Tank Maintenance Discussion Maintenance being thel lowest quote. This item was discussed in the last Work Session. City staff had solicited quotes on water tank maintenance, as the City has never had a water tank maintenance program before. Staff received back three quotes with. American Tank A1 tank maintenance program has been needed for quite some time, especially with the new tank that went online this year. City Council agree that making a budget amendment using contingency funds. The Tank Maintenance A preliminary plat is being requested for parcels known as the Spradlin Tract on Gates Road and Hwy 54 fora proposed mix-use development of356-unit apartments off of Gates Road, with 7.2 acres of retail space that would front Hwy 54. Developers Dustin Shaw & LeighAnne Green were present to answer questions. City Manager Lisa Kelly discussed with Council that the developers would need dedicate property on Gates Rd. to meet the code requirement for a 60' right of way and any provisions regarding sidewalk placement on the Gates Rd. frontage. A sewer force main will also need to be installed in the Highway 54 right of way. Staff recommends a development agreement be inj place prior to issuance ofal Land Disturbance Permit. This item is on thel Regular Meeting agenda Mayor Ayers explained to Council that the Holland Ware Foundation approached the County and City with a desire to donate to Parks & Rec. The County paid for preliminary drawings oft the plans for McGee Field to take to the Holland Ware Foundation. Thel Holland Ware Foundation is committing $1million toward the project ift the City and County each gave $500k towards the project. Thej park would need tol built inj phases. The City is still waiting Council and Staff discussed the City street parking priority areas at the last meeting. Staff recommended and Council agreed that the priority areas that need attention first would bel Huntcliff (noj parking on even side), Project St (Jennings Homes curve: no parking even side), 408 W. Boyd Road/Pine St (no street parking), Askew Ave (no parking even side), Frederick St (no parking even side), Green Ave (no parking even side), Ware Street (no parking odd side), Church St at curve 215-221(no: street parking). City Attorney will draft an ordinance for these streets and City Manager Lisa Kelly received a request to book Lake Jimmy. Jackson for an evening wedding ending around 9pm. They did not have a date set for the wedding yet, but she wanted to make sure Council was aware oft the ask in case they had any issues with it. Once aj permit application has been submitted, the City would issue an event Agreement with American Tank is on the Regular Meeting tonight for approval. 2. Preliminary. AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. THE COUNCIL OF THE CITY OF HOGANSVILLE HEREBY ORDAINS: SECTION1: That Sections 94-89 through 94-92 oft the Code of Ordinances of the City of Hogansville be modified by inserting therein new Sections 94-89 through 94-92 said sections currently being reserved, to read as follows deleting all of said sections, in their entirety, and inserting in lieu thereof new Sections 94-89 through 94-92, to read as follows: "Sec. 94-89. Parking on streets in residential zones. (a) Inorder to protect and promote the publichealth, safety and welfare ofthe citizens of the city, to insure the safe and orderly transition oft traffic in residential areas and to protect property values in certain residential areas in the city, the parking of certain vehicles within residential zones ES-R, SU-R, and TN-R is prohibited upon the public streets, alleys and rights-of-way within such residential districts. (b) The vehicles, the parking of which is prohibited by subsection (a) are defined as: (1) Any truck or other vehicle which has ai rated capacity of greater than one (1) ton or which has a wheel base of one hundred twenty-five (125) inches or more; (3) Trailers or semitrailers having dual rear wheels, or either such trailers having an overall length of greater than twelve (12) feet; provided, however, that an exception to the prohibition outlined ini this subparagraph may be granted, upon application to the building official, and in the discretion of the building official, provided said trailer or semitrailer at issue may be parked in the street safely without unduly impeding sight distance, traffic flow, federal, postal or other (2) Truck tractors having dual rear wheels; and deliveries and emergency vehicle ingress and egress. (c) Nothing in this section shall prohibit the parking of vehicles of public or private utility companies, or commercial vehicles making deliveries or vehicles in use in the construction, repair or maintenance ofany road, street or alley in such districts, but only for the period of time required for the delivery of service reasonably required by such vehicle. Sec. 94-90. Parking restricted or prohibited on designated streets. Parking of motor vehicles is hereby prohibited, limited or1 restricted as specified on the Askew Avenue: parking is prohibited on the north side of Askew Avenue from its beginning at its merger with Blue Creek Road at the eastern boundary ofthe city limits for the entire length of such street to its intersection with Johnson Street; West Boyd Road: parking is prohibited