There were several meetings to review Florin Hill Stormwater plans which directly affect BMP 107 & 125. Ihave received the "As Builts" for BMP 125: from ARRO and they have been provided to RETTEW for review. With final reviews of thej plans for Florin Hill coming to an agreement, Ibelieve that I willl be able to meet with RETTEW at BMP 125 to discuss options and pricing. BMP 107 will need to wait until Amtrak repairs the end walls. Now that Florin Hill Agreement is coming to an agreement, Ih have requested a meeting with RETTEW on sight of BMP 125 to look at options for thel Borough. RETTEW is working on project 13. Enforcement. A. Enforcement authority: The Borough Code Enforcement Officer shall enforce this chapter. B. Notice and prosecution of violations. (1) Int the event ofa violation ofthis chapter the Code Enforcement Officer may contact the owner in writing to notify the owner of the violation. The Code Enforcement Officer may issue a notice of violation via certified mail outlining the violation, remedies, and penalties for noncompliance. (2) Ifthe Code Enforcement Officer has served ai notice of violation and the notice of violation: is not complied with within thet time specified in such notice orifthe Code Enforcement Officer determines that such notice ofv violation will have no practical or beneficial effect, the Code Enforcement Officer may, with consultation of the Borough Manager, pursue summary criminal proceedings and shall notify Borough Council at the next regularly scheduled meeting. C. Penalties: Any person who shall violate a provision of this chapter, shall fail to comply with any requirements thereof, or shall fail to comply with any order of the Code Enforcement Officer shall be liable upon summary conviction therefor to fines and penalties of not less than $100 nor more than $1,000 plus all costs of prosecution, which fines and penalties may be collected as provided by law. Costsofprosecution shalli include the Borough's attorneys' fees as authorized by Section 3321(a)(5) of the Borough Code. All fines and penalties collected for violation of this chapter shall be paid to the Borough Treasurer. Each day that a violation continues and each section of this chapter which is violated shall be deemed a separate offense. $205-5. Interpretations and Appeals. Where more than one provision of this chapter controls a particular matter, the provision that is more restrictive upon uses and structures shall apply. Thej provisions ofthis chapter are in addition to any other applicable Borough ordinances. The Code Enforcement Officer shall apply a literal interpretation to this chapter. Ifaj party disagrees with an: interpretation ofthis chapter by the Code Enforcement Officer, the party may appeal to Borough Council. Such appeal shall be made in writing within 101 business days after such decision has been made or violation issued. The appeal shall be verified by an affidavit, shall state the grounds therefore and shall be filed with the Borough Secretary. The appeal shall be accompanied by the appeal fee which shall be established by ordinance or resolution of Borough Council, and no appeal is complete without the appeal fee. The appellant or his representative shall have the right to appear and be heard if such right is requested ini the written appeal. Borough Council shall make aj prompt decision on such an appeal. Borough Council shall render a written decision, copies of which shall be provided to the Code Enforcement Officer and the appellant. In making a decision on an appeal from a decision of the Code Enforcement Officer, Borough Council may vary or modify any provision ofthis Code where there are practical difficulties in the way of executing the strict letter oft the law SO that the spirit ofthel law shall be observed, public safety secured, and substantial justice done. Such variation or modification shall be the minimum necessary in order to grant relief. $205-6. Word Usage. Unless stated otherwise, the singular shall also regulate the plural, the present tense shall include the future tense, and the masculine shall include the feminine, and vice versa. CODE - Any law or ordinance in effect in the Borough, specifically including Chapter 116, Curfew, Chapter 130, Firearms, Chapter 170, Noise, Chapter 195, Property Maintenance, and CODE ENFORCEMENT OFFICER - The person appointed by Borough Council to enforce this DISRUPTIVE CONDUCT = An act by an occupant of a rental unit or by a person present at a rental unit involving public drunkenness, consumption of alcoholic beverage in public, public urination or defecation, the unlawful deposit oftrash or litter onj public or private property, damage to or destruction of public or private property, the