TOWN OF MOUNTAIN VIEW REGULAR TOWN COUNCIL MEETING September 9, 2024 MINUTES Note: This Meeting Agenda started at agenda item number seven (7) because the meeting followed. a Workshop Meeting which contained agenda items one (1) through six (6). No meeting minutes are created for workshop meetings. 7.Call to Order Mayor Mitcham called the meeting to order at 8:20 p.m. in Berkeley United Methodist Church, 5200 W43rd Ave, Mountain View, Colorado. 8. Roll Call Present: Mayor Emilie Mitcham, Council Member Leal Algiene, Mayor Pro Tem Kathleen Bailey, Council Member Laura Dennis, Council Member Brittany Loecher, and Staff in attendance: Town Administrator John Beltrone, Town Attorney Austin Pierce Flanagan, Police Chief Michael Nesbitt, Public Works Coordinator David Nugent. Council Member Brent Metz. A Quorum was established. 9. Pledge of Allegiance 10. Consent Agenda Those present stood and recited the Pledge of Allegiance. Mayor Mitcham removed items 10A and 10E from the Consent Agenda, stating community perspectives merited further discussion of these items. The Amended Consent Agenda consisted of Items 10B through 10D inclusive. B.Minutes of August 19, 2024 - Regular Meeting C.Minutes of April 15, 2024 = Regular Meeting D.Resolution No. 2024-09-09A - A Resolution Approving a Memorandum of Understanding Regarding Jeffco Community Crisis Response Pilot Program The consent agenda was adopted unanimously by voice vote. Mayor Mitcham stated that a Council Member would like to add to the Agenda, and then Council Member Algiene motioned to direct Attorney Flanagan to draft an ordinance establishing a six-month moratorium of the issue of new building permits for single family dwellings and duplexes, and the Town Administrator to schedule a meeting in the next month. The motion was seconded. Council discussed the date for the ordinance to be heard, and Council Member Algiene amended the motion for the ordinance to be on gave the floor to Council Member Algiene. the agenda on October 21st. The motion passed unanimously by roll call vote. The motion passed unanimously by voice vote. 10.A. Mayor Pro Tem Bailey made a motion to approve the agenda. Itwas seconded. 10.E. Mayor Pro Tem bailey moved to approve Ordinance No. 2024-08-19A - An Ordinance Amending Chapter 8 of the Mountain View Municipal Code by the Addition of al New Article 5 To Establish an Automated Vehicle Identification System, on second reading. Itwas seconded. Administrator Beltrone stated that the ordinance involves the Automated Vehicle Identification System (AVIS) which has to do with speed cameras and red-light cameras allowing automated ticketing near W41st, on the Mountain View side of Sheridan. Administrator Beltrone detailed the state mandates fori the new system and stated that it is an available tool for the Town goals related to traffic safety. He stated a 40% decrease in speeding over 10mph within 6 months is possible. Council discussion ensued, with staff answering Council questions related to process and goals. The motion passed unanimously by roll call vote. 11. First Reading = Ordinance No 2024-09-09A - An Ordinance Amending Chapter 8 of the Mountain View Municipal Code by the Addition of a New Article 4 Regarding Mayor Pro Tem Bailey made a motion to approve Ordinance No 2024-09-09A. It was Attorney Flanagan introduced the ordinance and stated that it allows our police department to cite these situations to our municipal court instead of to another jurisdiction. Council expressed approval for giving the police department tools to enforce Vehicle Registration and Driver Licensure seconded. the law. The motion passed unanimously by roll call vote. 12. First Reading = Ordinance No. 2024-09-09B - An Ordinance Amending Chapters 7a and 11 oft the Mountain View Municipal Code Regarding Fire Restrictions Mayor Pro Tem moved to approve Ordinance No 2024-09-09B. It was seconded. Attorney Flanagan introduced the ordinance as an item discussed at the last workshop regarding adopting regulations that follow Jefferson County's fire regulations. Fire restrictions are currently in the Town code for park land, but not for private land. Council discussion included asking for minor clarifications and about how to alert the community regarding the different fire stages posted by the county. Staff answered Council's questions. The motion passed unanimously via voice vote. 13. First Reading - Ordinance No. 2024-09-09C - An Ordinance Amending Article 1 of Chapter 17 oft the Mountain View Municipal Code by the Addition ofa a New Section Mayor Pro Tem Bailey made a motion to approve Ordinance 2024-09-09C. It was Attorney Flanagan and Administrator Beltrone clarified this was the code update to require the policy which would be proposed via resolution at the next agenda item. Staff described the reasons to require uniformity in maintaining addresses. Council discussed the merits and elements oft the subsequent policy, and staff answered their questions. Regarding Addressing seconded. The ordinance was adopted unanimously by roll call vote. Colorado Adopting an Addressing Policy for the Town 14. Resolution No. 2024-09-09B - A Resolution of the Town of Mountain View, Mayor Pro Tem made a motion to approve Resolution No 2024-09-09B. It was seconded. The resolution was adopted by voice vote unanimously. 