County Policies, including those that concern discrimination int the workplace, or seek guidance as to how toj proceed, ifr necessary. Instead, you failed to exercise clear leadership responsibility as Deputy Chiefand took no action ofany kind regarding these complaints. In doing so, you violated the County Policy. Moreovér, when a County supervisor, such as yourself, refuses to act when a complaint is received regarding illegal discrimination, such inaction can expose the County to al legal claim and possibly liability as well. The cost of defending against such a claim, even ifthat defense is successful, can be significant in terms oftime, resources, and money. The County has anti-discrimination and anti-harassment policies as well as a reporting mechanism to follow the law and tolavoid potential legal claims. When you refused to follow these Policies, you placed the County at potential risk for a legal claim being filed. Additionally, the investigation further revealed that when questioned, you were: not forthcoming about the emails, and initially denied all knowledge of the emails, even though you had created a folder on the County computer you used and saved these emails to said folder. You were shown copies of the emails, then stated that you only_had knowledge ofone of the three emails. This indicates that, at best, you did not competently manage these complaints, which might have resulted in a legal claim being filed against the County, and at worst, that you may have falsely disavowed knowledge ofthese complaints. Due to these facts, as determined by investigation, the County no longer has confidence in your leadership abilities as Deputy Chief, or your ability to adhere to County Policies to mitigate risk oflegal claims and liability. Based on these facts, we have concluded that you cannot continue your employment with Meriwether County. Asa professional courtesy, you will be given the opportunity to voluntarily resign instead ofbeing terminated, but ifyou choose this course ofaction, you will waive your opportunity to appeal the decision to terminate your employment." Director Chambers stated that below thei information from the Corrective Action tol Mr. Craig, were the policy violations, including Section 38. Reports of] Discrimination and Harassment, Section 34. Ethics, Appearance, Courtesy, and Behavior, Section 58. Failure inl Performance of Duties, and Section 59. Misconduct,Director Chambers stated that she would be glad to go through each ofthe violations with thel Board ift they chose to have her do that. She also stated at the bottom oft the page was an acknowledgment that they covered this with Mr. Craig, The next page is an opportunity for Mr. Craigto voluntarily: resign, which he opted not to do, according to Director Chambers. Chairman King asked Director Chambers ifs she had said at first Mr. Craig was not aware ofthe emails, and then he stated that he knew about one oft them. Director Chambers stated that at first Mr. Craig acted as ifhel had nol knowledge of them, and then he examined them and stated that he recognized one ofthe emails, but not the other two. Chairman King asked ifhe would have to create that folder for the emails to be on his computer. Director Chambers stated yes, and that I.T. has proven that. Director Chambers stated that I.T. has access to the emails and located the emails hich were in his inbox and moved them to a folder. Chairman King asked ifthel I.T. Diréctor would be the only one that could access these emails. Director Chambers stated that iti is correct, unless Mr. Craig gave someone else access to his computer. Vice Chairman Worsley askedi ifMr. Craig refused to sign ori ifthey did not have the copy. Director Chambers stated that'he did refuse to sign it. Director Chambers stated that on page two the document was signed by Chief Stephens and herselfwith a spot for Mr. Craig to sign as well. Director Chambers stated that he refused to sign anything as well as the included corrective action form. Director Chamber stated that Mr. Craig was given the opportunity to sign and refused and read a note that stated: "Deputy Chief Craig refused to sign the documents and stated that he would not voluntarily resign."] Director Chambers stated that he refused a copy of the County's appeal policy. Director/Chambers: stated that the policies were read aloud to him as he was walking out the door and stated that Mr. Craig was in al big hurry to leave. Commissioner Plant asked if employees shared a computer ori if we were set up that each employee had their own computer. Fire ChiefDanny Stéphens stated there are some tablets that are shared and an office computer at Station 1 that theCaptains use. Chief Stephens stated that each one. has their own desktop that they log onto and only has access to that individual desktop. Chief Stephens stated that Captain Etheredge, Captain Cannon, and Captain White have access to their own individual desktops. Chief Stephensistated that Chief Stephens, ChiefCraig, ChiefPynenburg, and Chief Grice all have their own laptops that are used in