Lucus, City Clerk Marshal's-Report (Atch 1): The Marshal issued three (3) ordinance violations to be presented in Municipal Court in March. He is continuing to issue ordinance violations, and there may be more for the March Court date. There are still problems with dogs. The Marshal is trying to be located the dogs, but feels they are strays with no collars. Jefferson County will loan residents traps to try and catch the dogs, but may end up with wild animals as well. Counciimembers Ford and Cearley told the Marshal that they would support him in doing what he has to do to control the dog problems. Councilwoman Ford suggested that the deed be checked to determine if some groups are exempt from paying a cost to use the Civic Center. She recommended the Council revisit the topic at the March council meeting. There isalso a need to have the facility cleaned. Citizen's/Coundi. Comments: Chief Gundolf stated that people should be able to drink liquor if renting Civic Center. Councilwoman Ford stated the ordinance must be reviewed as a separate issue. Mr. Hignett a BOMUD Director reported that cracks wére found in a water line on Inwood. May have water system shut down for repairs/upgrade. Mr. Bryant noticed in newspaper that all of the surrounding Communities were getting improvements through grants, etc. Suggested that we need to get a committee to work on our problems. We also need to work with other Councilwoman Ford stated that everyone on the Council need to work on problems for the City. She thinks we can do a better job, and this Council and Councilman Cearley would like to see the Community come together as a group Counciwoman Ford would like to work with community groups to defry the cost communities. Mayor are working well together for the good of the City. for projects. of improvements and in the future there will be funds available. Councilwoman Ford will be available to attend Southeast Texas Regional Planning District meetings to represent the City. Lucus, City Clerk. Marshal Crow reported on the status of ordinance violations. There are currently 11 Ordinance violations given. Five scheduled to meet court on 22 March 2005. Discussion items: Civic Center Rental: City Council reviewed Civic Center guidelines for rental or use of the Civic Center. Some of the groups exempt from a fee are: Scouts, 4H, Bevil Oaks Community Group, Hunter's Education, Concealed Handgun Classes, Water Department, and other non-profit groups within the City of Bevil Oaks. All must schedule the Center through the City Clerk, sO there will be no scheduling conflict, and will be on a first come, first served basis. A $50.00 fee will be required for a refundable cleaning deposit. Others will be charged a fee of $100.00, plus a returnable cleaning deposit of $50.00. After inspection the $50.00 will be returned if left in the condition found. The non-profit M/M/2/C: To approve Civic Center Rental Charges. Cearley/Ford CivicCenter Maintenance: Ms. Ford stated that It's a matter of funds for maintenance. Council will review priorities of City, to determine when City can reservation may be preempt for emergencies. afford the cost of maintenance in the future. Citizen's/Council Comments: Some concern about Kim Roberts Ward IlI vacancy. Mr. Cearley stated that he called Texas Municipal League(TML) and was told that the Council had to vote to remove her from her office. He wanted to make sure that the City would not be sued. Mr. Friloux wanted to be sure that the action taken was legal. Mayor Smith stated "the facts are Ms. Roberts had missed three regularly scheduled meetings, without prior approval for being absent." According to TML, after missing three consecutive unexcused meetings, the council position is then considered vacant. The Council would have had to vote for removal in a case of misconduct, or other conditions as identified by the State of Texas. Ms. Ford assured them. that contact with TML was to assure that the City was within it's right to declare the position vacant. Ms. Luçus spoke with a TML Attorney and was provided the same information. This information is in the TML Handbook Marshal Crow stated that there are still problems with dogs killing livestock. He feels that some are strays. There is only one way to eliminate the ongoing Mrs. Turk stated her son is still City Attorney. He has not been paid. The city has researched this issue and can not find supporting documents of his hiring. A letter was sent to Attorney Turk to inform him of the City's position for General Law Cities. problem as they cannot be trapped. AL inge in this matter. Councilman Cearley said that the City Council is doing a good job, we are all neighbors out here, and no need to talk bad about each other. Councilman Friloux agreed. Councilwoman Crane stated she has enjoyed Council. Councilwoman Ford stated there are issues of concern. However, she is very pleased the City is no longer in the red. There are citizens who care, and when they volunteer we can do things working together. She wants the City to be a Mr. Hignett, BOMUD Director talked about the 25 year