TOWN OF SAN ANSELMO Minutes oft the Town Council Meeting of. June 22, 2010 Present: 7:00 p.m. Coleman, Greene, Kroot, McInerney, Thornton CALL' TO ORDER AND PLEDGE OF ALLEGIANCE ANNOUNCE ACTION TAKEN, IF ANY, IN CLOSED SESSION Mayor Thornton announced there was no action taken in the closed session. OPENTIME FOR PUBLIC EXPRESSION Donna Monahan, Richmond Road, speaking for the Bolinas Avenue Safety Çommittee, a group of homeowners from Ross and San Anselmo who have safety and flooding concerns. One of their safety issues is Bolinas Avenue which they feel is a speedway with blind corners Flooding concerns are Bolinas Avea and Richmond Road. The Town of Ross has committed funds to study hydrology on Bolinas Avet to mitigate flooding and has submitted for a grant for public safety portion of the project. Monahan asked for San Anselmo to pass a storm water drainage ordinance similar to. Ross's to qualify for Federal Town. Manager Debra Stutsman gave an update for the Bolinas Avenue Neighbors Committee stating the Town of San Anselmo has beeni working closely with the Town of Ross and the Town of San Anselmo has plans to include an $ 18,000 in their 2010-2011 budget for geomorphologist study on drainage improvements on Bolinas Ave. Iti is an expensive and long term project and the San Anselmo Town Council will have to approve the $18,000 study for the geomorphologist. The underground work needs tob be done first, then possible safety improvements on the street and finally paving of the street; regarding the public safety grant, Ross Town Manager, Gary Board, will be submitting grant documentation for both towns, San Anselmo and Ross. She noted the San Anselmo Flood Committee is Mayor Thornton noted that Council has frequently discussed the topic of traffic safety on Bolinas Ave. San Anselmo has taken action jointly with Ross and both towns have increased police enforcement on Steven Lee asked when David Parisi will be coming back to Council with recommendations on traffic calming for Sir Francis Drake Blvd. He supports continuing traffic enforcement. Lee also supports the idea of Council hours to encourage communication and transparency with community members. Stutsman stated David Parisi is still working on the Sir Francis Drake Blvd study and we are hoping to funding. currently working on a storm water drainage ordinance. Bolinas Ave. receive the report mid-July. COUNCIL REQUESTS FOR FUTURE AGENDA ITEMS ITEM 1(a) Minutes of San Anselmo Town Council June 22,2010 McInerney announced that at the most recent Flood Zone 9 Advisory Committee meeting Jack Curley gave aj presentation and is targeting October for public meetings toj present the latest technical study which will address detention basins and the proposed work plan for Flood Zone 9, which will be the road map for the flood protection project needed to attain Federal and State funds. Curley indicated he will be meeting with the Public Work Directors of the towns involved to look at priorities for the towns and there will be money available for some flood prevention projects that can be completed before the upcoming Greene noted that recently PG&E is replacing some of the meters in town with the Smart Meter and he has concerns that the meters might not fall within the Towns wireless ordinance. Greene is apprehensive of the health impact that Smart Meters may generate through radio frequencies and that those who do have Smart Meters say their rates have gone up dramatically. Greene asked Epstein ifl he could ascertain the status of the proceedings that San Francisco has brought to the PUC and asked how difficult it would Stutsman noted that Town staff asked PG&E if they had installed any Smart Meters in the Town of San Town Attorney Epstein noted he has learned that San Francisco has taken an injunctive relief proceeding with the PUC. Epstein will research the issue and will review San Anselmo's wireless ordinance and Kroot stated he has been lobbied fairly hard regarding the Smart Meter and the concerns are with electromagnetic fields; that the new meters give different readings than the meters before; the Smart Meters will put meter-readers out of work. The Subcommittee includes the Antique Dealers Association, Red Hill Merchants Association, Greenfield Merchants Association, Downtown San Anselmo Merchants Association, the Town, and the Chamber of Commerce. The merchants come together, share their concerns and Coleman feels there is a new spirit of working together. Stutsman answered affirmatively stating that the air conditioner was donated by the Friends of the