As a member of the Flood Zone 9 Advisory Board, McInerney is concerned there will be a loss of momentum within the Marin County Public Works Department in relation to Flood Control in light oft the resignation of Farhad Mansourian, Public Works Director, County of Marin. McInerney stated it will bea Public Works Director, Sean Condry, reported the Safe Routes To School Project at Wade Thomas School and St. Anselm's School is nearing completion noting the sidewalks were installed before school sessions resumed. Condry announced he recently applied for an additional $600,000 grant from the Safe Routes to School Program and will find out on October 15 if the Town will receive the funds. Informational brochures have been sent to Sir Francis Drake High School and various local schools in hopes of educating pedestrians & drivers regarding the new pedestrian signals on Sir Francis Drake Blvd at Tamal Ave. and also at San Francisco Blvd. The green light instructs the pedestrian to proceed to cross the street and the red flashing hand instructs the pedestrian not to proceed to cross the street. APPROVE RESOLUTION NO. 3968 ESTABLISHING GUIDELINES FOR ADMINISTRATIVE HEARINGS ON VIOLATIONS OF SAN ANSELMO MUNICIPAL CODE TITLE 2 CHAPTER 11 REGARDING DISCLOSURE AND REPORTING OF Town Attorney, Rob Epstein, presented the staff report stating on June 28, 2011 the. Town adopted a Ordinance that added' Title 21 to Chapter 11 ofthe San Anselmo Municipal Code which imposes disclosure and reporting requirements on persons or committees making independent expenditures" totaling at léast $100 in an election for a Town office or ballot measure. The upcoming November 8, 2011 election will be the first election in which the new: regulations apply. The ordinance provides that the Town Council adopt guidelines and procedures to apply to the administrative hearings. The proposed resolution adopts a "Statement of Rights and Procedures for Administrative Hearings under San Anselmo Municipal Code Title 2 Chapter 11". The proposed procedures call for an informal evidentiary hearing and a written INDEPENDENT EXPENDITURESI INTOWN: ELECTIONS. decision based upon all the evidence presented. There was no comment from the public. Greene noted he will support the resolution though he has reservations withi respect to the criminal. procedure. Greene believes the criminalization ofthe behavior being subject to misdemeanor liability brings in a panoply of procedural rights for criminal defendants. M/s, Mclnemey/lhomton, to approye the Resolution No. 3968 establishing guidelines for Administrative Hearings on violations of San Anselmo Municipal Code Title 2 Chapter 11 regarding disclosure and reporting ofindependent expenditures in Town elections. - AYES: Coleman, Greene, Kroot, McInerney, Thornton. NOES: None. 3. PUBLICHEARING ONTHE 2011-2012 PROPOSED BUDGET AND WORKPLAN. Finance & Administrative Director, Daria Carrillo, presented the staff report stating the proposed budget shows a deficit of approximately $12,500 whereas the preliminary proposed budget showed a deficit of $255,000. Staff closed the deficit with adjustments to the 2011-2012 budgets. The adjustments in the revised proposed budget now includes COPS revenue of$100,000 but Motor Vehicle License Fees which were included ini the preliminary proposed budget and have been taken out as the Town will not receive these funds; impact for these revenues is ai net increase of $67,000. Additional revenue. has been increased in the amount of $60,000 for franchise fees from Marin Sanitary Service and negotiations have been completed with all of the Town's bargaining units in which the employees will be paying 3% of their PERS. Overall revenue. is flat, expenditures are down, including transfers out; costs for step increases are $104,000; transfer of $200,000 to the Insurance Fund. Savings include $51,000 from the Police Department for sharing of services; $20,000 from reduced animal control fee from the County; the Planning Director hours are now at 50% and additional savings resulted in staffretiring and/or resigning. Kroot asked ift the Town will be getting additional flood money from FEMA. Carrillo hopes to get another $600,000 from FEMA however these funds are not included in the budget. Stutsman noted FEMA has misplaced one oft the claims; staff has been working with a FEMA consultant, McInerney asked if staff has quantified increases regarding health care costs for employees and costs for Carrillo replied the cap that is paid for employees is tied to Kaiser rate through PERS which will be increased by 7%, approximately $20,000; costs for. employee step increases and longetivity pay is submitting the claims and following up on the claims. step increases in staff salaries. approximately $104,000. Greene asked for quantification in terms of dollars for the 16% increase in PERS costs. Carrillo referred to page 17 of the 2011-2012 proposed budget noting the increase in the retirement amount of $73,000 which includes the 3% employees will be paying. Ifthe employees were to continue McInerney asked if there were other additional health care costs for retirees. Carrillo replied no. tonot pay a' %ofcontribution to their PERS the figure would be $173,000. McInerney asked ifs staff expects Kaiser costs to go up. Carrillo replied yes. Greene has concerns with grant money as he senses grant money is drying up.. 3 Minutes of San, Anselmo Town Council September 13,2011 Stutsman agrees with Greene acknowledging money is tight and grant money is drying up; most of our grants are from state funds and federal resources. Acquiring grant funds is becoming more and more difficult; as the money dries up we will do less projects and will be utilizing our Road Maintenance Fund McInerney has concerns with the reserves in the Ross Valley Fire Department as referenced page 28 of Fire Chief] Roger Meagor replied the Fire Department has been using money from reserves for the past 3- 4 years and estimate approximately $230,000 from the reserves for the current fiscal year. Meagor Thornton stated the RVFD took $300,000 out ofreserves to fund the current fire budget; leaving a balance Roger noted the Ross Valley Fire Department reduced their overall expenses. from the previous year by Kroot noted that it would have been a worse situation ifthe Ross Valley Fire Fighter's1 had not also picked McInerney regards Robson House Fund, page 103 of the 2011-2012 proposed budget, does not think rental increases would cover the considerable amount of maintenance work and capital improvements that are needed to restore and maintain the house. Mclnerney believes the Robson Harrington property is draining the town of money and the town does not have money to maintain the house. McInerney suggests future discussions regarding possible. legal options the Town may have regarding Robson Stutsman noted the revenue from rental income, from Robson Harrington is enough to cover its yearly expenses. We are, however, unable to do large costly improvement projects such as kitchen remodeling and ADA improvements because of the lack of money in the Robson Fund and General Fund money is Public Works Director Sean Condry noted staff has submitted a $1.5 million parks grant application stating ift the Town receives the grant funds it would cover a lot ofissues at the Robson Harrington house. McInerney stated the Town has a beautiful asset that it can not afford to maintain and it's serving the intended use is becoming less and less and he wonders ifthe Town has previously reviewed its options of Town Attorney Rob Epstein explained that Council has discussed the issue in the past and with reference to the Marketable Record Title Act, because there has been no notice ofi intent to preserve an interest that was established when the deed was recorded, the reversionary right disappears and the Town is not Stutsman noted the Robson property is in a residential neighborhood, does not have good parking and is not ADA compliant.