on either of West Boyd Road from 408 West Church Street: parking is prohibited on either side oft the street from 215 Church Street Dickinson Street: parking is prohibited on the east side of Dickinson Street from its intersection with Askew Avenue for the entire length of such street to its Frederick Avenue: parking is prohibited on the north side of Frederick Avenue from its intersection with Lincoln Street for the entire length of such street to its Greene Avenue: parking is prohibited on the north side of Greene Avenue from its intersection with Lincoln Street for the entire length of such street to its Foot Log Lane: parking is prohibited on the south side of Foot Log Lane from its intersection with Foxhorn Trail for the entire length of such street to its Fox Chase Way: parking is prohibited on the south side of Fox Chase Way from its intersection with Hunt Club Drive for the entire length of such street (such street currently dead ends with proposed future development along such street which Foxhorn Trail: parking is prohibited on the west side of Foxhorn Trail from its intersection with Hunt Club Drive for the entire length of such street (such street currently dead ends with proposed future development along such street which Foxtrot Trail: parking is prohibited on the south side of Foxtrot Trail from its intersection with Foxhorn Trail for the entire length of such street (such street currently dead ends with proposed future development along such street which following streets within the city: Boyd Road to its intersection with Pine Street; to 221 Church Street; intersection with Greene Avenue; intersection with Dickinson Street; intersection with Johnson Street; termination at a cul-de-sac; shall be governed by this same parking restriction); shall be governed by this same parking restriction); shall be governed by this same parking restriction); Hunt Club Drive: parking is prohibited on the south side of] Hunt Club Drive from its intersection with US Highway 29 for the entire length of such street to its Project Street: parking is prohibited on the south side of Project Street from its intersection with West Boyd Road for the entire length of such street to its Ware Street: parking is prohibited on the north side ofWare Street from its intersection with US Highway 29 for the entire length of such street to its intersection with intersection with Foxhorn Trail; intersection with Pine Street; Brooks Road. Sec. 94-91. Enforcement oft this Chapter; penalties for violations. Unless another penalty is expressly provided for and governed by state law or otherwise addressed in this City Code, any person violating any provision of Chapter 94 of this City Code shall be guilty of a misdemeanor and upon conviction thereof shall be punished in accordance with Section 1-1 of this City Code. Sec. 94-92. Illegally parked vehicles, owner/driver citation. Forj parking violations under this chapter ofthe Code, citations may issue to either the registered owner of the vehicle or the driver of the vehicle at the time of the alleged violation. Proof that the defendant was at the time of the violation the registered owner of the vehicle shall permit the trier of fact in its discretion to infer that such owner ofthe vehicle was the driver of the vehicle at the time ofthe alleged violation. Such an inference may be rebutted ift the owner of the vehicle: (1) Testifies under oath in open court that he or she wasi not the operator oft the vehicle (2) Presents to the court prior to the return dates established on1 the citation a certified copy of a police report showing that the vehicle had been reported to law (3) Submits to the court prior to the return date established on the citation a sworn notarized statement identifying the name oft the operator oft the vehicle at the time at the time of the alleged violation; enforcement as stolen prior to the alleged violation; or of the alleged violation." SECTION2: All ordinances or parts of ordinances in conflict with the provisions of this ordinance shall be and the same are hereby repealed. SECTION3: This ordinance, after adoption by the Council and upon approval by the Mayor, shall become effective immediately. THE COUNCIL OF THE CITY OF HOGANSVILLE, GEORGIA HEREBY ORDAINS AS FOLLOWS: SECTION1: That Chapter 94, Article II, Division 2 oft the Code of the City of] Hogansville be amended by inserting therein ai new Section 94-57, said section currently being reserved, to read as follows: "Sec. 94-57.- Automated traffic enforcement safety system. (a) Definitions. The following words, terms, and phrases, when used in this section shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different Agent means a person or entity who is authorized by a law enforcement agency or governing body to administer thej procedures contained here and (i) provides services to such law enforcement agency or governing body; (ii) operates, maintains, leases, or licenses a video recording device; or (ii) is authorized by such law enforcement agency or governing body to review and assemble the recorded images captured by the automated traffic enforcement Automated traffic enforcement safety device means a speed detection device that: (A) is capable of producing photographically recorded still or video images, or both, oft the