COUNCIL MEETING MINUTES VILLAGE OF WESLEY CHAPEL 6490 Weddington Road, Wesley Chapel, NC 28104 September 11, 2023-7:00PM The Village Council of Wesley Chapel, North Carolina met at Village Hall at 6490 Weddington Members Present: Mayor Amanda Fuller, Mayor Pro Tem David Boyce Council Members: Staff Present: Planning Administrator Vagn Hanson, Finance Officer & Clerk Kathy Queen, and Road, Wesley Chapel, North Carolina. Lori Bailey, Deb Bledsoe, and Mike Como. Village. Attorney George Sistrunk. Minutes: 1. Call to Order Mayor Fuller called the meeting to order at 7:00 p.m. A quorum was present. The Pledge was Mayor Fuller read a statement released by the Governor's Office remembering and honoring the American'sy whol lost their lives, the first responders who camet tot theira aid, and the: service members who pursued and brought to justice those who were responsible for the terrorist act on 9/11. This recited by all, and ai moment of silence was offered by Mayor Pro Tem Boyce. horrific act claimed nearly 3,000 lives and changed our nation forever. 2. Public Comments Frank Capella, resident, spoke regarding significant flooding issues] happening in the areas outlined by the one: mile stretch from the Wesely Chapel Elementary School toward Monroc and from the school all the way to New Town Road. Flooding is thought to be caused by the new development int the area. Mr. Capella stated Molly Creek, which: runs under Potter Road, is overwhelmed by the runoff, and storm barriers previously surrounding the newly developing areas have long-ago fallen Council Member Como recommended including the County Manager in communications regarding flooding as the area noted is unincorporated. In response to Mr. Capella's comments, it was clarified by Council that stormwater management is part of the Village's process when Council Member. Boyce noted het tool has issues with flooding inl his area and had planned to discuss down. reviewing and considering new developments. itd during the comment period. 3. Agenda Additions, Deletions, and/or Changes upcoming Litter Sweep. Item 8 was changed to 8b. 1) Mayor Fuller requested for Item 8a to be added to recognize National Night Out and the Councill Minutes- Regular Meeting 2023-09-11 Pg.1 2) Mayor Fuller requested the Daughter's ofthe Resolution's Constitution Week Proclamation be added to the Consent Agenda. The Proclamation called for September 13-17 to be called Constitution Week commemorating the formation and signing on September 17, 1787 of the United States Constitution and recognize all who, by coming of age or by naturalization, have 3) Mayor Fuller requested to add Item 7c- Fraud Activity and 7d - Request to Change Banks. 4) Council Member. Called - Public Hearings for Ordinance Amendments: TA23-002, TA23-003 & TA23-004 on October 11, 2023 at 6490 Weddington Road, Wesley Chapel at 7:00 p.m. in the Council's Chamber. Approved = Constitution Week Proclamation Council Member Boyce requested the callers of the motions on the last item in the 8/14/23 be corrected. Also, the date on the Closed Session Minutes needs to be corrected. MOTION, and second were made by Council. Members Como and. Mayor. Pro Tem Boyce to approve the Consent Agenda with the changes requested and was unanimously approved. Mayor Fuller called for ai moment ofs silence remembering those affected by the events of9/11 and Mayor Pro Tem Boyce offered a prayer. Mayor Fuller thanked those who currently serve our 5. Moment of Silence- - 9/11 country as well as those who have served in the past. 6.25th Anniversary Update Council Member Bledsoe reported on the 25th Anniversary event held at Dogwood Park on July 15, 2023. She informed Council that eighteen trees have been sponsored and there are seven remaining tol be sponsored. She noted $400 has been paid for plaques. She reported the Village has received $1,700 in sponsorships thus far and requested any monies remaining after paying for the plaques to be donated to the Wake thel Forest Foundation. She stated the Village could wait to make the donation once all trees have been sponsored. Council Member Como asked if we had an expense to replace the trees that didn't survive; Council Member Bailey thought John Lepke noted there is money in the budget toj pay for those. Four trees have not survived. Council Member Bailey asked when Council Members would like tol have the tree ceremony and discussed lightly what the ceremony should bel like. Council Member Bledsoe noted that everyone would get an invitation who was represented by the