contract in which the Water Department provided water for the pool in exchanged for use of the land their office building sits on. BOMUD offered Mr. Crenshaw $5,000 for the land. Mr. Crenshaw wanted $200,000. BOMUD cannot pay that amount. The price was then lowered $60,000. BOMUD then offered $25,000. They are waiting for ar response from Mr. Crenshaw. He is concerned. If they cannot afford the land, they may have to bulldozer building, and rebuild at the Water Plant. Mr. Collins stated that he thought the Pool belonged to the City. The pool Mr. Hignett voiced concern about 4 wheelers. He was traveling down Inwood at Shipley when a child of about 7-8 years of age almost hit him. 4 wheelers are ruining roads. He stated that this a problem, and cannot understand why the law is not enforced. It is against State law to ride 4 wheelers, Go-carts, dirt Mr. Collins also stated that dirt bikes, 4 wheelers are coming down River Bend Road, across his property, and is very noisy. This occurs often after midnight. He is fed up, and wants to know what the Mayor and Council are going to do about the problem. Mayor Smith and Marshal Crow talked about this issue. The Mayor stated that he told the Marshal to revert back to no 4 wheeler, go-carts, and dirt bikes are not allowed on City roads. The Marshal safe place. belongs to Mr. Crenshaw. bikes on City streets. A dangerous problem. can enforce the law. Counciwoman Ford has been in contact with Ms. Johnson, Jefferson County Tax Assessor-Colector in preparation for the City Tax. - Resignation: Mayor Don Smith announced his resignation as Mayor of Bevil Oaks. Mayor Smith stated that ten (10) years ago shortly after the flood of "94" he decided to run for Mayor. At that time the City was facing lawsuits, in a mess, and in turmoil. During his tenure the road user fee was established to bring roads up to standards. Ms. Ford stated that a year ago Don Smith decided to run for Mayor after the former Mayor resigned, and was elected, as he was unopposed. The City has thrived, and is in the black once again, and doing well. Mayor Smith stated that over the last month he and his Family has been threaten. Roberts Ward I: Jimmie L.Grimes Ward M: Rusty Mosely Appoint Election Judge/Alternate: Election Judge & Alternate were identified in Ordinance 185. Mrs. Shirley Collins is Election Judge, and Ms. Mable Matthews is Alternate Judge. Citizens and Council Planning Session: Acting Mayor Ford talked about planning for the future of Bevil Oaks and asked all in attendance to discuss what ideas they have for the betterment of the City. Many comments and ideas were talked about. Some of the highlights from their discussions are as follows: Mr. Grimes ask the Council to consider the completion of a survey to apply for a Block Grant. Volunteers would be needed to go door to door to complete a survey. Another road out of Bevil Oaks. In the past the County agreed to build and maintain another road leading out of the City. City would have to provide for materials. At this time Eddie Arnold JeffCo funds are short, but would help the City of Bevil Oaks based on manpower. This can be Ms. Colleen Grimes talked about a Nutrition Center for Senior Citizens of Bevil Oaks to be held in the Civic Center on a five day a week basis. She will research what is need for the City to work with Meals-on-Wheels. Will be a minimum cost to the City, only utilities and space. Ms. Sherry Adams loves the idea of a senior program. She would like to see better tables and chairs in Civic Center. Mr. Brad Binks own A-1 Rentals, and could talk to him about researched in the future. Round tables would be better. table and' chairs. Mr. Grimes stated there might be free furniture. Councilman Friloux recommend painting the floor at a cost. Mrs. Hebert would like to have the City hire someone to maintain grounds. Suggest a committee to lead this action. City should be able to pay someone. There are many grants Acting Mayor Ford stated that we would have to work within to apply for. the budget, and prioritize projects. Mr. George Bryant stated that several years there was a flood committee. Would like to find a way to help city. Pinewood received money to help with drainage problems. Would like to get committee going again. A lot of drainage work going on in the City of Beaumont, and do not know if, Councilman Cearley added to what Mr. Bryant said. FEMA said they rebuild roads. Councilman Jim Cearley gave Invocation. Members Present: Jim Cearley, Cathy Crane, Pete Friloux, Becky Ford, Tommy LaRousse. Staff Members Present: James Carrico, Marshal & Normaj. Lucus, City Clerk. Marshal Crow has received many complaints over the City enforcing the State of Texas Law, which prohibits the driving of ATV's, Go-carts, Golf Carts, Scooters, and all unlicensed vehicles on the City streets. Marshal Crow spoke about requirements of the State, and asked all to uphold the law. Marshal Crow invited Texas State Trooper Richard Vasser to address this issue from a State of Texas perspective. The Trooper provided the following information: Lawn Mowers, etc.), are not allowed