PRESENT QUALITY OF LIFE SILVER AWARD TO GRACE KOMO FOR HER CONTRIBUTION OF 17 YEARS AS A VOLUNTEER RECEPTIONIST AT SAN ANSELMO TOWN HALL Woody Weingarten presented the award to Grace Komo. Komo thanked the staff and noted the many wonderful people she has met during her tenure at Town Hall. She further promised to continue her Christmas tradition ofbaking and sharing cookies with staff. Mayor Thornton thanked Komo for her service and for being the voice of San Anselmo to callers of Councilmember Coleman expressed her gratitude for Komo's friendship and service, recalling that Town Hall offices. Komo was one ofthe first residents to welcome her to San Anselmo. OPEN' TIME FOR PUBLIC EXPRESSION Jean Olive-Lammers, Pine Street, asked that Council consider the needs of dog owners who rely on the park before 8 a.m. when taking up the discussion of designating specific hours for Robson Harrington's Councilmember Kroot confirmed that discussion of the dog park would be placed on the agenda for the COUNCIL REQUESTS FOR FUTURE AGENDA ITEMS; QUESTIONS AND COMMENTSTO Kroot felt that the presentation on PG&E's Smart Meters had been one-sided and would like to hear Councimember Greene listened to the discussion regarding Smart Meters on the Town's website and urged all speakers to be certain their microphones are turned on. Further, Greene advised that he spoke with a PUC representative and found that the anticipated report from that commission will not be available until late August or early September. Greene reminded all present that when the Town Council dog park. next Council meeting. STAFF: STAFF MISCELLANEOUS ITEMS from those with a different perspective. ITEMI 1(a) Minutes of the San Anselmo Town Council August 10, 2010 had been addressing the PG&E initiative aimed at community choice aggregation, Councilmembers McInerney and Coleman had recused themselves. Gréene inquired as to why the two Councilmembers had not recused themselves in the discussion of PG&E Smart Meters. Greene concluded by urging further discussion, with particular emphasis on questioning the Smart Meter proposition sooner rather Thornton responded that at the time of the Councilmembers' discussion of the Smart Meters, it was expected that the PUC report would be available by mid-August. Further, a speaker on the opposing side ofPG&E's Smart Meters had been scheduled at the meeting but was prevented from appearing because than later. ofwork issues that came up that evening. Kroot asked ift the speaker could bei rescheduled for the beginning of September. Thornton agreed that this was a good plan. Coleman advised that with regard to not recusing herself from the previous Smart Meter discussion, it was her understanding that as her family did not stand to benefit financially from the Smart Meter program, there was no need for recusal on her part. She further noted that her family'sinyolvement with McInerney advised that prior consultation with the Town Attorney had determined that there was no conflict ofinterest for him in discussion of the Smart Meter program, adding that he had recused himself on a previous occasion because of his role in a PG&E case involving alleged misclassification of McInerney followed up on the suggestion of having Councilmembers sign up for Saturday availability for discussions with residents, advising that a sign-up sheet would be circulated among Councilmembers, targeting August 21St as the first of bi-weekly meetings to be held through the beginning of Deçember, at which time the practice would be reviewed. McInerney is further considering ways in which information can be shared with residents as well as taking requests to be shared with the McInerney addressed Kroot's interest in agendizing a discussion relative to Greene's support of documenting unwritten policies and traditions, observing that he supports Kroot's suggestion. Further, McInerney, as a representative of the Ross Valley School District, has been asked to act asaco- chair on the district's future bond campaign aimed at raising funds for building new classrooms, replacing aging portables, and maintaining arts programs. Mclnerney advised that he would be meeting with Superintendent Eileen Rohan and is happy to share with her any questions Council may have. Coleman reminded all present about the picnics on the plaza that have been taking place on Friday nights over the summer, noting that the gatherings have been very successful. Coleman thanked Sylvia Stewart-Stompe of Shadows and Pam Dixon of Yankee Girl and of the Antique Dealers Association. The next step is for Council to approve the current draft, which will then be forwarded to the State Department of Housing and Community Development (HCD). HCD will likely Greene. Henderson reminded Council that staff had been asked to review the legalization of second units in consideration of preparing an ordinance in that regard. It has been determined that this process is not likely to yield more than ten units as the Town relaxed standards for legalizing second units several years ago, resulting in the legalization of several units. Further, there are illegal units in San Anselmo which would never meet current minimal building codes, such as minimum ceiling height. Staff is recommending that a policy with regard to second unit legalization be included in the housing element draft to be forwarded to HCD, the specifics of which would be proposed by a housing element