Ms. Peers noted that Trillium needs to do more with public schools and offer their Safe Schools training to families. She said that even if people aren't Trillium members, they can still call the 24-hour crisis hotline number and be directed to help. The Trillium team is getting started with re-entry services. Ifan incarcerated individual is a Trillium member, Trillium will reach out 30 days prior to release to help with the transition. County Manager Lisa Minter said $18.7million is the amount for the construction cost for the New Library, but there are other non- construction costs associated with the project to total $22 million. OLD BUSINESS VI.A Resolutions Regarding New Library and Emergency Communications System Limited Obligation Bonds, Series 2024 Financing Finance Director Candace Iceman presented two resolutions regarding the New Library and Emergency Communications System/VIPER Limited Obligation Bonds, Series 2024 Financing. As part of the next steps in the debt issuance process for the two projects, the Board will need to adopt two. resolutions: 1) Resolution Making Certain Findings and Determinations Regarding the Proposed Financing ofa a New Library and Emergency Communications System and Requesting the Local Government Commission to Approve the Financing Arrangement and 2) Resolution Approving and Authorizing the Sale and Issuance of Limited Obligation Bonds and the Execution and Delivery of a Master Trust Agreement, A First Supplemental Trust Agreement, A Deed of Trust and Related Documents in Connection with the Financing of a New Library and Emergency Communications System. County Manager Lisa Minter said the financing consisted oft two separate projects, combined into one financing for various reasons. The VIPER project includes more than just radios, it covers necessary infrastructure upgrades the State is requiring. The County can use some E-911 funds to enhance the 9-1-1 system; but the County must finance the upgrades required by the state through this financing. Ms. Minter noted that the bank wants collateral for the financing and the VIPER project cannot be put up as collateral since the County will not own all oft the devices, sO the New Library land and future building is sufficient collateral to fund both projects. The County received an estimate from the vendors that staff believes will be enough to cover both projects; however, the County can handle overages ifi needed. Bond Counsel and staff anticipate selling the Limited Obligation Bonds at a premium and that will hopefully bring in additional funding, which may allow for some of the project alternates to be considered. The Lee County Library Project has been facilitated through a construction manager at-risk (CMR) construction delivery method. The County selected Sanford Contractors/Samet Corporation to serve as the CMR. The CMR is responsible for delivering preconstruction services while working with the architect and Lee County staff during the design phase and later serves as oversight for construction. Once the financing is approved by the Local Government Commission (LGC), which is anticipated to occur in mid-September, subcontractors will be issued a notice to proceed by the CMR. The Board resumed open session at 7:58 p.m. County Attorney Whitney Parrish noted that the Board created a Consolidated Human Services Agency composed of the Lee County Department of Social Services and Health Department and created a Consolidated Human Services Agency Board to oversee the newly created Agency in July of 2023 and added the Senior Services Department in September 2023. Currently, the Community Support Services Department is overseen by the Assistant County Manager who also serves as the Consolidated Human Services Agency Director. To continue to expand the services of the consolidated agency, it is staff's recommendation to move Community Support Services into the Consolidated Agency. The Director of Community Support Services will be overseen by the Consolidated Human Services Director and all employees will continue to serve under the Director and will abide by Lee County Personnel Policies. Lee County provides $150,000 to LCS, which covers about three nurses. LCS sends the Health Department the nurses' timesheets for reporting purposes. The school district has about 15 nurses on staff. The County receives funding based on a tiered system from the State. Lee County is in tier 1, per the State. The Health Department also provides training to all of the school nurses, not just the three that the County allocates these funds to. (e) Entering into the Trust Agreement and issuing the Bonds pursuant thereto is preferable to a general obligation bond and revenue bond issue in that (i) the County does not have sufficient constitutional authority to issue non-voted general obligation bonds pursuant to Article V, Section 4 of the North Carolina Constitution because the County has not retired a sufficient amount of general