WHEREAS, the City of Wilkes-Barre has determined that there is an immediate need to increase the number ofi police officers toj protect the public safety ofi its citizens; and WHEREAS, the City has been unable toj fill vacant, positions in a timely manner utilizing the current. Police Civil, Service Commission 's competitive testing procedures; and WHEREAS, the training and. Appendix "A." A1. Employment. Entry-level positions in the Police Department shall be filled through the civil examination and grading requirements contained ini the Third-Class City Code and the Police Civil Service Commission's) Rules and Regulations for Hiring and Promotion. A2. Additional authorization for employment in the Police Department; Entry level positions in the competitive class in the Department of Police can be filled without regard to the Civil Service examination and grading requirements contained in the Third-Class City Code and Police Civil Service Rules for police when in the determination of the Mayor conditions affecting public safety exist which require the authorization to fill without compensation. appointment of certified police officers without competition. The Police Civil Service Commission shall then certify individuals to fill such positions without competition regardless of whether or not a current competitive eligibility list for police officers is in existence. The qualifications for such positions shall be established by the Police Civil Service Commission. Such positions shall be included in the competitive class upon hiring notwithstanding that the position is filled without competition. This provision shall be in addition to the current rules and regulations for the hiring of entry level police officers. A3. Qualifications. The Police Civil Service Commission shall establish the qualifications for police officer positions to be filled without competition that shall include at ai minimum: The applicant must hold current certification as a police officer by the Commonwealth of Pennsylvania under the Municipal Police Officer Education and Training Program pursuant to 53 P.S. Section 740, as amended, or must be certified by another state whose certification is recognized by the Commonwealth of Pennsylvania or have successfully completed Act 120 qualification training and be able to obtain Pennsylvania municipal police officer certification. A4. Recruitment. In the event that the Mayor determines that there exist conditions affecting public safety which require the appointment of certified police officers without competition, the Chief of Police shall request that the Police Civil Service Commission, in accordance with these rules, conduct recruitment for the purpose of filing the requested number of police officer positions. The process for the appointment of certified police officers without competition in the rules shall be in addition to, and noti in lieu of, the process for appointment of police officers in accordance with the Police Civil Service Commission's Rules and Regulations for Hiring and Promotion. A5. Selection. Upon receipt of a certified list, the Chief of Police may fill any number of vacancies in the certified positions by selection from among the certified applicants on the list. The Chief of Police should rely upon the background investigation of the applicant including prior employment, relevant education, prior experience and character, with consideration given to the specific requirements of the Police Department. The Chief of Police may also rely on the other relevant information or examination data which the Police Civil Service Commission may supply. However, all applicants are subject to removal pursuant to Article VII. of the "Rules and Regulations for Hiring and Promotion" oft the Police Civil Service Commission. A5. Probation. All original appointments to the position of police officer which are filled without competition shall be for a probationary period as set forth in the Standard Operating Procedures oft the Police Department of the City of Wilkes-Barre. SEVERABILITY. Thej provisions oft this ordinance are severable. Ifany part ofthis ordinance is declared tol be unconstitutional, illegal or invalid, the validity of the remaining provisions shall be unaffected thereby. Iti is the intention ofthe Council of the City of Wilkes-Barre that this ordinance would have been adopted had such unconstitutional, illegal or invalid part not been included. REPEALER.
