No. 140715A and Ord. No. 191008A. This zoning was approved in 2014 and 2019. The Preliminary Plats are. Lakewood Meadows and Falcon Point Phase3 Addition.. Commissioner Ruszkiewicz clarified that this property was rezoned years ago and unless we. have a violation of an ordinance making this non-conforming of what was approved, Steve Wydra, 24 Falcon Point Lane - expressed concern because the property is a flood plain and there is not] proper water drainage and alsol had concerns regarding thei roads at Falcon Point. Jeff Cole, 1500 McDonald Road - stated that his lives on the largest property that is affected by this. His biggest concerns are the traffic at McDonald Road and the flooding. Thej proposed development standards are1 10lots, 8 one-acre. lotsand two1.5-acrel lots. The density and dimension requirements conform to SF-43. The building standards are 100% masonry (max 20% stucco); garages arej j-swing or setback 75 feet; detached garages offset per SF-43. Fencing is all ornamental wrought iron. The streets conform to EDS and the cul-de-sac variance for length. The street lighting conform to Outdoor Lighting Ordinance. The sidewalks are 4 ft width; minimum 41 ftt to curb. The utilities are buried underground, 10 ft public utility easement behind sidewalk. The neighborhood signage entryfeatures require. ARB approval. Drainage standards conform to EDSwith City Engineer approval. Cul-de-sac standards conform to EDS and Fire Code with the exception of the cul-de-sac length variance requested. The proposed zoning change compliance with the Zoning Ordinance is a discretionary decision and should be made in conformance with the Comprehensive Plan. The proposed zoning change substantially complies with the Heath Code of Ordinances with the exception of the Cul-de-sac: Length Variance and the Front Setback Variance requested. Following rezoning, a preliminary plat, final plat, and public improvement construction plans are required to create this subdivision. At that time, the applicant will demonstrate how the neighborhood will connect to the city's water and sanitary sewer system and comply with all engineering design standards. Sanitary seweri is available tot the site from a 10" line at Dennis Bailey and 549. Water is available toi the site. There are multiple water service lines in the vicinity: 12" and 8" lines at the intersection of Dennis Bailey and 549 and a 12" line along the opposite side of 549. The applicant's engineer will propose the best solution for the site tol be reviewed by the City Engineer in the construction plans submitted with the final plat. Jim Knight, KFM Engineering & Design was present stating that the prior meeting gave us some very significant direction that we: feel we. have met. Regarding water, wel have a connection point, at the front of the property and across 549 and have two connection points. Trail, landscaping, two detention ponds and maintained by the HOA and open to the public. Fire access on both roundabouts, and we are down to one variance, thec cul-de-sacle length. HEARING to receive comments regarding the request. Chairman. James Tunnell opened the public hearing at 8:34p.m. Allen Dowell, 6717 S. FM549, property owner = stated that he was very proud and pleased with this design, it's a better fit for Heath. Tunnell closed thej publicl hearing at 8:35 p.m. Discussion and action regarding the request. The Commission continued discussion and were pleased with the revisions. Commissioner Ruszkiewicz stated that there are substantial improvements but he would still like to see. largerl lots since most of the surrounding properties have larger lots. Staff recommends approval with the condition that the cul-de-sac length exceeding 600 feet requires a variance from the City Council.