obligation debt in the preceding fiscal year to issue a sufficient amount of general obligation bonds for the financing of the Project; (i) the nature of the financing does not allow for the issuance of revenue bonds to finance the Project; (iri) the costs of financing the Project exceeds the amount to be prudently provided from currently available appropriations and unappropriated fund balances; (iv) the circumstances existing require that funds be available to finance the Project as soon as practicable and the time required for holding an election for the issuance of voted general obligation bonds pursuant to Article V, Section 4 of 2 the North Carolina Constitution and the Local Government Bond Act will delay the commencement of the Project by several months; and (v) there can be no assurances that the issuance of general obligation bonds to finance the Project would be approved by the voters and the current interest rate environment dictates the financing of the Project be accomplished in a timely and expedient manner. (f) Based upon information provided to the Board, the costs of the financing described above is reasonably comparable to the costs associated with other alternative means of financing and is acceptable to the Board. The principal amount of the Bonds shall be the amount that, in the best judgment of the person executing the Bond Purchase Agreement, is necessary to provide sufficient funds, together with any other available funds, to pay (a) the costs the Project and (b) the fees and expenses incurred in connection with the sale and issuance of the Bonds. The interest rates on the Bonds shall be determined by the County at the time oft the execution by the County of the Bond Purchase Agreement; provided, however, that such interest rates shall not result in a true interest cost in excess of5 5.00% per annum, such execution and delivery oft the Bond Purchase Agreement to constitute approval by the County of the interest rates on the Bonds. Section 3. The Bonds shall be sold to the Underwriter pursuant to the Bond Purchase Agreement. The Bonds may be sold to the Underwriter at a discount below the amount of the principal amount ofthe Bonds, such discount not to be less than 98% of the principal amount of the Bonds; provided, however, that if all or any of the Bonds are to be sold to the public by the Underwriter at original issue discount (resulting in lower interest costs of the interest on the Bonds), then the Bonds may be sold at a further discount in the amount necessary to cover such original issue discount. The final maturity oft the Bonds shall not bel later than October 1, 2044. Section 4. Field House B has foundation in place and is starting vertical wall construction. The maintenance building has foundation with metal framing and trusses installed. Field Construction: Ball fields are under construction. The perimeter drainage is installed (underground) and now work on infields is starting, along with the installation of sand and clay for all four ball fields. Rectangle fields are at rough grade and will be the focus ofthe builder (Precision Turf) after ball fields are completed. Field lighting (MUSCO) isi installed on about 75% oft the site and willl be completed once rough grading is complete Site Construction: Parking lots A and B have the base layers of asphalt installed. Finalization of stone base at parking lot C will complete base asphalt installation for the remainder of the site. As construction nears completion, a final layer of asphalt will be Staff is working with DR Horton and McAdams to finalize the Duke Power easement between Ashby Village and the Lee County Athletic Park, with a plan to bring to the Board in September 2024 once the associated documents have been reviewed and negotiated. Potential change orders continue to be vetted and discussed between Sanford Contractors, McAdams, and Lee County in preparation to present to the Board of Commissioners at the September 2024 meeting. Change orders include drainage improvements around multipurpose fields 9 and 10, irrigation and water meter change/redesign, and credits issued for reductions of electrical conduit duct banks and asphalt hold back at the entrance at Highway 421 to allow for road expansion. Phase 1& II Parks Projects - Kiwanis Children's Park and Temple Park - Tropical Storm Debby, but construction still continues. on fields 7,8, and 9. installed over the entire site. Kiwanis Children's Park: This project includes new sidewalk installation for future connection to Kiwanis Family Park, a new playground for children ages 2-5 years, restroom renovations, and a new shelter installation. Marks Construction has completed most of the new sidewalks throughout the park and grading for the new playground installation. Churchich (contractor responsible for the bathroom renovation, playground, and shelter installation) has ordered the shelter and playground equipment. Playground equipment was delivered August 