CALLTOORDER The meeting was called to order at 7:30 p.m. by Chairman Ralph Ghent, who also led the Commission in the Pledge of Allegiance. 2. APPROVAL OF MINUTES Motion: Bill Butts motioned to approve, with corrections, the September 30, 2024, Planning Commission Minutes. Seconded by Kim Buynak. Vote: All in favor, none opposed. 3. CIIZENCOMMENISINRE items not on the agenda) None 4. - CARROLL-/EREDERICK COUNTY PLANNERS Carroll County Planner- - Hannah Weber - Hannah updated the Commission on the Carroll County Planning. They have received the housing study from the consultants and will be presenting it to the County Planning Commission on November 6, 2024. Two Zoning Texts Amendments are going to aj public hearing on November 14th. They are for Solar Site Design Guidelines and for House Bill 538 tol bring the County Zoning Code into compliance with state law. That public hearing is with the County Commissioners on November 14th. They have also launched their Master Plan Website, Carroll2035.org. On the website are two surveys available Frederick County Planner - Vanessa Moreno - Vanessa updated the Commission on the Frederick County Planning. The Investing in Workers and Workplaces Plan. This plan - undertaken inj partnership with the Division of Economic Opportunity = will increase land designated for targeted economic opportunity uses through the review ofs select growth areas and to take. current land use designations. The Residential Development Pipeline has had no major changes int the municipalities, including the City ofFrederick. The growth in the southeast quadrant of Frederick. Projects are: in the pipeline, but as ofnow, they are currently moving rather slowly through the development review department. They are considered low priority for the County overall. Bill 24-17: AN ACT to Amend Chapters 1-19 oft the. Zoning Ordinance to Update Certain Existing Definitions and Add New Definitions. The motion was not passed, and the staff will revisit the definitions. 5. SITEPLANS/ SUBDIVISIONS/DEVELOPMENT PROIECTS None 6. NEW BUSINESS/INTRODICTION/RECOMMENDATION Sign Request for Cigars & More - The owner of the Cigars & More store, located at 1001 Twin Arch Road, requests approval for a new business sign. Ralph Ghent motioned to conditionally approve the proposed exterior signage located at 1001 Twin Arch Road, Suite 11, ofthe Twin Arch Shopping Center, specifically the proposed sign for "CIGARS & MORE," with the condition that the proposed signage also complies with any shopping center exterior signage requirements, and to delegate to the Zoning Administrator the authority to issue the permit for the proposed sign. Martina Hatley seconded the motion. Proposed Fire/EMS Certification Letter - FIRE/EMS Proposed Certification letter for review and possible approval. Martina Hatley motioned to recommend approval oft the FIRE/EMS Certification letter, with the edit to remove the Approaching Inadequate section. Wildwood Section VII, Discussion of Variance Request The owner of Wildwood Section VII is requesting site plan variances or modifications. Attorney John Maguire and Michael Vansant, the design engineer, presented the project for the owner, Michael Berman. Mr. Maquire advised the commission that this is not a variance request but more ofa guidance request. Ralph Ghent proposed three points. The first point is that informal guidance for any developer relative to interpreting or understanding our code is sought by the developer to the town planner. The second point is that the next step per the code for this planning commission to deliberate and decide on your development plan is at the concept plan stage, not something called aj pre-concept plan, not something referred to as a draft plan, which I did, but it's at the concept plan stage. Third point, or in lieu of considering a formal submission of your concept plan, this body under its authority given in 98-49 through a formal letter that the developer provides to the town showing what hardships exist inj providing a concept plan can then invoke 98-49 for this commission to havea deliberation on your identified hardships to seek guidance to seek interpretation and to Ralph Ghent did a roll call on the agreement on those three points, Steve O'Malley - Yes, Brian Bieda - Yes, Martina Hatley - Yes, Bill Butts - Yes, Kim Buynak - Yes, Ralph Ghent - Yes.