Library. Coleman asked if we could advertise the fact Thornton announced that Community Media Center of Marin which was set up a year ago broadcasts through Comcast Cable Channel 26 (Public Access), Channel 27 (Government Access), and soon will be turning up Channel 30 (Educational Channel); and on Channel 99 U-Verse. They have over 300 memberships of which. over 20 are organizations. Membership numbers are higher than the media centers in San Francisco or Berkeley and they have done this in less than a year. Regarding Item 6 of the minutes, the Joint Powers Agreement for the Ross Valley Fire Department, McInerney requested that the minutes be revised to reflect the fact that he, in concert with Councilmembers Thornton and Coleman, requested clarification oft the mediation clauses and that Epstein M/s, Greene/Mcinerney, to approve the consent agenda with the changes noted for Item 1 (a). Town Manager Debra Stutsman presented the staff report stating the Quality of Life Commission has a membership of seven seats and there are three vacancies available. Woody Weingarten has reapplied for M/s, Coleman/Kroot, to appoint Woody Weingarten to the Quality of Life Commission. AYES: All. aposition. AWARD SAUNDERS NEIGHBORHOOD STREET REHABILITATION PROJECT TO JOHN BENWARD COMPANY, INC. IN THE AMOUNT OF $528,220.21, AND PROVIDE DIRECTION TO STAFF REGARDING EXPANDED SCOPE. Councilmember Coleman recused herself due to the proximity of the project in relation to her home and left the room Public Works Director Steve Myrter presented the staff report. Myrter acknowledged staff's recommendation to award the construction contract for the 2008 Rehabilitation Project to John Benward Company, Inc. in the amount of $528,220.21 and for Council to provide direction on expanding the project scope to include pavement rehabilitation of: Park Drive from Tamal Ave to Calumet ($45,000 cost which is included in the $528,220.21 contract award amount); of Alder Avenue from Yolanda to the cul- de-sac ($23,000 additional cost); and Agatha Court from Saunders Avenue to the cul-de-sac ($15,000 additional cost). With the additional work of approximately $40,000 the contract price would be $571,220.21 which is $131,780 below the budgeted amount of $700,000 established for this project. Myrter stated there are sufficient funds budgeted for this project including the funding for the proposed expanded project scope. The Project is included as part of the Town's FY 2009/ 2010 Capital Improvement Projects Program and is to be funded through the Road Maintenance Fund. Kroot noted that $15,000 is extremely inexpensive to pave Agatha Court from Saunders Avenue to the Myrter acknowledged that it is very cost effective to extend the prices. We are getting very, low prices cul-de-sac. because oft the size of the project and also because of the poor economy. McInerney asked when the project work is scheduled to. be performed. Myrter stated that contractor mobilization will occur the week of July 5th, Myrter intends to walk the neighborhood this week and: next week to inform the neighbors ofthe start of construction. Pascal Sisich, Park Drive, encouraged Council to increase the scope of work to include Park Drive. Anselmo Town Council June 22,2010 Senior Planner Phil Boyle presented the staff report and also introduced Bob Brown, Community Development Director for the City of San Rafael to. answer questions or concerns regarding the City of Boyle provided an overview comparing the use ofi independent third Green Point Raters and Town staff. Page 4 of staff report has cost analysis of an independent person as compared to a staff person. It was concluded, by the Planning Commission, that independent raters would be better than town staff. Since the April 12, 2010 Joint Council and Commission Workshop, some of the requirèments in the Green Building standards have changed. The intent of these changes is to provide increased flexibility and to The Planning Commission wanted to reduce the burden on applicants, for residential remodels, by requiring no additional inspection and no fees paid to Build It Green8(BIG). However quality control may suffer without an independent rater and BIG oversight. There would be no documentation on file San Rafael's Green Building Ordinance. give the applicants more choices. with BIG and it may require additional stafftime. Coleman asked Brown if San Rafael requires green raters. Bob Brown stated San Rafael prefers to use the outside expertise. Boyle stated that it is a balance to determine what level of project requires how many points and