rear ofar motor vehicle or of the rear of a motor vehicle being towed by another vehicle, including ani image ofs such vehicle's rear license plate; (B)is capable of monitoring the speed of a vehicle as photographically recorded pursuant to: subparagraph (A)ofthis paragraph; and (C)indicateson each photographicaly-reconled still or video image produced the meaning: safety device for review by aj peace officer. date, time, location, and speed of a plolographcalyrecorued vehicle traveling at a speed above the posted speed limit within a Owner means the registrant ofan motor vehicle, except that such term shall not include a motor-vehicle rental company when a motor vehicle registered by such company is being operated by another person under ai rental or lease agreement with such company. School. zone means the area within 1,000: feet oft the boundary ofany public or private elementary or secondary school. (b) Authorization. Speed camera enforcement, using automated traffic enforcement safety devices, is hereby authorized within school zones during such hours and in accordance with Georgia law and/or (c) Administration. Any automated traffic enforcement safety system administered under this Code section shall be administered as (1) The law enforcement agency, or agent on behalf ofthe law enforcement agency, operating an automated traffic enforcement safety device provided for under O.C.G.A. $ 40-14-18 shall maintain a log for the automated traffic enforcement safety deviçe attesting to the performance of such device's self-test at least once every 30 days and the results of such self-test pertaining to the accuracy of the automated traffic enforcement safety device. Such log shall be admissible in any civil enforcement proceeding for a violation issued pursuant to O.C.G.A. $ 40-14-18. The law enforcement agency, or agent on behalf of the law enforcement agency, operating an automated traffic enforcement safety device shall perform an independent calibration test on the automated traffic enforcement safety device at least once every 12 months. The results of such calibration test shall be admissible in any court proceeding for a violation issued pursuant to O.C.G.A. $ 40-14-18. (2) Prior to the placement of a device within a school zone, each school within whose school zone such automated traffic enforcement safety device ist to be placed shall first apply for and secure a permit from the department of transportation for the use of such automated traffic enforcement safety device. Such permit shall be awarded based upon need. The department of transportation shall promulgate rules and regulations for the implementation ofthis paragraph. marked school zone. O.C.G.A. $4 40-14-8. follows: (3) Ifa an automated traffic enforcement safety device is moved to or placed in a location where an automated traffic enforcement safety device had not previously been moved to or placed in, no citation shall be issued for a violation recorded' by that automated trafficenforcement safety device until: a. The city shall erect signs warning of the use of a stationary speed detection device within the approaching school zone. Such signs shall be at least 241 by 30 inches in area, shall be visible plainly from every lane of traffic, shall be viewable in all traffic conditions, and shall not be placed in such ai manner that the view of such sign is subject to being obstructed by any other vehicle on such highway. Such signs shall bej placed within 500: feet priort tot the warning sign announcing the reduction oft the speed limit for the school speed zone. There shall be a rebuttable presumption that such signs are properly installed pursuant tot this subsection at the time ofany alleged violation under this article; and b. That no citation shall be issued for the first 30 days after the first automated traffic enforcement safety device is introduced by a law enforcement agency within a school zone, but rather, a civil warning shall be issued for disregard or disobedience of the posted speed limit within the school zone during those first 30 days. (4) A law enforcement agency authorized to enforce the speed limit of a school zone, or an agent working on behalf of a law enforcement agency or governing body, shall send by first class mail addressed to the owner of the motor vehicle within 30 days after obtaining the name and address of the owner oft thei motor vehicle but no later than 60 days after the date oft the alleged violation: a. A citation for the alleged violation, which shall include the date and time of the violation, the location of the infraction, the maximum speed at which such motor vehicle was traveling in Phologrmphtcaly-reconued images, the maximum speed applicable within such school zone, the civil warning or the amount of the civil monetary penalty imposed, and the date by which a civil monetary An image taken from the oogrmpncalyrcora images showing the vehicle involved in the penalty shall be paid; b. infraction; C. A website address where Phoogmpncaly-recorted images showing the vehicle involved in the infraction and a duplicate of the information provided for in this paragraph may be viewed; A copy of a certificate sworn to or affirmed by a certified peace officer employed by a law enforcement agency authorized to enforce the speed