sponsored trees. Finance Officer Update a. NCLM Meeting: Kathy Queen, Finance Officer, reported that she and Mayor Fuller met with a representative from thel NCLM to discuss free services being offered by the League under a $25 million grant received by the NCLM. Services that the Village has interest in includes obtaining financial accounting software paid for by the League for four years, cybersecurity services, and b. Alternate Payment Form: Ms. Queen also reported that the Village is working to take c/d. Fraud & Bank Change Request: Mayor Fullerinformed Council that the Village had had a breach in their QuickBooks and as a result, the Finance Officer had requested for 5/3 Bank to suspend the bank account in an effort to protect the Village's funds. Mayor Fuller also requested that Council permit the Village toi move thel bank account from 5/3 Bank to one oft thel banks within the municipalities as municipalities are expected to bank within their municipality borders. Initially, there were no banks in Wesley Chapel, but now there are banks within the Village. Council Member Baily requested the NCLM to conduct a forensic evaluation of the Village's entire system. National Night Out: Mayor Fuller reported that National Night Out (NNO) is scheduled from 5j pm to 7 pm on October 3, 2023 in the Food Lion Parking Lot. The event recognizes and celebrates law enforcement officials and emergency personnel for their services. She also noted that the Litter Sweep, scheduled for October 21, is upcoming and information can be found on the Village Website. b. P&R Update: Pat Utley reported the following: Movie Night received over 100 inquiries, Council Minutes Regular Meeting 2023-09-11 Pg.3 P&R Committee recommends not pursuing working with Big Dog Securities. While service Crosswalks were discussed and Council requested: for Gordon Oliver to research crosswalk options. Planner Hansen noted that the Village will be responsible for paying for a crosswalk, and it will need to be vetted by an engineer. Council Member Como asked if there would bei regulations; Mr. Hansen noted anything in the right-of-way has regulations. Thet tractor-naming contest will bei incorporated into the Fall Bash event scheduled for the end The Committee is working more on social medial advertising in an attempt tol boost attendance Christmas Tree Event. Ms. Utley proposed an idea to have Christmas trees in the park decorated by interested groups. The trees would not have lighting, just decorations. She suggested starting with five potted trees and planting them later and commented on the amazing things people can do with decorations. Mayor Fuller suggested hosting the event The Committee requested purchasing ai tractor for the park. Council was in favor of a tractor tol help move needed items from one location to another but was not in favor of using it as a MOTION. and: second were made by Mayor. Pro Tem Boyce and Council. Planning Board Member- -In Michael Kenary, Planning Board Chair, reported on the previous Planning Board meeting. He noted it was the first meeting he had attended in a while as he was on vacation and also attended his son's wedding the month before. Mr. Kenary reported that the Planning Board discussed amendments to three ordinances regarding private roads, sidewalk requirements and minimum lot size requirements when subdividing property pertaining to non-subdivision lots. Mr. Kenary informed Council Members that all Volunteer Fire Departments were working as a result oft the recent flooding. Hei noted there was even ai row-boat rescue. b. Planner Hanson's Comments Planner Hansen discussed in more detail the three proposed changes to the ordinances noted by Mr. Kenary. He discussed the previous motions to contribute $4,000 each to two intersection improvements in Wesley Chapel. Mr. Hansen stated the County had received more: inquiries than had been expected and requested the Village to prioritize the two supported intersections. Planner Hansen had suggested New Town Road and Lester Davis due to design purposes. Mayor Fuller reasoned that the Billy Howie/Waxhaw-Indian Trail intersection was more dangerous and should be first in line. After some discussion, Council agreed that the intersection at Billy Howie and Waxhaw-Indian Trail Road was more critical (dangerous) and prioritized it above the intersection atl New Town Road and Lester Davis. C. Five Stones Update Mayor Fuller reported the Village's attorneys are reviewing materials to confirm Five Stones is compliant with the SUP previously