their offices. I.T.A Assistant Jake Holloway stated that all computers have their own passwords and logins. Chairman King asked ifthis was ini reference to Bobby Craig being released or dismissed from his duties with Meriwether County. Chief Stephens/stated thati is correct. Chairman King asked why he was reading that he resigned on 5/12/2024. Chief Stephens stated that is not part oft their termination, itiss something that Mr. Craig gave them that was part oft the preliminary investigation, but is not part oft the termination. Vice Chairman Worsley asked ifMr. Craig turned inl his resignation. Chief Stephens stated that he did not, it was a letter that was also found when LT. Director Matt Brown was looking for the letters. Chairman King confirmed that these were not sent, and Director Chambers explained these documents were what Mr. Craig requested the Board have when he came in, and she paused to'have someone copy them. Commissioner Collins asked ChiefStephens ifhe knew about the/statement that he assumed was from Mr. Bobby Craig, that three fire department employees sent emails to him complaining about Mr. Robert Etheredge and believing there was al hostile work environment. Chief Stephens stated that he did: not know anything about the complaints. Director Chambers stated that was the concern that Chief Stephens didn't know, and she didn'tknow, and they didn't have a chance to do anything about the situation, nor did Bobby do anything about it on his own. Chairman King stated there were other people involved and asked ifother disciplinary action was taken against the others that were mentioned. Director Chambers sstated that other disciplinary action has been taken as a result of the investigation. Vice Chairman Worsley stated that he feels that statement is not part oft this case, but feels it needs a conversation. Chairman King stated that he asked to make sure that Mr. Bobby Craig wasn't the only one receiving disciplinary action ifs someone should or Interim. Administrator John Gorton stated that on October 3, 2024, Assistant Administrator Blue Cole received aj phone call from Mr.Bobby Craig. Assistant Administrator Cole stated, Mr. Craig wanted to file an appeal. Interim Administrator Gorton stated that he received an email from Mr. Craig on October 4, 2024, requesting an appeal to the Administrator. Interim Administrator Gorton stated that he had seven days to reply and replied to Mr. Craig by letter on October 11,2024. Interim Administrator Gorton stated this was presented as Exhibit 3. Interim Administrator Gorton stated that JGwas himself and BC was Mr. Bobby Craig. Interim Administrator Gorton stated that thegist ofthei information is that Mr. Craig was aware ofthis and read one of the emails and wast trying to deal with it as best he could internally instead of taking it to HR. Mr. Craig felt they were short-staffed. The Board took time to read the conversation between Interim Administrator Gorton and Mr. Craig. Vice Chairman Worsley stated he would like to do that beforé making any decisions. Interim Administrator Gorotn stated that what the Board read was a copyjoft the conversation he had with Mr. Craig and he wanted to have that conversation before reading the County file. Exhibit 3 is the letter that Interim Administrator Gorton stated he wrote to Mr. Craig, upholding the termination. The Board took Chairman King called Mr. Craig up to the podium and asked him before he presented ifhe would still like to move forward or resign, based on what he had heard up to that point. Mr. Craig stated that he would like to proceed. Chairman King stated that was fine, but wanted to be Mr. Bobby Craig stated that he did not want to deny what Director Chambers stated and explained that he did get the letters and tried to handle some oft the stuff on his own. Mr. Craig stated that looking back this was aj poor choice. Mr. Craig stated there was stuff going on and stuff still going on right now. Mr. Craig stated that the reason he requested copies ofthe extra letters is that the Board asked about; the letter on 5-12-2024. Mr. Craig stated that he had written al letter ofresignation which was not in the email and was pulled offofthe computer. Mr. Craig stated that the second letter never got sent to the Board, and he feels personally that is what the decision was based upon and why he was terminated, because he doesn't like that. Mr. Craig stated there are a lot of things that have happened in the department since he started work a little over two years ago. Mr. Craig stated he was appointed Deputy Chiefa little over a year ago. Mr. Craig stated that Chief Stephens and himself never really could get on the same page, which is what the letter says and why he wanted it brought to the Board, Mr. Craig stated he felt he could handle these situations in the emailsand get it calmed down himself. Mr. Craig stated that the department is short-staffed and should have 45 people and there are 24 people that are working their butt offt to manage. Mr. Craig stated that in trying tol have a conversation with Chief Stephens, every