obstruction of public roads, streets, highways or sidewalks, interference with emergency or police services, use of profane or obscene language or gestures, indecent exposure, fighting or quarrelling, or any other act defined as "disorderly conduct" in the Pennsylvania Crimes Code or any act prohibited in Chapter 116, Curfew, Chapter 130, Firearms, Chapter 170, Noise, or Chapter 200, Public Property, of the Borough Code of Ordinances, or which otherwise injures or endangers the health, safety or welfare of the residents ofthe Borough residing in the neighborhood or vicinity of the gathering. It is not necessary that such conduct, action, incident or behavior constitute a criminal offense nor that criminal charges be filed against any person in order for said person to have perpetrated, caused or permitted the commission of disruptive conduct, as defined herein; provided, however, that no disruptive conduct shall be deemed to have occurred unless a police officer shall investigate and make a determination that such did occur, and keep written records, including a disruptive conduct report, ofs such occurrences. C. Requirement to permit: (1) An owner shall obtain a permit from the Code Enforcement Officer, on an annual basis, for each residential rental unit. Annual permits shall be valid for the period of. January 1 to December 31. Failure to obtain a permit for any residential rental unit shall be a violation of this chapter. (2) The owner of a residential rental unit shall pay the annual permit fee set by resolution or ordinance of Borough Council upon application for the annual permit for such residential rental unit. D. The Code Enforcement Officer shall deny and may revoke aj permit for a residential rental unit under the following conditions: (1) The owner does not provide the name, address and phone number of a manager as required by this chapter. 4 (2) The owner does not pay the annual permit fee. (c) The owner shall actively prosecute the eviction proceeding. If the owner does not appear for the hearing, fails to present evidence at the hearing or withdraws the eviction action, the owner shall be in violation oft this chapter and the Borough shall revoke the permit for the residential rental unit. Any person who shall violate aj provision oft this Code; or who shall fail to comply with any of the requirements thereof; or who shall use, maintain or alter a lot, building or structure in violation of any approved plan or directive oft the Code Official or of any order, permit or certificate issued under the provisions of this Code; or who shall violate any order oft the Code Official; or who shall fail to remedy or who shall negligently ori improperly remedy any health hazard; or who shall fail to completely implement aj plan to remedy a health hazard which has been reviewed and approved by the Code Official shall bel liable, upon: summary conviction therefor, to fines and penalties of(a) not less than $100nori more than $1,000 plus all costs ofprosecution, including the Borough'sa attorneys' fees, for a first offense, (b) not less than $200 nor more than $1,000 plus all costs of pros- ecution, including the Borough'sa attorneys' fees, for as second offense, and (c) not less than $3001 nor more than $1,000 plus all costs ofp prosecution, including the Borough'sattomeys fees, for a third offense, which fines and penalties may be collected as provided by law. All fines and penalties collected for violation ofthis Code shall be paid over to the Borough Treasurer. Each day that a violation continues and each section of this Code which is vio- lated shall be deemed a separate offense. This Code may also be enforced by an action in G. Any person who defaces or removes a condemnation placard without the approval of the Property Mainte- nance Code Official shall be subject to thej penalties provided by the code. K. Section 111.3 shall provide as follows: 111.3. Failure to comply. Whenever the owner of a property fails to comply with a demo- lition order within the time period prescribed, the Code Official shall request the Borough Solicitor to institute an action at law or in equity against the property owner to obtain an order authorizing the Code Official to raze and remove such structure or contract for the razing and removal of such structure at the expense of the owner of the property. At the completion of such: razing and removal, the Borough Solicitor shall file ai municipal claim as a lien against the property in the amount oft the Borough's costs plus aj penalty of10% of such costs and for allowable attorneys' fees. Borough Council, the Code Official or any officer or employee of the Borough designated for this purpose is hereby authorized to give notice, by personal