Jesse Gonzales,Jr.e explained this Ordinance was created to address both the Coin-Operated Machines as well as the Game Rooms and Amusement Redemption Machines while differentiating between the two. Section 19-51 under Article IV. Game Rooms and Amusement Redemption Machines pertains to the Location Restriction. This section was amended as City Attorney Puja Boinpally found a ruling from the Supreme Court that stated the City of Fort Worth exceeded their authority. when they required Game Rooms within theirjurisdiction be a (Asst. City Mgr.) certain distance away from other Game Rooms. However, the distance provision between a school or daycare is allowable. In addition, the fee's structure, which follows the state guidelines, was added to this ordinance. Mayor Pro-Tem James Warnock arrived at 6:01 p.m. City Manager Frank Rodriguez III explained after careful review oft the bid tabulation he recommended City Council approve the proposal from BlueCross BlueShield ofTexas. Director of Human Resources Sara Mata explained BlueCross BlueShield ofTexas came in with al better annual premium for the City of Fort Stockton. She further explained the City of Fort Stockton has had BlueCross BlueShield for the last two years. She advised City Council that our employees have been content with BlueCross BlueShield. She stated there were some issues when we first transitioned to this insurance, which is expected with any changeover. However, our Representative Riley Dearring has been excellent at working with us to fix any issues that arise. Plant Public Works Director Luis Guerra recommended awarding the bid for Sup.) Aggregate and Caliche to MJ Trucking & Materials. He recommended awarding the bid for Emulsion to P2. He explained P2 has a better quality ofe emulsion, as it does not melt. He further explained when he first started with the City there was an issue with the product from Ergon Asphalt & Emulsions. Their emulsion would bleed through the rock and get on tires. Since switching over to P2 Emulsions we have not had this issue. TxDOT currently utilizes Ergon Asphalt & Emulsions and is experiencing this issue. They are having to spray lime and water tol keep the emulsion from getting on tires.. She explained that item No. 8 was added to include hosting obligations of the 4th ofJuly Event. She explained in the past the Chamber of Commerce hosted the 4th ofJuly Event; however, three years ago they decided they no longer wanted to host it. The Convention and Visitor's Bureau took it on; however, it has become difficult to host as they do not have enough volunteers available for this event. Therefore, the Convention and Visitor's Bureau would like to ask the Chamber of Commerce to take Mayor Pro-Tem James Warnock inquired if he recalled correctly, that the Year 2023-2024. Economic Development Corporation Executive Director Remie Ramos explained due to Lancium being unable to complete the project due to energy restraints, they have requested to alter the original agreement. They requested a reduction in their pilot payment to the amount of $150,765.00 annually. This would not restart the agreement. This would change the agreement to reflect what is on the ground. Council Member Darren Hodges recommended letting the agreement terminate once Lancium failed to fulfill their end of the agreement and then taxing them what the property is worth. Council Member Ruben J. Bernal left the Regular City Council Meeting at 6:27 After further discussion, Motion was made by Council Member Darren Hodges, seconded by Council Member Ruben Falcon, and carried unanimously to Authorize an Offer of an Agreement to Alter the Previous 380 Agreement between the City of Fort Stockton and Lancium for a reduction in the pilot payment to the amount of$150,765.00 annually for One Year.