time, whether it was his truck, staffing, it was always met with resistance. Mr. Craig stated that the day all oft this came about, they called them into the office with Chief should not have. time to read Exhibit 3. respectful. Stephens, Valerie Chambers, and Theron Gay and brought the letter out, which is why he felt it was relevant. Mr. Craig stated there are things that are wrong here, and the stufft that is in the letters that the people said, Captain Etheredge pretty much does everything that was said. Mr. Craig stated that as far as it being anything such as sexual harassment, no, it is just the yelling, screaming, and cussing. Mr. Craig stated that he tried to handle it himself and get it under control to avoid losing more personnel than was needed to lose. Mr. Craig stated that the Board's decision is up to them and basically all he has to tell them and will not waste their time any longer. Mr. Craig stated that it was mentioned in the meeting that they were attacking Chief Stephens character. Mr. Craig stated that he is not attacking him personally and doesn'teven know! him personally outside the department and feels he is a good person. Mr. Craig stated that Chiefwise, he feels he is in over his_head and his decision making is less than desirable. Mr. Craig stated that is what the letter ofresignation was and then he decided he was not going to back down now and will keep going! Mr. Craig stated that he attempted to send the letter to the Board, but backed out as he figured that it would go south too. Mr. Craig stated that the Board has stations that are not covered andare all things discussed that never went anywhere. Mr. Craig stated that the same would apply regarding Capt. Etheredge, it wouldn't go anywhere. Mr. Craig stated that that is alll he had and appreciated the Board hearing him out and didn't want to waste any more oft their time. Vice Chairman Worsley asked Mr. Craig ifhe remembered the date he wrote the resignation letter that he did not send. Mr. Craig stated that it was dated 5-12- 2024, so right around that time. Vice Chairman Worsley asked him about the letter that he was going to send to the Board. Mr. Craig stated it was shortly after that, and probably around two weeks after. Mr. Craig stated that it never got dated and was never sent to anyone, and was pulled off the computer. Vice Chairman Worsley asked Mr. Craig how he tried to handle it himselfinterally. Mr. Craig stated that he talked to the employees and also talked with Capt. Etheredge about his attitude. Mr. Craig stated that he and Capt. Etheredge had multiple conversations about his attitude andhow he spoke to employees. Mr. Craig stated that they had multiple conversations even before he was Deputy Chiefand was still on shift as a Captain. Mr. Craig stated hel has done this job for40 years between being a volunteer and full-time employee and retiring in 2022 after 34 years with the City of] Hapeville. Mr. Craig stated he had dealt with employees for a long time and was Battalion Chiefin Hapeville and knows how to talk to people. Mr. Craig stated that unfortunately in this day and time, he may should have gone to HR with it. Vice Chairman Worsley asked Mr. Craig as Deputy Chief, if Captain Etheredge would report to him as well. Mr. Craig acknowledged that he would. Vice Chairman Worsley stated that Deputy Chief stated hel had hadmultiple conversations with Mr. Etheredge and asked ifhe had documented any oft those conversations in his files. Mr. Craig stated that he did not. Vice Chairman Worsley asked Mr. Craig/why he would not discipline Capt. Etheredge on his own, and why he would need Chief Stephens. Mr. Craig stated that it would not have went anywhere because, ultimately, Chief Stephens/would have had to agree to any discipline or suspension, and it wouldn't have went anywhere. Chairman King asked Mr. Craig ifhe reached out to Chief Stephens to try and get anything done to see ifit would not have gone anywhere. Mr. Craig stated that he didn't and that he had already had other conversations and no conversations ever went anywhere. Mr. Craig stated that he should have documented it better, without question, but he can tell the Board the stuffis still going on now too. Chairman King stated that ifi it comes to them, they will address it, but it is not an issue today. Chairman King asked Mr. Craig ifhe created the file and put the emails in it. Mr. Craig stated that he did create the folder and put the emails ini it and to the side. Mr. Craig stated the one email that Director Chambers showed him he did read, but the other two he putin the folder and tried to handle it. Mr. Craig stated he remembered a conversation about one that he doesn't believe ever happened and doesn't think that Chief Stephens was in a compromising position and thinks someone was frustrated at the time and just trying to say something. Mr. Craig stated that as aj person he feels ChiefStephens is a good person, but feels he is in over his head with what he is doing as Chief. Vice Chairman Worsley asked Mr. Craig why he thought that any