limit oft the school zone and stating that, based upon inspection of photographically recorded images, the owner's motor vehicle was operated in disregard or disobedience oft the speed limit in the marked school zone and that such disregard or disobedience wasi not A statement of the inference provided by Georgia lawand ofthe means specified therein by which such inference may be rebutted for such violations; Information advising the owner oft the motor vehicle of the manner in which liability as alleged in the citation may be contested through an administrative g. A warning that the failure to pay the civil monetary penalty or to contest liability in a timely manner as provided for in subsection (d) of this Code section shall waive any right to contest liability. d. otherwise authorized by law; e. f. hearing; and (5) Proof that a motor vehicle was operated in disregard or disobedience oft the posted speed limit of the marked school zone shall be evidenced by photographically recorded images. A copy of a certificate sworn to or affirmed by a certified peace officer employed by a law enforcement agency and stating that, based upon inspection of photographically recorded images, a motor vehicle was operated in disregard or disobedience of the posted speed limit in the marked school zone and that such disregard or disobedience was not otherwise authorized by law shall be prima-facie evidence oft the facts contained therein. (6) Liability shall be determined based upon aj preponderance of the evidence. Prima-facie evidence that the vehicle described in the citation issued pursuant to this Code section was operated in violation of the posted speed limit of the school zone, together with proof that the defendant was, at the time of such violation, the registered owner of the vehicle, shall permit the trier of fact in its discretion to infer that such owner ofthe vehicle was the driver ofthe vehicle at1 the time of the alleged violation. Such an inference may be rebutted ift the owner oft the vehicle: a. Testifies under oath in open court or submits to the court a sworn notarized statement that he or she was not the operator of the vehicle at the time of the Presents to the court a certified copy of a police report showing that the vehicle had been reported to the police as stolen prior to the time of the alleged alleged violation; or b. violation. (7) A violation for which a civil warning or a civil monetary penalty is imposed pursuant to this section shall not be considered a moving traffic violation for the purpose of points assessment under O.C.G.A. $ 40-5-57. Such violation shall be deemed noncriminal, and imposition of a civil warning or civil monetary penalty pursuant to this section shall not be deemeda a conviction and shall not bei made ap part of the operating record of the person upon whom such liability is imposed, nor shall it be used for any insurance purposes in the provision of motor-vehicle insurance (8) Any court having jurisdiction over violations of subsection (a)of0.C.G.A. $ 40-14-18 shall havej jurisdiction over cases arising under this section and shall be authorized to impose the civil monetary penalty provided for by this subsection. Except as otherwise provided pursuant to Georgia Law, the provisions of law governing jurisdiction, procedure, defenses, adjudication, appeal, and payment and distribution of penalties otherwise applicable to violations under this section shall apply to enforcement under this section; provided however, that any appeal from superior or state court shall be by application in the same manner as that coverage. provided by O.C.G.A. $ 5-3-1 ets seq. (d) Designation of administrative hearing officer. In accordance with the provisions ofO.C.G.A. $ 40-14-18, and as oft the effective date of this section, the city shall utilize the judge or assistant judge of the municipal court oft the City of Hogansville, Georgia to conduct an administrative hearing when timely requested by recipients of notice ofviolations under this section. (e) Violations and penalties. (1) Any person who shall violate any provision of this article shall be subject to the civil penalties set forth in O.C.G.A. S 40-14-18(b)(1), as amended, including a fine in the amount of $75.00 for a first violation and $125.00 for a second or any subsequent violation, in addition to fees associated with the electronic processing of such civil monetary penalty, which shall not exceed $25.00. (2) The city is hereby authorized to notify the Georgia Department of Revenue of all outstanding notice of violations that are eligible for reporting pursuant to O.C.G.A. $ 40-14-18. (f) Severability. Ifany section, subsection, sentence, clause, phrase, or portion oft the ordinance from which this section derived is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions of the ordinance from which this section derived, it being the intent of the governing authority that the ordinance from which this section derived shall stand, notwithstanding the invalidity ofany section, subsection, sentence, clause, phrase, or portion hereof." SECTION2: SECTION3: All ordinances or parts of ordinances in conflict with this ordinance are. hereby repealed. This Ordinance after adoption by the Council and upon approval by the Mayor shall become effective immediately.