service, by United States mail or by posting the property, to the owner of any premises whereon trees and shrubbery are growing or remaining in violation of this Section 302.4.1 directing and requiring such owner to remove or trim such trees and shrub- bery sO as to conform to the requirements of this Code, within 10 days after the issuance of such notice or such other time period as may be set forth in the notice. Inc case any person shall neglect, fail or refuse to comply with such notice, within 10 days after the issuance of such notice or such other time period as may be set forth in the notice, Borough authorities may remove or trim such trees and shrub- bery, and the cost thereof, together with aj penalty of10% of such cost, and allow- able attorneys' fees may be collected by the Borough from such person ini the man- ner provided by law. P. Section 302.8 shall be amended to provide as follows: 302.8. Vehicles. Except as provided in other regulations, the parking and storage ofr motor vehicles, including but not limited to automobiles, buses, vans, trucks, recreational vehi- cles, and trailers, shall be limited as provided herein. 302.8.1. Licensed and inspected vehicles. Vehicles which have a current license and inspection may be stored upon a premises in accordance with the requirements oft the Borough Zoning Ordinance and other applicable ordinances and regulations 302.8.2. Unlicensed or uninspected vehicles. Vehicles which do not have both a current license and a current inspection may be stored within a completely enclosed structure on any premises. Unlicensed or uninspected vehicles shall not be stored outside ofa completely enclosed structure on a premises ifs such storage constitutes anuisance orifsuch vehicle is al hazardous vehicle. Except as provided below, prior to the unenclosed storage of any unlicensed or uninspected motor vehicle on any premises, the owner of the premises shall obtain a permit from the Code Official for the storage of such vehicle. The Code Official shall determine that the motor vehicle is not al hazardous vehicle and that the proposed storage shall not constitute anuisance prior to the issuance ofaj permit. Such permit shall authorize the storage ofthe motor vehicle: for aj period of90 days. The owner shalll have the rightt to appeal a denial ofaj permit by the Code Official as provided in Section 106 herein. Storage unless such vehicles are hazardous vehicles as defined herein. 7 of an unlicensed or uninspected vehicle without obtaining a permit as required herein shall constitute a violation ofthis Code. The Code Official and/or the Police Department may order the removal of an unlicensed or uninspected vehicle for which a permit has not been obtained using the procedure set forth in Section 302.8.3. Exceptions: No permit shall be required by the operator ofai motor vehicle towing or repair establishment. Such establishments shall be permitted to store un- licensed or uninspected motor vehicles for a period ofr not more than 90 days. 302.8.3. Hazardous vehicles. No person who owns a hazardous vehicle shall park, place, deposit or permit the parking, placement or depositing of the hazardous ve- hicle on any property. No property owner shall permit any hazardous vehicle to remain on aj premises. Ifany hazardous vehicle is] parked orj placed upon aj premises, the Code Official and/or the Police Department shall notify the owner or occupant of the premises of the duty to remove the hazardous vehicle. The Code Official and/or the Police Department shall post upon the hazardous vehicle in a conspicu- ous place a notice directing the removal of the hazardous vehicle within ten days. Should the vehicle not be removed, the Code Official and/or the Police Department shall serve a second notice which shall be in writing and shall provide a time limit not to exceed five days within which thel hazardous vehicle has tol bei removed. Said notice shall be served as provided in Section 109 herein and shall additionally be posted upon the hazardous vehicle. Ift the owner of the premises fails toi remove the hazardous vehicle, the Borough may take action to abate the health and/or safety hazard resulting from the hazardous vehicle in the manner provided in Section 107.5 herein. A new Section 302.10 shall be added which shall provide as follows: 302.10. Used vehicle parts and tires. Noj person shall place, deposit or permit the placement or depositing of used vehicle parts or tires outside of an enclosed structure on any property unless such used vehicle parts or tires are secured toj prevent removal and unless such used vehicle tires are wrapped or covered in a manner sufficient toj prevent the accumulation of any standing water, to eliminate