Council Member In MOTION and second were made by Board Members Peter and Reule to adopt the amended agenda and Council Member Bailey provided an update to the Board. She noted thei following: Council Members granted a variance for the subdivision modification request for 616 Chambwood to Council Members granted a variance for the subdivision modification request for 5413 Hudson Road to divide the parcel into three parcels. Council Member Reule asked why the variance was approved when the Planning Board had recommended denial. Planner Hansen noted that while both requests were approved, there were many other requests, and these were the only two that had merit for consideration. Mayor Pro Tem Bailey responded it helped that the applicants were willing to come in and discuss their request and to help Council to understand their issue by using photos and ànswering questions. Stormwater Regulations Presentation Bonnie Fisher, PE, LaBella Engineering, provided an introduction to Stormwater Management to Board Members. She discussed how water naturally cycles and how storm water is managed. Ms. Fisher discussed the general standards found in Section 156.219 General Standards for Storm Water Management under Chapter 156:Z Zoning-Drainage, Storm Water Management & Wetland Protection. She illustrated the types of storm water facilities by showing the wet ponds for Chic-Fil-A and Candella as well as Harris Teeter's Dry Pond. Ms. Fisher provided comparisons for municipal entities in both Union and Mecklenburg Counties, noting the Village has stricter requirements than most surrounding municipalities. Ms. Fisher informed the Board the Village's Stormwater Ordinance references the Storm Water Design Manual for Charlott-Meckenburg: She noted this works well because local engineering firms are familiar with this document. The Village's Storm Water Ordinance specifies that the Village must use the NOAH website which provides rainfall data for a specific area and provides rainfall data for whichever design storm that is to be designed. Also, she noted the USDA has a publication that gives all the differing soils Ms. Fisher stated that people sometimes ask what can be done to reduce flooding. With new developments, Wesley Chapel is requiring detention structures, and those are doing a lot. Board Member Reule asked about regulating streams; Ms. Fisher noted the water must flow to the lowest point. He asked who reviews drainage paths; Ms. Fisher noted LaBella reviews drainage and grading plans and they use the Storm Water Design Manuals to check engineer's calculations. Typically, drainage paths follow natural drainage patterns, and LaBella ensures engineers follow the design criteria. Board Member Reule requested a listing of BMP ponds in Wesley Chapel along with a copy oft their annual inspection reports. Staff will provide the information. b.A Amendments to the Floodplain Damage Prevention Ordinance Planner Hines discussed the proposed amendments to the Village's Floodplain Damage Prevention Ordinance. She noted the changes are recommended by the State Emergency Management System with one exception. When substantial damage occurs, more stringent repairs are required for that property. The state allows five years to accumulate costs for repairs, whereas the Village only requires one year. C.S Subdivision Ordinance Amendment-lmfrasrvcure Acceptance Guarantee The Village Council requested staff to prepare an amendment to the Subdivision Ordinance to provide an additional financial guarantee. The Infrastructure Acceptance Guarantee (IAG) will assure funding is available for public infrastructure that may not meet required standards for acceptance for maintenance by the intended receiving entity following completion. Staff proposes requiring an IAG equaling 10% of actual construction costs of the specific infrastructure. Once the infrastructure has been accepted, the guarantee will be released. Planner Hansen clarified that these funds will only be used to correct construction defects revealed at the time of final inspection prior to acceptance. The recommended amendments also contain clarity statements in addition to the new infrastructure acceptance guarantee MOTION and second were made by Board Members Burke and.