implementation committee before certification oft the housing element; said proposal would be reviewed Further, staff examined the proposed in-lieu fees and recommends including the language "projects ranging from 2 to five units and up" in the current housing element draft. The housing element implementation committee and others can provide direction as to drafting specific standards in the Finally, staff reviewed zoning requirements for an emergency homeless shelter. State law requires that every city and county provide zoning that would allow a homeless shelter without requiring discretionary permits. At Council's direction, properties within a quarter mile of public transit in the C-3 and the P-F zones have been included in the draft. Further, Robson-Harrington House and the Butterfield Road Fire Station have not been included as they are completely surrounded by single family residential housing. The Isabel Cook Center, Town Hall, and the downtown fire station have been included. Henderson noted that the downstairs portion of the Isabel Cook Center alone could Henderson introduced former Deputy Director ofHomeward Bound in Marin Bob Puett, who has worked extensively with homeless programs over many years. Puett, who has developed and managed several homeless shelter projects, advised that Homeward Bound is not planning to operate a shelter in San Anselmo. He assured Council that any operator of a homeless shelter would have rules including a strictly enforced good neighbor policy and clearly defined parameters with regard to residents' behavior and habits. Puett noted that Homeward Bound has been operating for 18 years in Novato and was encouraged and advised by neighbors of the Novato facility to add 32 studios and a culinary school. Puett is confident that the Town could work closely and successfully with any operator Kroot asked ifmost oft the Homeward Bound programs are located in Novato and San Rafael. Puett advised that there are homeless people in San. Anselmo as there are in all towns and cities. Kroot advised Puett of thè successful program at the Presbyterian Church, noting that the neighbors of that facility are pleased with it. Unfortunately, some residents who attended the Council meeting expressed concerns about drug probléms and mental illness. Kroot asked how these situations are Puett advised that his programs are behavior-driven, adding that inebriated individuals are taken to detox centers. In a successful program, staffi is charged with keeping things running safely and taking action if McInerney asked Puett if! his programs have been successful in allaying fears of neighbors in residential neighborhoods and inquired as to what kind ofoutreach the programs are conducted. in this regard. Puett advised that his organizations have held teas and invited neighbors to come and voice their issues, controlled. needed. noting that many neighbor's issues are reasonable ones that can be resolved. Coleman asked what happens if an undesirable operator comes in to San Anselmo. Puett advised that there haven't been a lot of operators, as there is a lot of fundraising required and homeless shelters are: not profit centers. Coleman asked the average stay ofa a shelter resident. Puett observed that the Mill Street facility, for example, offers a six month maximum stay, adding that programs have been extending stays because of the downturn in the economy. Puett noted that they are seeing more families and former white collar workers as a result of current widespread economic Thornton thanked Bob Puett for coming to the meeting and noted that the communities that have shelters Greene asked: ift there is any proposed language being considered for illegal second unit amnesty. Itis a matter of coming up with some methodology to identify an estimated number of illegal second units and proposing a program that anticipates the legalization of a given number of units, stating how many of this number has not been Kroot remarked that the present second unit ordinance is very restrictive and he would like to see that Baird responded that there is a program in the draft housing element that examines this issue. Thornton asked if part of the Isabel Cook site could be considered either the proposed site or one of counted in the census. reexamined. several proposed sites. Henderson affirmed. Baird added that ifl Isabel Cook were designated as the sole site, it would have to provide all 171 beds; ifa larger area were proposed, encompassing several potential sites, the size of each facility, including Greene noted that the current proposal is accommodating the Lincoln Park residents who do not want to be the only designated area for aj potential site. Is the idea of creating a 10-bed limit meant to address the request to spread the burden across neighborhoods? Is there a way to craft the language sO that in the event an opportunity should arise, all 17 beds can be placed at one site? Greene asked if flexibility could be accomplished without requiring a future rule change. Epstein suggested that it may be possible to impose a 10-bed limit while establishing criteria that would allow a facility to exceed that limit. Coleman asked for clarification oft the 10-bed limit. 