REGULAR COUNCIL MEETING - September 23, 2024 The City Council oft the City ofLa Grange met in Regular Session on Monday, September 23, 2024, ini the City Hall Council Chambers at 155E. Colorado Street with the following members present: Mayor Jan Dockery, Mayor Pro tem Kathy Weishuhn, Councilmembers Arthur Bosque, Councilmember Bonnie Busch, Councilmember Katie Gross, Councilmember Bryan Kerr, Councilmember Kim Newton, and Councilmember Ken Taylor. Councilmember Violet Zbranek was absent. Staff present: City Manager Jack Thompson, Assistant City Manager Frank Menefee, City Attorney Marie Angela Flores Beck, City Secretary Janet Bayer, and Sergeant Travis Anderson. Visitors: Teresa Brown, Frank Reichert, Andy Johnson, Alfred Torres, Adela Flores, Brandon Schielack, Pastor Kolbe Hill, and others. Mayor Jan Dockery called the meeting to order. Next were pledges to the US and Texas Flags. Pastor Kolbe Hill with The Remnant Church gave the invocation. PUBLIC HEARINGS The first item on the agenda is a Public Hearing on a Zoning request from SBA Investment Group. The Public Hearing was opened by Mayor Dockery at 6:02 P.M. The City of La Grange received a request on. July 17,2024, from Brandon Schielack, Managing Partner of SBA Investment Group Inc, to rezone property referred to as Tract 2 (2.248 acres) located at E. St. Hwy 71 Bypass and N. Von Minden Road from Residential Zone to Commercial Zone. There being no comments from the public, the Public Hearing was closed at 6:03 P.M. PRESENTATIONS/PROCLAMATIONS The next item is a presentation by Teresa Brown, Executive Director, of Gardenia E. Janssen Animal Shelter who spoke about their car show and benefit concert to bel held on Saturday, November 2, 2024. This first annual event begins with car registration for the car show at 8 a.m. on the square in downtown La Grange. They also have a truck raffle for a 1955 F-100 pick-up, a chili cookoff, a concert, and a fashion show that evening held at The Crown Bar. Events kick off at 11:00 a.m. on the square in La Grange. Thei next item was ai report on Electric Department: responsibilities: and operations by Alfred Torres, Jr., Electric Department Supervisor. There are four (4) members int the Electric. Department servicing approximately 3,200 City ofLa Grange electric utility customers monthly. There are 58 miles of overhead power lines and 7 miles of underground utility lines. Staff are responsible for routine maintenance of power poles, lines, tree trimming, and many other routines to prevent outages. Staffrotate on-call duties 24/7. CONSENT AGENDA The next item was to discuss and/or consider approval of September 9, 2024 minutes. Motion Mayor Pro tem Weishuhn, Second Councilmember Taylor to approve the September 9, 2024, minutes as presented. Motion carried 7-0. REGULAR AGENDA The first item under: regular agenda was to discuss and/or consider request from SBA Investment Group to rezone from Residential Zone to Commercial Zone on Tract 2 (2.248 acres) located at E. St. Hwy 71 Bypass and N. Von Minden Road. The SBA Investment Group is wanting to use this property to create ai facility for youth sports activities and professional office space. The Zoning Commission unanimously approved this zoning request at their posted Public Hearing meeting held on Tuesday, August 27th, at 5:15 pm in the Council Chambers. Motion Councilmember Taylor, Second Councilmember Gross to approve the request from SBA Investment Group to rezone from Residential to Commercial Zoning on Tract 2 (2.248 acres) located at E. St. Hwy 71 Bypass and N. Von Minden Rd. Motion carried 6-0-1 with Councilmember Busch abstaining. The next item was to discuss and/or consider proposed street closures for National Night Out on the Square on October 1st, 2024. The City ofLa Grange Police Department is requesting permission for the closing of the inner parking area by the north entrance oft the Ourthouse/proposed section oft the street along Colorado Street for the event tent sO that citizen safety can be secured starting at 5:00 pm on Tuesday, October 1st. Motion Councilmember Gross, Second Councilmember Taylor to approve closing the section of Colorado Street for The next item was to discuss and/or consider proposed street closures for Trick or Treat on the Square on October 31St. The. Advisory Board ofLa Grange Main Street is requesting permission for the closing of streets in downtown La Grange for the safety of the public to accommodate Trick or Treat on the Square on Thursday, October 31st. Motion