authorized by the Village. Also, she noted that Five Stones had reached out to meet with her within the last couple of weeks and she informed them that all meetings between the parties are: required tol have attorney's present. Councill Minutes- Regular Meeting 2023-09-11 Pg.4 10. Proposed Re-Zoning RZ2022-04 Planner Hansen stated he did not have any comments but would answer questions. Council Member Bailey reported she is disappointed that the applicant states he wants to work with the Village but failed to follow up with additional plans. Council Member Bledsoe stated that without zoning approval, he would not have plans. Council Member Bailey asked about the status of the application; Planner Hansen responded that revised drawings were submitted of a 7,000 sq. ft. medical facility. Planner Hansen stated The Moser Group had submitted revised plan after Bonnie with LaBella Engineering made comments. Council Member Bailey stated they do not have approved plans; Planner Hanson responded they will likely be approved. Council Member Boyce wanted ita acknowledged that' The Moser Groupl has spent money based on the property being zoned OI and have an application in place with the Village. Council Member Boyce asked if the application could have been denied when submitted; Planner Vagn affirmed but stated most plans are given an opportunity for cure. Council Member Bailey asked which parcel would be built; Planner Vagn responded Parcel #06034033 and stated the parcel represents the two most northern parcels. Council Member Bledsoe inquired when the Planning Board received this request for zoning; Mayor Pro Tem stated around January. She commented that she feels that Mr. Moser will partner with the Village tol have something acceptable to the Council and stated Mr. Moser and his crews have come numerous times. She stated she believes he will step up and do what he says. She noted thei relations between the Village andl Mr. Moserl have always been adversarial, but Mr. Moser would like to have al better relationship with the Village. Council Member Bailey doesn'tfeel Mr. Moser is sincere in working with the Council. Ini response to having more updated plans, Mayor Pro Tem commented it would be good to get additional information, however, noted The Moser Group cannot go too far because the Village changes things that are set. He noted that to undo everything that has already been set is wrong. He stated he supports leaving the parcels zoned as OI, and Council Member Bledsoe agreed. Council Member Bailey would like it to be rezoned because she believes this is what the citizens want, and she wants to stay with the recommendation oft the Planning Board. Council Member Boyce also stated that individuals dircctly across from the proposed development are ok with it, and it is a second wrong to change it again. Council MOTION. and: second were made by Mayor. Pro Tem. Boyce and Council Member Como to leave the zoning as it is currently (OI) and passed. 3:1 with Council. Member. Bailey opposing. MOTION and second were made by Council Members Boyce and Como to deny rezoning the property and acknowledged that while this decision is inconsistent with the Villages adopted. Land Use Plan, the property owner had an application, for approval following the initial hearing, and Council Members do not want to disrupt the owner s planj for the property; The motion passed. 3:1 Council Members briefly discussed the Policies. Council Member Como requested thel Park & Rec. Committee review the Park & Rec. Committee Policies before Council makes a decision. Member Como agreed with Mayor Pro Tem Boyce. with Council Member. To note, WUMAi isi interested in creating Western Municipality Regional Sewer Cooperative and is looking for support from member municipalities. Also, she noted that NC Legislators changed residential codes, and WUMA would like to invite them to come and explain the changes to the group. 14. Hei is excited that Frank Cappella is taking thel lead rolei int the flooding issue, andi hei is planning to attend the meeting set up by the state to discuss the revised flood maps. He would like to see the cemetery on Potter Road, belonging to the Wesley Chapel United Methodist Church, receive restoration attention. He noted he was recently in Ireland, and he observed that they have preserved their heritage for hundreds of years. Mayor Fuller asked Council Member Bledsoe was interested to see if the owners of the first Price Mill home were interested in having the home classified as historical property.
