The following members were present: Chairman Steve McKinnon; District One Commissioner Chris Carroll; District Two Commissioner Donald O. Grantham; District Three Commissioner Charles W. Gary; and District Four Commissioner Frankie Wilson. Chairman McKinnon called the meeting to order at 10:00am. Commissioner Grantham opened with the Pledge of Allegiance. APPROVED - SOLID WASTE COLLECTION SERVICES CONTRACT  Commissioner Gary made a motion to approve the contract with Wiregrass Rehabilitation Center to collect trash and rubbish along roadways in the County. Dale County contracts with Contractor to collect trash and rubbish along its roadways in the County. Contractor shall be deemed to be an independent contractor and not an agent or representative of Dale County in any respect. Contractor shall pay all salaries, withholding and benefits to which its employees are entitled and  the County shall in no way be liable therefor.  2. The truck driver shall be qualified, approved and added as an approved driver on the County's insurance. None of Contractor's employees shall be deemed to be an employee of the County nor entitled to any benefits or entitlements as other County employees. Contractor shall be solely liable for its employees and all injuries to damages which they may sustain and also for any liability which contractor shall incur as ar result of its operations and shall hold Dale County and its officers and agents harmless therefrom. Contractor shall ensure that all its employees abide by all safety regulations and local and state laws including, but not limited to, the use of brightly  colored vests, flashing lights, cones and other safety devices.  8. Dale County shall be liable for its own actions and equipment in the project and shall  hold Contractor and its officers and agents harmless therefrom.  9. Contractor shall bag all materials collected and deliver same to the Solid Waste Disposal Area as designated by the County. The County will pay all costs ofd disposal  and Contractor shall not be responsible therefor.  10.Contractor shall collect all tires and "white goods" left on the roadside and deposit  same at the Dale County Shop.  11.Contractor shall pick up the truck and trailer from the Dale County Shop and return same at the end oft the work day to the same location. Contractor shall be responsible and liable for any damage to the truck and trailer during the work day while same  shall be in Contractor's possession.  12.Contractor's collection of trash and rubbish on County roadsides shall be performed for the entire year, as specified herein (item 2). The contact person between the Dale County Commission and Contractor shall be the Commission Chairman or such other  person as the Commission appoints. Payment for services provided by Contractor shall be made at the end oft the month when the work isp performed and invoices shall be paid by the County within 15 days after receipt. 14.This contract is subject to termination by either party with a 30 day notice with or without cause. In the event ofa a termination oft the contract, all documented services provided by Contractor prior to the termination shall be paid by County. 15. Disputes which arise between Contractor and the County shall be submitted to mediation in Dale County.