what Greene asked when the size & cost of the project gets higher would that require a licensed rater to do the checking and to sign off. Greene feels the bigger the project the more likely there is a possibility of Boyle answered yes in general the larger the project the larger the resources that could be used and the level of project requires a green professional. conflict or the more money the greater potential for conflict. larger the project the more complex it gets, therefore more green points will be required. McInerney asked Brown how the City of San Rafael has handled the issue. Brown stated their concerns have been the availability of their building inspection staff. For new single family residential construction they require a third party rater and they require it to go to BIG for certification. On single family renovations they require a Green Point Rater when. renovation costs are at $100,000 or above. Below $100,000, city staff will do the rating. Thornton asked what is the benefit ofhaving a certification from Build It Green. Boyle stated the certification from Build It Green is mainly done for quality control. Brown noted the green raters work very closely with the real estate agencies SO they will actually have Carla Overberger, San Anselmo Planning Commission, explained that the Planning Commission desired to help the homeowner with the finances associated in the green building. Overberger noted that San Anselmo is last in on the Green Building Ordinance therefore we have an advantage because we can look at Green Building Ordinances from other towns in the county. In San Anselmo 90 % of the construction some value in resale. 5 Minutes of San. Anselmo Town Council June 22,2010 are remodels and flexibility, choice and recognizing the value of green point raters is important. Overberger noted that we can come backi in 6 months and change the ordinance ifv we feel it is necessary. Michael Rex, Sais Ave, encouraged Council to pass the ordinance as is, he does not find fault anywhere in the ordinance and he feels the ordinance is pretty standard for what has been passed by other towns in Pascal Sisich, Kensington Rd, supports the ordinance and encourages Council to approve the ordinance. Casey Mazzoni, Marin County Builders Association, urges council to adopt the ordinance. the county. Ian Mousley, Oak, Avenue, is opposed to the Green Building Ordinance because he feels that it will impact the middle class and low income families. He feels this will segregate the middle class and lower class residents and there are many unintended consequences to all these actions. Mousley asked Council Kroot feels this ordinance is a mistake and that the ordinance is too complicated, too bureaucratic and he prefers the county's former point system. Kroot noted that what is currently being done in building McInerney strongly supports the adoption of the ordinance and applauded the efforts of the Planning to consider how, this ordinance will affect the residents and how it will affect the town. regarding energy efficiency is tremendous. Commission and Staff. Greene feels Council needs to take action on this item and he is in support of the ordinance. Coleman is in support of the Green Building Ordinance but she wants everyone to keep in mind the tremendous costs of buying a house in San Anselmo and that young people can'treally afford the cost of Thornton applauded Staff and the Planning Commission for their work done on the Green Building M/s, Mclnerney/Greene, to approve Resolution #3913 adopting Green Building Standards and introduction and first reading of an ordinance amending the San Anselmo Municipal Code creating Chapter 19 of Title 9, Green Building Requirements, and amending Title 9, Chapter 1, Construction Codes; Chapter 12.16, Plumbing Code; Chapter 12.12, California Building Code and for the Town Manager to read the Ordinance by title only.. APPROVE THE TERMINATION OF AGREEMENT WITH THE SLEEPY HOLLOW FIRE PROTECTION DISTRICT IN CONSIDERATION OF THE AMENDED AND RESTATED Town Manager Debra Stutsman presented the staff report. Stutsman stated staff's recommendation is for Council to authorize the Mayor to sign the Termination Agreement between the Town of San Anselmo and the Sleepy Hollow Fire Protection District, to unwind the current agreement dated September 17, JPAJ FOR THE ROSS VALLEY FIRE DEPARTMENT. 