discipline originated by him as Deputy Chief wouldn't have gone anywhere, and what is the baseline driving that feeling? Mr. Craig stated there is a chain of command, and he/found out more ofwhat was going on as far as Chief Stephens' decisions through the department and Captain Etheredge. Mr. Craig stated that Capt. Etheredge and Chief Stephens had more conversations than he and Chief Stephens did, and most oft the things that were changing he found out from someone else, rather than finding out from Chief Stephens. Commissioner Collins asked how often he and Chief Stephens had conversations. Mr. Craig stated that inj passing, and that was about it. Mr. Craig stated they never had weekly or monthly meetings. Mr. Craig stated they talked about doing that and every once ina a while they would have arguments on the phone about stuff such as matrixes. Mr. Craig stated that we can second guess these things all the time and the arguments they had were over things that needed to be addressed. Mr. Craig stated there is a staffing matrix in the County that isi right now not able to meet due to lack of personnel. Mr. Craig stated that the entire west side oft the County stays pretty much uncovered 2/3rds oft the time or better. Mr. Craig stated there are issues between the volunteers and the paid staff and the conversations come up on a regular basis with no resolve, and there needs to be. Mr. Craig stated that the concern about a lawsuit here with this, he gets, but there is another one on the horizon that is eventually going to raise its head. Mr. Craig stated that it was trying to be corrected and, as he put in the letter, that is the concern he had. Mr. Craig stated that it is frustrating to be in that spot and not be able to correct something, but he felt in trying to handle it externally with the actual emails that he could get it under control, keep the personnel they had, and try to move forward. Mr. Craig stated in hindsight, that obviously wasn't a good choice. Chairman King asked Mr. Craig how many years he was in Hapeville. Mr. Craig stated that he was there 34 years and 40 years total ini the fire service. Chairman King asked him ifhe would consider himselfa good leader in the fire service. Mr. Craig stated he would like to think sO, yes. Chairman King asked him if this wasn't him and was one ofhis employees, with the County violations, would he terminate him? Mr. Craig stated that he didn't feel it was a terminating offense. Mr. Craig asked, should II have been disciplined? Yes, and I should have handled it better. Chairman King asked Mr. Craig, ifhe was the Chief, and someone on his staff had to be taken to Human Resources because they had violated County policies that could have the County at liability or in trouble, would he feel they deserved another chance, or would he show his leadership and terminate them? Mr. Craig stated that he would have given them a suspension, explained to them what they had done wrong, why they did wrong, and moved forward from that point. Mr. Craig stated that it was poor judgment on his part, and he acknowledged that. Mr.Craig stated that he knows his job and has leadership ability. Mr. Craig stated that hel knows the Board are busy people and that is all he has for them. Mr. Craig left the meeting at 4:39 p.m. Director Chambers asked Chief Stephens, after pulling a report, ifthe number ofe employees Out of departments 30,35, and 36, was actually around 67 active employees? Chief Stephens stated that this was accurate and there is a blend of part-time employees. Chief Stephens stated the accurate number is between 30-32 employees and that number is steadily increasing. Chief,Stephens stated that he would like to say that hel has never had an out-of-the-way conversation with Chief Craig. Chief Stephens stated that he doesn't know what hei is talking about regarding arguing or fussing. Chief Stephens stated there may have been at time when there was an argument about what station was staffed or what station wasn't, but that is written outi ini their staffing matrix in the way those are brought up. Director Chambers asked Chief Stephens to share with the Board details about a conversation he had with Capt. Etheredge regarding a conversation between Capt. Etheredge and ChiefCraig. Chief Stephens stated that with these emails, he received a call from Capt. Etheredge one evening. Capt. Etheredge wanted tol know ift there was aj problem andi ift there were some complaints against him. Chief Stephens stated that he knew the investigation was going on and had tol be neutral and tell Capt. Etheredge that he didn't know what he was talking about. Chief Stephens stated at that point no one had been called in, and they were trying toi figure out where the stuff came from. Chief Stephens stated that they didi not know who wrote the anonymous letters. Vice Chairman Worsley stated they would come back to that. Chief Stephens stated that Mr. Theron was sitting int the office. and asked Chief Craig ifhe would ever think of writing a letter to the Board ort tol HR. Chief Stephens stated Mr. Craig's