15. General Business - Public Works Contract would be required to move it forward. Mayor Mitcham introduced the contract, stating that a motion, second, and majority vote Public' Works Coordinator David Nugent explained that the proposed contract would solve a problem that remains with a section oft the curb and gutter on W41st Avenue, and will replace a section of sidewalk to mitigate storm water pooling there. Council discussion included the likely safety hazard if the work is not done, concerns regarding delays to future curb and gutter work, and general approval for the repairs. Mayor Pro Tem Bailey made a motion to approve the contract in the amount of $13,525. The motion passed via roll call vote unanimously. 16. Public Comment Catherine Colwell of 4354 Chase commented she approved of the Town paying the Church to use their space and she encouraged continuing to meet in the larger space Another resident thanked Council and staff for serving the community and would like to until the Town can get a larger community gathering space. see the meeting's format continue. 17. Staff Reports A. Police Department Police Chief Michael Nesbitt gave an update regarding a State Trooper shooting incident on Highway 36, and said he is making a full recovery. Chief Nesbitt highlighted several other items in his report and shared that Corporal Rodriguez will attend a public safety leadership development class in October. Council questions were answered. B. Public Works Public Works Coordinator David Nugent highlighted items from his written report such as the improvement in the percent of recycle bins accepted by Summit due to the tagging of non-recycled bins; items accepted for recycling went from 29% to 85% success, town-wide. He also briefly discussed the ten- year infrastructure plan for streets, alleys, curbs, gutters, and sewers. Council discussed the utility billing audit briefly. C. Town Administrator Town Administrator John Beltrone began by mentioning the process for managing solicitors and stated Town Hall has permit applications and no soliciting signs available for those who want them. He stated that for the public hearing on the 2025 budget in October, a larger sign will be used for the public notice. Administrator Beltrone thanked Council Member Loecher for her help in organizing the party for staff and Council on December 5th at 7:00 p.m. Administrator Beltrone was able to attend Downtown Colorado Inc's Metro Mobile Tour to see different commercial corridors and learn the process for development, and he shared excitement for their organization's involvement in a future workshop meeting. Mayor Mitcham emphasized the importance of making sure the community knows about this when the workshop is held. A. Mayor's Report Mayor Mitcham had nothing to report at this time. B. Events Committee Council Member Loecher highlighted upcoming events including the Santa Visit and Toy Drive Saturday December 14th from 10am to 12pm. C. Historical Mountain View Committee history for everyone to enjoy. Mayor Pro Tem Bailey encouraged everyone to read the article she included in her report and shared a summary oft the larger goal of writing a Town 18. Future Agenda Schedule Administrator Beltrone began to review future agenda items. Council Member Algiene shared topics of concern that she had previously wanted to address with Chief Nesbitt during his reporting time. She stated that residents are requesting additional patrols at night on W43rd near Depew where there are possibly vans parked with people sleeping in them at night, resulting Council agreed in a4 4 to 1 voice vote to extend the time of the meeting past the three-hour time permitted by the Council Rules of Procedure, with Council Members Algiene, Bailey, Dennis, and Metz voting in favor and Council Member Council discussion regarding the policing concerns continued. Council Member Metz emphasized that the Police Department encourages residents to call the non-emergency dispatch number to alert the police to issues when they see things or have questions or concerns. Chief Nesbitt agreed and said some of the concerns merit a 911 call as well, if there are drugs involved for example. The Future Agenda Schedule discussion continued and Administrator Beltrone Council Member Algiene asked to add to the parking lot a discussion about administrative improvements sO that community members would have a quick response to their emails to town staff. Mayor Mitcham and Administrator Beltrone various problems. Loecher voting against. concluded the review of upcoming agenda items. said they would look into this. 14.