6 Minutes of San Anselmo Town Council June 22, 2010 2004, in consideration of the new "Amendedand Restated JPA Agreement among Fairfax, San Anselmo Greene is concerned that the new agreement may not be fully executed before the old agreement is ended and suggests that the new agreement be signed by all interested agencies before the old agreement is M/s, Greene/Kroot, to approve the termination of agreement with the Sleepy Hollow Fire Protection District in consideration of the Amended and Restated JPA for the Ross Valley Fire Department providing that the signing of the termination agreement is done only after the Amended and Restated JPA and Sleepy Hollow. terminated. has been fully executed with all necessary signatures. NOES: None. 6. 2010-11 PROPOSED BUDGET: (A)UPDATE FROM STAFF ON 2010-11 BUDGET PREPARATION AND DISCUSSION ON Town Manager Stutsman stated that staff plans to come forward with the 2010-2011 proposed budget at the July 27 Council meeting. They have been looking at a $200,000 to $300,000 budget shortfall between the projected revenue and projected expenditures in the next fiscal year. However staff has been working hard to refine revenue projections and to cut expenditures in order to get a balanced budget. They. have Stutsman stated there are a couple of expenditures that staff feel are necessary and would like Council's approval: $50,000 safety issue to repair Town Hall tower which is in need of dry rot repair; $15,000 for a Caltrans requirement that the Town conduct a bridge safety study on four of the town's bridges. Stutsman asked direction from Council regarding their interest in continuing the team building session that was started in May. $10,000 would be required by the facilitator to continue the sessions. Also, regarding staff goals for 2010-2011 Stutsman asked Council to discuss if they want to have new goals, modify the current goals or to direct staff to continue working on the current goals. McInerney asked if Council will be getting a monthly Library Revenue & Expenditure report similar to Stutsman replied that Council could direct staff to prepare a monthly Library Revenue & Expenditure report. Staff does not normally report on a monthly basis on other funds. The Recreation Fund is an enterprise fund which is expected to cover department expenditures with revenue sO the monthly reporting McInerney thinks it would be useful to have some sort of fund report sO the fund can be monitored. 2010-11 GOALSAND OBJECTIVES. done sO with considerable help from the Police Department with cuts to their budget. the monthly Park & Recreation Revenue & Expenditure reports. isto monitor the fund. Kroot asked when the work on Town Hall tower be done. Myrter stated that October would be the optimum time. Greene asked Stutsman to be more specific in regards to Police Department cost cutting. Stutsman stated they are hoping to reduce their overtime by $70,000 through some scheduling changes; fuel costs will be decreased because of new energy efficient vehicles and booking costs with the County Coleman stated that she would like to see the document regarding facilitator costs for the team building sessions before she votes on including it in the budget therefore she would like to continue the issue to the ofMarin will be reduced by approximately $10,000. next meeting. 7 Minutes of San Anselmo Town Council June 22, 2010, Coleman has strong feelings that it is not the obligation of the Downtown Merchants to provide $3,000 to $5000 for downtown holiday lights during the holidays and she feels it should be paid by the Town and Kroot thinks Coleman's idea is good and he feels it would help the merchants because sO many of them Greene also likes the idea of the town helping the merchants by paying for the holiday lighting and he is not sure that Council wants to invest $10,000 in team building sessions. Green expressed his appreciation to the Police Department for their part of balancing the budget by reducing the department's overtime. (B) REPORT FROM LIBRARY DIRECTOR ON PROPOSED USE OF LIBRARY TAX Town Librarian Sara Loyster stated they, are thrilled by the passage of Measure B and she gave special thanks to Elihu Welber and Steve Lee: for their campaign efforts which will bring approximately $210,000 annually to the Library. Loyster announced she will be retiring soon and that they are currently working on: recruitment for a new Town Librarian. Regarding immediate improvements Loyster stated they will be purchasing more materials, purchasing 6 new computers, a few new printers and possibly a new phone FUNDINGIN2010-11. system however all ofthis will take some time to implement. McInerney asked ift they had any plans for repairs. Loyster stated that one oft the first things they would like to do is some landscaping and cosmetic repairs. McInerney wondered if people would agree that landscaping should come out of Measure B money. Attorney Epstein indicated that the measure called for enhancing general library services. 