all breeding grounds for insects and to eliminate all areas which could be used as harborage for rodents or other animals. R. Section 304.14, Insect screens, shall be amended by inserting April 1" and "September 30" into the appropriate places. S. Section 308, Rubbish and Garbage, shall be amended by adding new Sections 308.4, No- tices of violation, and 308.5, Enforcement, which shall provide as follows: 308.4. Notices ofviolation. Borough Council, the Code Official or any officer or employee ofthel Borough designated for this] purpose is hereby authorized to give notice, by personal service, by United States mail or by posting the property, to the owner of any premises on which there exist accumulations of rubbish or garbage remaining in violation ofthe provi- sions of this Code, directing and requiring such owner to remove such accumulations of rubbish or garbage SO as to conform to the requirements of this Code, within five business days after the issuance of such notice. In case any person shall neglect, fail or refuse to comply with such notice, within seven business days after the issuance of such notice, 8 Borough authorities may remove such accumulations of rubbish or garbage, and the cost thereof, together with aj penalty of 10% of such cost, and allowable attorneys' fees may be collected by the Borough from such person in the manner provided by law. IfBorough Council, the Code Official or any officer or employee ofthe Borough has given notice under this section in the calendar year and the owner did not comply with the notice within the required five business days, the Borough shall not bei required to give additional notice to the owner before the Borough removes accumulations of rubbish or garbage on the property in that same calendar year, and the Borough may collect the cost thereof, to- gether with a penalty of 10% of such cost, and allowable attorneys' fees from such person 308.5. Enforcement. The Code Official or any police officer shall be authorized toi institute summary criminal proceedings against any person who fails to comply with the require- ments of this Section 308 prohibiting accumulations of rubbish or garbage and requiring proper storage and disposal of rubbish and garbage. The failure to maintain exterior prem- ises and property and the interior of a structure free from accumulation of rubbish and garbage and/ort the: failure ofa any person to comply with the requirements of Sections 308.2 and 308.3 ofthis Code: is a violation ofthe provisions ofthis Code, whether or not Borough Council, the Code Official, or other officer or employee ofthel Borough provides the notice set forth below. Any police officer and the Code Official may institute summary enforce- ment proceedings pursuant to Section 107 ofthis Code. BE AND IT IS HEREBY ORDAINED AND ENACTED by Borough Council of the Section 1. Borough Council of the Borough of Mount Joy, Lancaster County, Pennsylvania, hereby levies an annual tax for general Borough purposes upon all taxable real property within the Borough and establishes the millage rate at 4.75 mills based on an assessment ratio of100 percent ofa assèssed value fort the year 2025. Thei tax rate expressed in dollars and cents shall be $0.475 on each one hundred ($100.00) dollars of assessed valuation oft taxable property. Section 2. All taxes imposed under this Ordinance paid by April 30, 2025, shall be subject toa at two (2%) per cent discount. All taxes imposed under this Ordinance which are: not paid in full by. July 1,2025, shall be subject to a flati ten (10%) percent penalty. Notwithstanding the foregoing, Council may change such time periods by resolution, ifa change is authorized by the Legislature Borough ofMount Joy, Lancaster County, Pennsylvania, as follows: oral Declaration of Emergency by the Governor. Section 3. The provisions of this Ordinance are severable, and if any section, sentence, clause, part or provision hereofs shall bel held tol be illegal, invalid or unconstitutional by any court of competent jurisdiction, such decision of the court shall not affect or impair the remaining sections, sentences, clauses, parts or provisions of this Ordinance. Itis hereby declared to be the intent ofBorough Council that this Ordinance would have been adopted if such illegal, invalid or unconstitutional section, sentence, clause, part or provision had not been included herein. Section 4. AlIOrdinances or pamfOninnesinomsiasnt herewith arel hereby repealed. Section 5. This Ordinance shall take effect January 1,2025. Joy, PA 17552 Office: 717-653-1650 Fax: 717-653-0062 2 Introduction: This study! has been prepared for the Council of Mount Joy Boroughi to analyze the feasibility of additional on-street parking on Delta Street