6 Minutes of the San Anselmo Town Council August 10, 2010 Henderson explained that the Town is required to provide zoning that allows homeless shelters without getting discretionary permits and that our required allotment totals 17 beds. If someone wanted to provide a six-bed shelter, the Town would allow it and it would result in covering six of the 17 required Greene advised that he had spoken with a representative at HCD regarding illegal second units and had been told that as long as San Anselmo was not seeking to satisfy its ABAG imposed numbers solely by means ofrelying on the legalizing ofi illegal second units, and assuming that the Town has other methods ofi meeting affordable housing obligations, HCD generally looks to see whether or not the second units Baird believes that it comes down tol how many sites we have in total and the ability to meet the regional housing need at the different income levels. Right now we have a small surplus and any programs we Kroot noted that his impression of the Lincoln Park neighbors was that they unequivocally rejected the idea of having a homeless shelter in their neighborhood. Kroot asked ifit was advisable to think about specific rules under which shelters can operate and in which neighborhoods. In other words, how does the' Town ensure that San Anselmo has a shelter that is more like the one at the Presbyterian Church and Henderson said that at the time the property actually is rezoned, Council comes up with criteria that beds. comply with state law and, provided that they comply, it would be acceptable. can include in the element to meet that regional need provides a cushion. perhaps less like the one at Ritter House? would regulate that, including specifying the number ofbeds, etc. Thornton opened the discussion up for public comment. Michael Rex of Sais Avenue pointed out that only 15 permits had been issued in San Anselmo for new housing projects over the past four years; of the15, 13 were single family homes, one was a duplex, and one was an 8-unit condominium project. If in-lieu fees are tied to five units or more, in the last four years only one project would have contributed funds. It is for this reason that two or more units was chosen. The concern voiced at the last meeting is well-founded. A high fee will discourage the creation of duplexes. The amount of the fee and its applicability need to be considered carefully. Rex suggests Gayle Permar of Madrone Avenue asked if the homeless shelter at the Presbyterian Church will be staying with two units and make the fee nominal and on a sliding scale. affected by thel housing element's homeless shelter proposal. Thornton responded that the existing shelter would not be affected. Whitney Merchant of Ash Avenue noted that the Seminary is considering selling some apartment buildings and that the properties are of possible interest to some parties who wish to create deed- restricted affordable housing. Further, the potential investors would need the assistance ofl local funding; this is why it is sO important to take the in-lieu fees seriously. 7 Minutes of the San Anselmo Town Council August 10,2010 Merchant further observed that the phrase "affordable housing" is often misunderstood; small, deteriorated apartment units are not necessarily affordable housing; rather, deed-restricted, below- Merchant pointed to statistics which demonstrate that there is a great need for affordable housing in San Anselmo and that in order to fill that need a pool of funds needs to be created through reasonable in-lieu fees. She added that new, energy-efficient, attractive units can be created to fill the need. Betty. Pagett of Greenfield Avenue clarified that the current in-lieu fee proposal involves extending our current, inclusionary zoning policy and making it cover units to reflect the kind ofbuilding that actually takes place here. In-lieu fees were used by Larkspur to buy the land that Edgewater Place was built on; the housing fund for Corte Madera was used to help build San Clemente and some ofthe funding came from in-lieu fees. In terms of homeless shelters, the first one in the county started at the Methodist Church in 1983, was very successful, and rotated among five churches for a number of years. It ended market rental rate units are affordable housing. because the building at Mill Street was acquired as a permanent shelter. Lisa Bell ofLincoln Park asked for clarification as to the language in the current proposal. Henderson responded that the recommendation under consideration is that the Council direct staff to look at C-L, C-3, and P-F zones, or at the Isabel Cook facility. Thornton returned the discussion to the Council. Kroot stated that in the past, in-lieu fees were imposed on every fifth or tenth unit; however, there are not many projects of this nature in San Anselmo. The multi-unit project on Woodland Avenue has possibly two units that are managed by Ecumenical Housing or another organization- is this an example Henderson responded that in-lieu fees are financial contributions. The Woodland Avenue project sounds like an inclusionary situation, in which a certain number of units had to be designated as low- or Thornton observed that the eight-condo unit project at 1535 Sir Francis Drake originally had four units proposed for low-income units with deed restrictions; when the developer ran into financial problems, the number of restricted units was lowered to two. This project is the only recent multi-unit endeavor in Baird added that it depends on whether or not a unit is a rental unit or an ownership unit. Ifit's an ownership unit, the Town has an agreement with the county housing