FORNEY X MINUTES- BOARD OF ADJUSTMENT Tuesday, April 9, 2024- 6:30 p.m. Forney City Hall 101 East Main Street I. CALL TO ORDER Chair Brian Reese called the meeting to order at 6:30 PM. Present were board members and alternates Brian Reese, Caz Tankersley, Gwendolyn Brady, Clinton Kirk, Christopher Childress, and Rob Melnyk. Also, present were Director of Community Development Peter Morgan, City Planner Alex Dixon and City Attorney Jon Thatcher. Board members and alternates, Terese Rice, Courtney Smith, and Phillip Baxter were absent. Christopher Childress served the role ofai regular voting member for this meeting. II. CONSENT ITEMS 1. Consider approval ofthe. January 9, 2024, Board of Adjustment meeting minutes. Mr. Kirk made a motion to approve the minutes. Mr. Tankersley seconded the motion. The motion passed by a vote of5 ayes and 0 nays. III. PUBLIC HEARINGITEMS 1. Hold a public hearing and discuss and consider approval of variances to the zoning area regulations for property located between 305 McGraw and 309 McGraw. Peter Morgan introduced the item and explained the details of the request. Chair Brian Reece open the public hearing at 6:36 p.m., and the following people spoke: 1. M. Cox - opposed to the request. Mr. Tankersley seconded the motion. The motion passed by a vote of5 ayes and 0 nays. The variance requests were denied. City Attorney. Jon Thatcher received verbal confirmation from the Board that they determined the requests did not meet the requirements necessary to grant a variance. 2. Ross Garza - in favor of the request. Mr. Garza constructed the carport in violation of setback regulations. He did not get a permit from the City prior to construction. 2. William Spain - in favor of the request. Mr. Spain is the property owner. He hired Mr. Garza to complete the work and was unaware it was being constructed without a permit. Chair Reese opened the public hearing at 7:41 p.m. Paul, representing Priority Signs and Graphics, spoke in favor of the request. Chair Reese closed the public hearing at 7:44 p.m. Mr. Tankersly made ai motion to approve the request. Mr. Kirk seconded the motion. The motion passed by Emergency Room, located at 1325 S. F.M. 741. avote of5 ayes and 0 nays. ADJOURNMENT There being no further business to bring before the board, Brian Reese made a motion to adjourn the meeting at 7:45 p.m. Clinton Kirk seconded the motion.
