Mike Como, and Deb Bledsoe. Administrator, Absent: Staff] Present: 1. Call to Order Council Members Lori Bailey and Vagn Hanson, Zoning & Planning Kathy Queen, Finance Officer/Clerk and Village. Attorney George Sistrunk. Mayor Fuller called the meeting to order at 7:00 p.m. A quorum was present. The Pledge was recited by all, and the invocation was given by Mayor Pro Tem Boyce. 2. Public Comments Roger Horton, resident, requested for Council Members to have a speed study conducted on Weddington Road in front of their neighborhood, Pinnacle. He stated Pinnacle is a 55 and older Mayor Fuller stated she thought a study had recently been done on this roadway and would check community, and they are. having difficulty exiting their neighborhood. to scc when thc last one was done. 3. Agenda Additions, Deletions, and/or Changes Council Members requested the following changes: a. Change Item 7a to Butterfly Wall update b. Consider. Item. 11 - Add Auger to tractor quote c.Add. Item 8e - Call for public hearing for text amendments 4. Council Meeting Minutes - Approval MOTION, and second was made to approve the. June 22, 2023 Council Meeting Minutes and was unanimously approved. S25thAmniversary of the Village Celebration Update Council Member Bledsoe reported on the 25th. Anniversary. She stated that all memorabilia for the event have been received, thunderstorms were threatening to disrupt the event, and misting Council Minutes Regular Meeting 2023-07-10 Pg.1 stations would be provided to help cool volunteers and guests. Council Member Bledsoe noted there was an issue with the banners that were tol hang on1 the poles in the Village for the 25th event, and they likely would not be in place in time. She is continuing to work to have them installed in the Village. She also informed Council Members that one of the twenty-five dogwoods donated and planted in the park was not doing well. Council Member Bledsoe noted many of the trees have been sponsored; Mayor Fuller suggested having a place to sell sponsorships at the event. 6. Financial Report a. Financial Update Kathy Queen, Finance Officer, reported that the Village was in the process of closing the books for the FY22-23 fiscal year. Once they have been finalized, they will be presented to the Council. Council Member Bledsoe asked about the. Accounts Receivable Item showing upon the Balance Sheet. Ms. Queen noted this item reflected the invoices that had been sent to recoup reimbursable engineering costs. The amount in questions was approximately $7,500. 7.1 Park & Rec. Committee a. Updates: Pam Utley, Park & Rec. Chair rinformed the Council that the Park & Rec. Committee did not have aquorum at the last scheduled meeting. She informed Council Members the Boy Scouts finished the Butterfly Wall on April 24. Ms. Utley mentioned the upcoming event in August - End of Summer Jam and informed Council that there is no additional information to report on Birddog Security at this time. 8. Planning Board Report a. Update Planner Vagn Hansen was absent from this Council Meeting. Sherry Killion, from the audience, reported that the Planning Board had a guest speaker, Keith O'Herrin, who spoke on the Urban Mayor Pro Tem Boyce asked if the Council should call a Public Hearing in August regarding the proposed text changes to the Village's Subdivision Ordinance. Council Member Como suggested aj joint meeting with both the Council and the Planning Board before the public hearing is called to1 review and discuss the proposed amendments. Council asked Vagn to present the joint meeting to the Planning Board and Council proposed July 24, 2023 for the Special Meeting. RZ2022-04 Parcels 06024011, 06024011A, 06024011B, 06024011C, 06024030, 06024031, The property owner reached out on June 26, 2023 to confirm that the Council had not voted to change anything on the property. Mayor Pro Tem Boyce affirmed to the owner that no changes had been made. The property owner asked when a decision would be made. Mayor Fuller reminded Council Members they made the suggestion to consider conditional rezoning. Council Member Bledsoe commented that he owns the land, and the Council needs to deal with this. She thought the owner was open to partnering with the Town and stated he was looking forward to working as partners. The property owner commented that he perceives hei is being stonewalled by the Council. She recommended in the spirit of partnership for the Council to reach out and ask Mayor Fuller asked if Council çould change property zoning to be conditional, and Attorney Sistrunk replied properties cannot be classified as conditions and advised that a Conditional District would be needed. With Council's prior approval, Mayor Pro Tem Boyce and Council Member Bledsoe met with the developer/owner in an effort to better understand his needs and to find out how to best partner with him. Mayor Pro Tem Boyce stated the Village needs to move forward with this issue as the developer is aj property owner. Items of interest include 1) Weddington is also having an anniversary celebration, but Mayor Fuller was not sure of the number of years they are celebrating, Marvin isl hosting their 2nd Annual Marvin Day, a 1.75% water rate increase was reported to expand services, and the Board of County Commissioners continues to discuss the expansion of the water system and potentially allocating resources to Municipal entities. Updated Budget Message Mayor Fullerinformed Council that Finance Officer Queen updated the Budget Message based on comments made previously by a citizen. The new message discusses projects in the Village's pipeline that likely will not bei implemented in FY23-24. 