answer was no. Mr. Theron then presented al letter to Mr. Craig that was addressed to the Board of Commissioners and asked Mr. Craig ifh he wrote it. Chief Stephens stated Mr. Craig then told him yes he did write it. Chief Stephens stated that led them to believe he wasn't being truthful. Chairman King stated that with all due respect that ifh he wrote the letter and didn't send it, iti is similar to texting someone but deciding not tos send it, ifsomeone asked ifhe wrote it, he would probably say no, because he didn't send it and should not be out there. Chairman King asked ifthey went into the computer and found something that he never: sent to determine Mr. Craig was a liar. Chief Stephens stated, no. Vice Chairman Worsley stated that he lied about having knowledge about the three emails. ChiefStephens stated. they were trying to figure out where all the things were coming from. Chief Stephens stated the question was asked, "Did you send these letters to the BOC? No. Have you ever thought ofs sending letters to the BOC?No. Chiefs Stephens stated that Mr. Theron stated that the letter was found on his computer addressed to the BOCa and asked Mr. Craig ifhe wrote it and Mr. Craig responded yes. Chief Stephens went back to the conversation between him and Capt. Etheredge and stated that Capt. Etheredge told him that ChiefC Craig, or his shift, that morning, told him that hel had some complaints against Capt. Etheredge. Chief Stephens stated that Capt. Etheredge asked Chief Craig ift they could discuss them and Chief Craig told him no, no, it's nothing to worry about. Chief Stephens instructed Capt. Etheredge to call Chief Craig back and make sure he heard what he was saying correctly and Capt. Etheredge did. Chief Stephens stated that Chief Craig had knowledge ofthe complaints and who they were against, but still failed to address them. Chief Stephens stated that he kept hearing today from Mr. Craig that he was going to address the complaints internally. Chief Stephens stated nothing ever was done, tol his knowledge. Vice Chairman Worsley stated to Chief Stephens that he had just said that he knew nothing about them doing an investigation until Capt. Etheredge called him and asked him what was going on. Chief Stephens stated that is correct because ChiefCraig asked him and told him that he had these complaints against him. Chief Stephens stated he couldn't tell Capt. Etheredge that they were dealing with al long list ofthings in HR and still trying to figure out where these things were coming from. Vice Chairman Worsley stated tol him that it was backwards, which is irrelevant in this case. Commissioner Plant asked Chief Stephens ifMr. Craig being terminated would solve any problems. Chief Stephens stated he feels like it has already, and the attitude has changed already. Chief Stephens stated the incident created discourse, and he feels that it has already changed. Chairman King asked Chief Stephens ifhe had personal issues with Chiefc Craig and avoided talking to him because ofhis role, or does he feel like he gave him as much time as any other employee? Chief Stephens stated that he feels he gave him just as much time as any other employee and their offices were right across from each other. Chief Stephens stated that a lot oft times they conversed back and forth between offices, and he was not sure about just passing. Chief Stephens stated that they have talked and stood in front of the door and talked about mapping, because ChiefCraig didn't understand the way the staffing is laid out. Chief Stephens stated they have had those conversations. Vice Chairman Worsley stated that at this time, the Board's responsibility is to decide to uphold, overturn, or modify the decision to terminate. Chairman King asked if demotion was an option in lieu of termination, due to the years ofs service and no one else being terminated. Interim Administrator Gorton stated that his decision was based offofwhat Mr. Craig told him and what HR and Chief Stephens presented tol him. Chairman King asked Interim Administrator Gorton ifanyone had made a recommendation to him. Interim Administrator Gorton stated they had not, and he stayed unbiased the entire time until he spoke with Mr. Craig. Interim Administrator Gorton stated he spoke with Mr. Craig on Wednesday, read the investigation on Thursday, and made his decision onl Friday. Director Chambers stated that County Administrator McCarthy was the Administrator An motion was made by Vice Chairman Worsley and seconded by Commissioner Collins to go into Executive Session for the purpose of Personnel and Litigation at 4:47 p.m. All were in A motion was made by Commissioner Collins and seconded by Vice Chairman Worsley to come out of the Executive Session at 5:22 p.m. All were in favor. A motion was made by Vice Chairman Worsley and seconded by Commissioner Collins to go back into the Regular Session at 5:24 p.m. All were in favor. A motion was made by Vice Chairman Worsley and seconded by Commissioner Collins to uphold the Interim County Administrator's decision. All were in favor.