between East Main Street and East This report will provide the advantages and disadvantages of permitting on-street parking and provides recommendations fori the potential harzards and damages. Henry Street. Study Area: The area oft the study is Delta Street in Mount. Joy Borough, specifically the section between East Main Street and East Henry Street. This area is referred to as the 0-100 block of Delta Street. This roadywayi is designated as a north and south local road. The roadwayi is frequented by motor vehicles, bicyclists and pedestrians. History: Delta Street was established int the early settlement of Mount. Joy Borough. In 2011, Mount Joy Borough, AMTRAK: and PennDOT improved the roadway by making the roadway brick and adding a covered walkway ont the east side of Delta Street. The improvements were meant to assist with moving people from downtown tot the AMTRAK station. Exsisting Conditions: Delta Street is ai flat and straight aligned roadway that is approximaely 221 feet wide and 205 feet long. There are two existing parking spaces ont the west side oft the street. The parking section is for 2H hour parking from 6AM-9PM (21 hour parking only). This parking areai is not governed by any ordinance in Mount. Joy Borough. The parking section begins 201 feet from East Henry Street and extends 601 feet towards East Main Street. Sheetz Funeral Home entancel drivewayi is on the west side of the street and begins 901 feet from East Henry Street and extends 651 feet towards East Main Street. The roadway has a stop sign at the There are noi fog lines or dividing lines ont the roadway. The roadway is currently designated for1 two way local traffic with only two entry points and one driveway to al business. There are sidewalks on the east and west side of the roadway and a cross walk at both ends of the roadway. The sidewalks assist pedestrians walking to nearby businesses and the northeast corner and southwest corner of the roadway. 3 AMTRAK train station. Delta street has miminal traffic compared to other roadways ini the On October 26, 2024lconducted an observation of the roadway for approximately 30 minutes. There was six vehicles parked on the east side of the roadway and one vehicle parked int the parking spots located ont the west side of the roadway. During my observatons,Iopserved seven pedestrians using the nearby sidewalks, two bicyclsts traveling on the roadway and seven vehicles traveling on1 the roadway. Out oft the seven vehicles, onlyt two of them were attempting to park on Delta Street or in the nearby parking lots. Ispoke to a nearby business owner (Yah Brewery/Hulk Hoagies) who stated thati four of the six cars on1 the road were either their cars or employees. The owneri informed me there are four apartments located in the building located at 18 East Main Street. She informed me there are typically four vehicles that park on the east side of Delta Street belonging to those tenants. lalso spoke to the owner of Sheetz Funeral Home who stated they frequently use the available parking on the east side of Delta Street. There is alsoa Mount Joy Municipal Parking! Lot located at 10 East Henry Street and 20 East Henry Street. Prior to the improvments in 2011, business owners (formerly known as Higher Grounds and Sheetz Funeral Home) had various concerns about the loss of parking for customers and area. There is also adequate lighting for the roadway and sidewalks. employees. Assessment: Stopping, standing or parking may be restricted along the curb or edge of a roadwayi ift the distance between the center oft the center line pavement markings (or the center of the roadway if center line pavement markings are not present). and the curb or edge of roadway is less than 191 feet on major arterial highways, or less than 181 feet on other roadways (PennDOT pub. 212.114). In addion, if the street width is such that, if vehicles are parked along one or both curb faces or edges of the roadway, two vehicles cannot move abreast of one another in the same or the opposite direction without one) yielding to allow the other vehicle to pass. Delta Street provides 111 feet per lane of travel. A minimum of (8) eight feet ist the preferred width of on-street parking space PennDOT/MUTCD: Section 3B.19 Parking Space Markings). If parking is allowed ont the east side of the roadway, there will be approximately 141 feet of travel lane remaining. Vehicles will ini turn have to slow and yield to each another while traveling on the roadway. The current sign should be removed until this portionofroadway is added to the ordinance. Parking limitations would need to align with the same ordinance which guides parking regulations on East Main Street between South Market Street and Marietta.