to operate on city streets Marshal's Report: ATV Issue All non licensed transportation (ATV's, Go-carts, Golf Carts, Scooters, Only allowed on private property City Ordinance and rules cannot supersede State law Tractors can be driven on city streets if used for agriculture - City boundary is from fence line to street, including ditches purposes Councilman Friloux asked about scooters. Trooper Vasser stated that scooters must be used like bicycles, and speed must be less than 35 miles per hours. City Attorney Thad Heartfield was in attendance and he stated that the City could be liable if State laws are not upheld, and the City cannot change Ordinance to go against state law. There were pros and cons about the enforcement of City and State Law. Some citizens were upset, and some were happy to see the ban enforced. Mr. John Hignet related the near miss he had with an ATV being driven by a child. He stated that the Council should not give permission to break the law. Mrs. Sherry Adams wondered what message we are sending our children, and we should not break the law. There will be no change to the current ordinance. Court Report: Ms. Lucus reported on the status of the Municipal Court. There were fifteen (15) Ordinance violations and 1 traffic ticket filed with the Court. Court was held on 22 March 2005. 6 ordinance violations were dismissed when they complied with ordinance. 7 Ordinances cases were continued for 60 days. One traffic case was approved to take Defensive Driving. Mr. Collins will continue his research into education issues and will keep the City apprised of progress, and help needed. A meeting will be held on 28 April with Mr. Williams; B.I.S.D. Amendment of Ordinance 85: Ordinance amended to correct permit fee amounts to New Construction $100.00, Add-on $50.00. If permit is requested after construction starts the fee is $150.00, and Add-on is $100.00. Citizen's/Council Comments: Acting Mayor Ford thanked Trooper Vasser for his assistance in the briefing on Acting Mayor Ford thanked Mr. Cearley for his service as Councilman and for all Councilman Cearley expressed concerns about city spending money. He thanked all of the people he worked with, including the Heberts, the Bryants, Councilman LaRousse thanked Councilman Cearley for his service to the City. Councilman Friloux also thanked Councilman Cearley for a "job well done." Counciwoman Crane wished Councilman Cearley the best. And stated that "if he had any questions about the budget" he should feel free to ask. Acting Mayor Ford gave praise to the Fire District for their quick action in response to a 911 call she made at about midnight to assist Mr. Ford with oxygen. The EMS was also there about 5 minutes later. She thanked God for ATV, etc. of the hard work he provided to the City and it's citizens. and City employees Marshal Crow, and Norma Lucus. the Fire District as they were there within minutes. Mrs. Hebert also thanked the Fire District for their help in the past. The Fire Mrs. Colleen Grimes provided information on the Nutrition Site to be held in the Civic Center. There will be a Council workshop to assess the needs of the City, both now and in the future. The Council will look hard at the rate, and must be completed by August 2005. Acting Mayor Ford stated the need to build the Contingency Fund up in case of an emergency. There was $100,000 in fund, but is now about $33,000. All spending will be justified. Crane/Friloux Education Committee: Mr. Randy Collins provided the following information: The Education will continue to work to get Bevil Oaks annexed by Hardin- Jefferson (HU) School District. They are willing to accept us. If one districts says no and the other says yes, then the Bevil Oaks Committee and Citizens must go to the State Commissioners Court. The Education Committee will meet with HJ superintendent of Schools. Ifwe are accepted by HU, then we must start a petition, hire an Attorney to represent us in Austin. We must find out what our tax base is, the approximate number of school age children, and grade level. Mayor Ford read letter from Ms. LaDoux, is willing to work with the Education Committee. Mayor Ford asked "would the Education committee need funding from the City of Bevil Oaks?" The City will need an answer to that question. Everyone signing a petition will have to also go to Austin. Mr. Collins spoke to an Attorney and was told that the way the situation is with Beaumont Independent School District "low performing schools, etc., this is a good time to act." After discussion on the type of improvements being made to his property, and assuring the Council that the building in question was not to be used as a business, the Council had Mr. Englehardt sign a Statement to that fact. Motion made to reinstate the building permit. M/M/2/C: Moseley/Crane Building Inspector's Duties: The duties of the Building Inspector were reviewed and Attorney Heartfield recommended that the duties be changed to reflect that the Council must approve every permit, and the Mayor must sign building permit, and permit must agree with deed restrictions.
