SPECIAL CITY COUNCIL MEETING Hillsborough Town Hall and Zoom Video Conference Meetings of the City Council are held in-person. CALL TOORDER Mayor Krolik called the meeting to order at 1:00 p.m. Present: Chuang, Ragsdale, Royse, Cole, Krolik II. ROLL CALL III. PUBLIC HEARING 1. CONSIDERATION OF INTRODUCTION OF AN ORDINANCE AMENDING SECTION 17.16.020(D) ("USE FOR THE PURPOSE OF SINGLE-FAMILY DWELLING DEFINED") OF TITLE 17 ("ZONING") OF THE HILLSBOROUGH MUNICIPAL CODE RELATED TOTHE PROHIBITION OF USE OF SINGLE-FAMILY DWELLINGS FOR COMMERCIAL ACTIMITIES PURSUANT TO CEQA GUIDELINE 15378 AND City Manager Doug Davis introduced the item. Assistant City Attorney Mark Hudak provided the staff report. City Attorney Christopher Diaz, Code Enforcement Officer Linda Stevens, City Clerk Lisa Natusch and Chief of Police Nelson Corteway provided 15061(B)(3) additional information. Mayor Krolik opened the Public Hearing at 1:42 p.m. Jonathan Weinberg, attorney representing Rocky Yu, expressed concerns with the proposed ordinance citing rushed timing, proposed regulation of freedom of speech in private residences, unclear definitions of commercial activity and issues with enforceability, and requested the opportunity for his client to meet with Town officials to prevent the passing of an ordinance that could lead to litigation. Mayor Krolik closed the Public Hearing at 1:47 p.m. Jonathan Weinberg responded to City Council questions. Following discussion, without objection, the City Council directed staff to revise the draft ordinance to refine the definition of commercial activity and to potentially amend the home business section of the municipal code to include a "day pass," for consideration for introduction at the regular City Council meeting on May 13, 2024.