7. TOWN DISCUSSION ITEMS TO PROVIDE DIRECTION TO STAFF AS TO PRIORITY AND NEXT STEPS. ACOUNCIMEMBER OFFICE HOURS Stutsman stated that Councilmember's McInerney and Coleman have both suggested that Councilmember's. have "office hours" on the Town Hall Plaza on ar rotating basis to provide the citizens a chance to have a real exchange with a Councimember that is not allowed by the Brown Act at a regular meeting. 8 Minutes of San. Anselmo Town Council June 22,2010 McInerney suggests the San Anselmo Town Council have "office hours"; a program similar to Mill Valley's Town Council: year round, 2 days a month (usually Saturday or Sunday), from 10:00 a.m. to 12:30 p.m. McInerney offered to set up arotating schedule if Council is interested in doing SO.. Kroot is willing to give it a try for a few months and see how it goes; Saturday mornings can be difficult with his work schedule. Greene advocates the idea. Coleman thinks it would be fun and Council should give ita a try. Thornton thinks itj is a good idea and Council should re-evaluate the program in November. (B) CAMPAIGN REFORM ORDINANCE Stutsman acknowledged that Councilmember McInerney has suggested the Town adopt an ordinance limiting contributions to political campaigns to $250 from a. single donor. The previous Council had directed staff to prepare an ordinance on campaign reform that focused on independent committee expenditures and the Town Attorney has been working on such an ordinance. Stutsman requested Kroot noted that he ran for Council in the nineties and he was shocked over the amount of money that was raised, it seemed over scale for our community even at that time. He thinks the issue is worth Council McInerney noted that a comprehensive election campaign reform is a complicated issue and thinks there would be legal problems ift the Town wanted to put a limit on spending. McInerney suggests taking it on as smaller scale, something that would let the people know that we do not want to have large contributions. McInerney also suggests Council discuss the possibility of voluntary spending limits that have incentives. McInerney would like ai reasonable figure, something that has worked in other towns ofs similar size. Greene is concerned that iti is a very problematic area and he has mixed feelings about it. Coleman feels that this has never really. been a problem in San Anselmo; she is willing to discuss it at a Thornton stated she has a strong ethical belief in what she takes on as a Councimember and she. feels that the disclosure portion of the contributions is important sO the public has the information. He feels that Kroot was feeling skeptical about the idea in regards to danger but now feels there are plenty of plaçes in town that are. not dangerous. He thinks that this will take time from staff and to consider a part-time paid Stutsman noted that there have been problems in the past with people using town equipment and one of the parameters should be that the volunteers. need to bring their own tools and equipment. Christine Craig, Madrone Avenue, suggests that people adopt little sections because small sections are: not John, landscape architect, San Anselmo, feels there is a lot ofmedian area in town and he has concerns that ifiti is not done right it could look a little peculiar. He doesn't see how you can get volunteers to perform something SO comprehensive. John is willing toj put some time and effort into the program. there are a lotofrèsidents that are willing toj participate. coordinator. SO hard to do. Bernie Bernbaum, Brookside Avenue, thinks there should be a plan. McInerney feels there is a sense that people want to do something with the medians and suggests informing others about forming a committee regarding landscaping some oft the medians with the understanding ofbudget and staff limitations. Stutsman stated that she will put something in her newsletter informing people that a volunteer committee (D) VIEW ORDINANCE - Vice Mayor Greene has suggested that the Town should enact a view ordinance. Interim Planning Director Henderson has prepared the memo discussing the pros and isb being formed regarding landscaping some of the medians in town. cons ofa view ordinance. Discussion on a view ordinance was continued to a future time. 8. APPOINT ALTERNATE TO THE MARIN COUNTY COUNCIL OF MAYORS AND COUNCIEMEMBERS MCCMOLEGIBLATVE COMMITTEE.