authority to manage the resale to ensure that the unit continues to comply. Ifit is a rental unit, a management entity monitors the renter's McInerney acknowledged Lisa Wight, Diane Henderson, Phil Boyle, Jeff Kroot, and members of the Housing Element Sub-Committee for their work. McInerney advocates for including all C-L, C-3, and P-F zoned properties in the proposal. Although Isabel Cook might be the best solution, it is just too restrictive to exclude the other potential sites. With regard to the in-lieu fees, McInerney appreciated Michael Rex's letter and agrees that limiting the threshold to five or more units is meaningless. McInerney supports the concept of a sliding scale for imposing in-lieu fees on projects with two or more units. Mclnerney feels affordable housing is a real need for any community and that this effort is a step toward creating that Greene supports Rex's suggestion with regard to in-lieu fees, but feels the fee should be more than a nominal figure, something scalable, and commensurate with the scope of the project. Greene further supports the consideration of the C-L, C-3, and P-F zones with regard to homeless shelter zoning and Kroot would prefer designating Isabel Cook solely as the potential site for a homeless shelter, as it seems to be an ideal location with a building that can be modified as needed. Kroot is concerned about second units, noting that there have been problems, including a situation at a halfway house a few years ago during which a resident attacked aj police officer with a knife. Kroot recognizes that although this is not behavior engaged in by the vast majority of homeless people, it is behavior that he observed in San Rafael. He would be open to more general zoning and feels that if the Town can create some strong regulations that protect business owners, homeowners, and families, a wider area can be designated. With regard to in-lieu fees, it is difficult for Kroot to see how effective they are. Collecting in-lieu fees in significant amounts may make the cost of potential low-income housing projects prohibitive. Kroot supports the amnesty program for second units and would like to review our second unit ordinance. He Coleman noted that many local teachers cannot afford to live in San Anselmo and feels that anything we can do to support bringing residents at differing income levels into San Anselmo is a step in the right Thornton has worked with the homeless community and thinks that expanding areas where we can place homeless shelters is appropriate. The Town has the ability to set the rules SO that neighbors are not negatively impacted by the placement of homeless shelters. Thornton supports including properties in the C-3, C-L, and P-F zones and feels an approach encouraging a broader area and smaller units is the best way to proceed. Thornton supports considering in-lieu fees for projects of two to five units or larger, as there is very little multi-family development in San Anselmo. Thornton encourages the building of more duplexes and legalizing second units. Further, she advises using the language "consider" when discussing these issues initially and choosing more specific terms only when final M/s, Greene/Mclnemey, to adopt the draft housing element with the modifications agreed to and submit itto the Housing and Community Development Agency for review and comment. Coleman asked if Fairfax Program Development Coordinator Camille Esposito's increased involvement Donery advised that Esposito has been involved in smaller projects such as bringing family events to the Pavillion that have become fundraisers for Fairfax Open Circle Arts and Sports (FOCAS) and this action ist to acknowledge that participation. She will not be involved in the larger projects and her entire annual compensation is approximately $3700. Thornton asked for clarification ofthel FOCAS program. Donery responded that FOCAS is Fairfax's branding of the programs and predates San Anselmo's involvement with the Town of Fairfax. Fairfax has agreed to give a portion of their funds to FOCAS to Greene notèd that San Anselmo has responsibility for employee background checks in this program. Would the liability for the failure to adequately investigate fall solely on San Anselmo or is it shared Donery explained the process for background checks, which entails an applicant making an appointment Police Chief Charles Maynard explained that live scan is a digitizing process whereby fingerprints are sent directly to the Department of Justice, placed in a database, and compared with existing records. Maynard further made the distinction between the live scan process and a charge of failure to Epstein added that ift the unlikely were to occur and the Town was sued, San Anselmo is taking on that responsibility and saying that if something arises from the Town's negligence and there is liability, the Town will indemnify. Coleman observed that her first league meeting for new councilmembers and mayors in Sacramento was avaluable experience and that she would appreciate the opportunity to attend the conference. McInerney suggested that Coleman speak about the resolutions presented at the conference at a future Council meeting. 11 Minutes of the San Anselmo Town Council August 10, 2010 M/s, Greene/Mclnerney, that San Anselmo have a presence at the League of California Cities Annual Conference and Expo and that the presence is manifested by Councilmember Coleman.