Councilmember Newton, Second Councilmember Busch to approve closing streets for Trick or Treat on the National Night Out on the Square on October 1St. Motion carried 7-0. Square starting at 3:30pm on October 31St. Motion carried 7-0. The next item was to discuss and/or consider proposed street closures for Gardenia E. Janssen Animal Shelter Car Show/Concert benefit on November 2, 2024. Staff of the animal shelter are requesting permission for the closing of streets in downtown La Grange for the safety ofthe public to accommodate the car show and concert to be held Saturday, November 2nd. Motion Mayor Pro tem Weishuhn, Second Councilmember Busch to approve closing streets for Gardenia E. Janssen. Animal Shelter Car Show/Concert benefit on November 2, 2024, starting at 8:00 am. Motion carried 7-0. The next item was to discuss and/or consider proposed street closures for Schmeckenfest on December 5th, 2024. The. Advisory Board ofLa Grange Main Street is requesting permission for the closing of streets in downtown La Grange for the safety oft the public to accommodate Schmeckenfest to be held' Thursday, December 5th. Motion Mayor Pro tem Weishuhn, Second Councilmember Newton to approve closing streets for Schmeckenfest starting at 4:00pm on December Sth Motion carried 7-0. The next item was to discuss and/or consider on Second Reading of an Ordinance levying Ad Valorem taxes for use and support of the Municipal Government of the City of La Grange, Texas for the 2024-2025 Fiscal year; providing for apportioning each levy for specific purposes; providing when taxes shall become due and when same shall become delinquent if not paid; providing for the levy and collection of occupation taxes. Motion Mayor Pro tem Weishuhn, Second Councimember Gross to approve this Ordinance on Second Reading. A roll call vote was taken: Councilmember Bosque for, Councilmember Busch for, Councilmember Gross for, Councilmember Kerri for, Councilmember Newton for, Councilmember Taylor for, Mayor Prot tem Weishuhn for, and Councilmember Zbranek absent. Motion carried 7-0. The next item was to discuss and/or consider adoption on Second Reading ofa an ordinance amending the Code of Ordinances, City ofLa Grange, Texas, by adding an appendix, Appendix C, "Schedule of Rates, Fees, Deposits, Civil Penalties and Charges," thereby establishing a centralized location within the Code of Ordinances for all Rates, Fees, Deposits, Civil Penalties and Charges for city services and utilities. Motion Mayor Pro tem Weishuhn, Second Councilmember Kerr to approve this Ordinance on Second Reading adding Appendix C. A roll call vote was taken: Councilmember Bosque for, Councilmember Busch for, Councilmember Gross for, Councilmember Kerr for, Councilmember Newton for, Councilmember Taylor for, Mayor Pro tem Weishuhn for, and Councilmember Zbranek absent. Motion carried 7-0. City Council CammiteBardyAdibon, Reports Councilmember Taylor stated the next Tax Appraisal Board meeting is September 24th. The next Economic Development Corporation (EDC) Board meeting is September 24th. StaffUpdates City Manager Thompson stated the City Hall Plaza canopy roofi is finished. They are now working on finishing the underside. The Street Department will bei implementing new street signs in the city limits of La Grange and have a sample for the council to look at. City Manager Thompson stated that Hope Hill Park is nearing completion and should be completed by the end ofr next week. Sales tax was up 17%1 for the month of September and we: nearly matched last years figures. Citizen Participation None. Items of Community Interest City Secretary Bayer reminded everyone oftwo upcoming events. The next Shred It Event is Saturday, October 19th, from 9: am to noon: at the La Grange Police Department at 243S. College Street. The next bulk pick up for furniture and appliances is Saturday, October 19th. Items need to be at the curb by Friday evening, the 18th. Councilmember Taylor reminded citizens oft the Friends of the La Grange Railroad Depot dedication and unveiling of the Texas Historical Marker at the M-K-T "Katy" Depot on Tuesday, October 22nd, at 10:00 am at 260N N. Washington Street. At 6:24 PM as pursuant to Section (551.074) Personnel Matters, City Manager Performance evaluation, the La Grange City Council went into Closed Executive Session. At 7:32 PM, City Council went into Open Session. At 7:32 PM a Motion was made by Councilmember Gross, with a Second by Councilmember Newton that the meeting be adjourned. Motion carried 7-0.