11. Equipment Purchase Mayor Fuller informed Council Members that staff is requesting to purchase the John Deere Tractor, cart and auger. The cost oft the Tractor and accessories is the lowest of three quotes and MOTIONand: second were made by Council. Member Como and Mayor Pro Tem Boyce to allow for the purchase ofthe. John Deere Tractor and accessories for $23,887.45. and was unanimously the pre-tax cost, including the auger, is below what has been budgeted. approved. 12. UCSO Contract Council Members approved the amended UCSO Contract in the amount of $117,517.96. MOTION and second were made by Council Member Bledsoe and Mayor Pro Tem Boyce to approve the Union County Sheriff's Office (UCSO) Contract in the amount of8117,517.96 and Finance Officer Kathy Queen presented an amended ARPA Ordinance 2023-07-10 #12, for Council's review. The remaining, unearned amount reported by the Village is $195,060. This Ordinance appropriates the final amount allocated from the CARES Act and received by the Village as ar result oft the COVID Pandemic. Irrigation Extension Mayor Fuller requested Council Members to approve a template contract for Union Grove Landscape Development and to authorize Mayor Fuller, in conjunction with the Park Maintenance Technician, to negotiate and approve the contract up to the budgeted amount of $9,000. The contract requires a project scope in order to negotiate the cost; The scope is required to be included as part oft the contract. Council determined it is ini the Village's best interest to continue to work with the same contractor, Unity Grove. Landscaping Development. Mayor Pro" Tem Boyce noted he did have concerns regarding suspending the Policy; however, he was in agreement to continue with the same provider toj protect the Village's current investment in this asset and to not intertwine two contractors for the same project. Park, to negotiate pricing, for the project, and to execute the contract not to exceed the budgeted amount of $9,000 and was unanimously approved. Mayor Fuller informed Council of the complaints from the Heritage Subdivision regarding a foul odor coming from the pump station. She explained that she spoke with Brian Matthews, County Manager, and he agreed this was a valid concern. Mr. Matthews suggested the Village consider a Resolution of Support to givet tot thel Heritage Subdivision community. Both Kolter and the County fault the pump station for creating the foul smelling odor; However, the County says Kolter was made aware oft thej problem before the County signed off on the station and Kolter says the County signed off, SO they are not responsible. Council Member Como speculated that the developer should look to the engineer as it required their approval before it could be released. To date, the developer has not turned: management over tot thel HOA. Regarding bond: monies, Council Member Como stated Kolter went through a loophole, and they were warned by the County that this wasa potential problem, and they, Kolter, ignored the warning. Council Member Como informed Council Members the Town ofL Indian Trail will be discussing this issue at their next meeting. Attorney Sistrunk noted there is not an official action that can be taken by the Village. Council Member Como stated the Village should not write a resolution for this purpose. Council agreed for Mayor Fuller to communicate with HOA atl Heritage and to attend their meeting as a show of or combined system. approved. 16. Amended Planning Board Rules of] Procedures Council approved the amended Planning Board Rules of] Procedure as presented with a few: minor changes. In particular, Council determined the outcome of votes when a member refuses to vote. Council decided that if the issue is a zoning matter, the vote shall be recorded as a no vote. Council Members liked the idea ofh having the form completed upon appointment and again when there is a change of status. The update upon a change of status should be done prior toa any meetings. 18. Closing Comments Mayor Fuller shared a thank you letter from Semper Fi for donations received from the Rock n Roller Car Show held earlier this year. The letter was passed to the Park and Rec.