9, and the shelter has been ordered and is scheduled to ship September 9. Staff is coordinating with Churchich to schedule work for the bathroom, shelter, and playground, and with Mark's Construction to complete sidewalk and shelter OT Sloan Park Accessibility Project = The original project includes pavlion/restroom renovations, seatretaining wall, playground and surfacing, playground entry gates, sidewalk (-4500 sq ft), parking striping for handicapped spaces, parking improvements, landscaping, site preparation, lighting, site furnishings, and fencing. The original project bids came in above budget with the lowest base bid for construction exceeding the project budget by -$125,000. A modified scope of work reflecting a reduction in work for the project has been reviewed and approved by the NC State Parks and Recreation. The reduced scope includes removal of the restroom renovation and 3,000 square feet of sidewalk. Lee County is now working with the architect, padi installation. WithersRavenel, to update bid documents reflecting the scope of work reduction. After documents are updated by the architect and reviewed by Lee County, the project will be re-bid. The playground equipment and installation are being provided by Barrs Recreation LLC, and Library Building Project - This is a CMR (Construction Manager at Risk) project, facilitated by SAMET/Sanford for the construction oft the new Lee County Library. The bid period was set from May 15 - June 20, with 35 total packages posted for bid. The bid closed on June 27 and 18 bid packages were received; however, staff did not receive three bids for all bid packages. A re-bid opening was held on July 9 and staff received all 17 remaining bid packages. The GMP (Guaranteed Maximum Price) was finalized and presented by SAMET/Sanford following input regarding bid alternates. Bid tabs have been certified and the final GMP is presented at $18,784,275.00 including the base and five add alternates, allowing Lee County to move forward within budget. The target cost ofconstruction of$ $18,834,0001 is a component oft the overall project budget of $24,034,000. The Finance Department is now working with bond council and LGC (Local Government Commission) to arrange borrowing and bond sales. LGC approval is anticipated to occur September 10 with a sale date of September 25 and a closing date of October Lee County is evaluating RFQ submissions for Third Party Testing (Construction Materials Testing and Special Inspections). The bid period was held July 11 - August 5 with five submissions received. Lee County plans to bring a recommendation: and proposal to September's Historic Courthouse - The Historic Courthouse renovation project currently focuses on roof replacement with alternates for masonry repairs and storm water management. The project is currently out to bid (July 19 - August 21) and is predominately funded under the Emergency Supplemental Historic Preservation Fund (ESHPF)grant. A pre-bid meeting was held on July31 at the Historic Courthouse. Lee County has received confirmation from the State (NC Dept of Natural and Cultural Resources) and the Grant Administrator (Central Pines Regional Council) that additional funds of -$185,000 will be added to the grant. A confirmation has also been received that the grant deadline will be extended through December 31, 2026. Once documents are updated reflecting the newi total funding amount and expiration date, they willl be presented to Horton Park Parking Lot improvements - At the December 2023 Board of Commissioners retreat, Commissioners requested improved parking options for Horton Park and Pool.. J. Thomas Engineering was approved as the engineer fori the project at the Board of Commissioners meeting on March 18, 2024. A preliminary design has been reviewed by Lee County and is currently submitted to NCDOT for review and approval. The current design adds a smaller drive through the parking lot just below the pool area and bathhouse, adding 17 designated parking spots and eliminating unsafe parking conditions occurring along Washington Avenue. Potential add alternates include additional sidewalk installation along Washington Avenue toward the community garden, located at the adjacent property, fori the convenience and safety of pedestrian Lee County Government Center The generator and generator equipment (switchgear) function today, but they are beyond the useful life. Lee County has worked with Dewberry Engineeringt to provide drawings and bid documents for the generator and switchgear. The budget does not allow for replacement of both the generator and the switchgear as originally planned. The project will focus on the switchgear (infrastructure connecting generator to the building) as the base bid due to the immediate need to replace as replacement parts are no longer readily available for the current equipment. The project was bid March 22 - April 21 with RECORE LLC equipment has been delivered onsite at OT Sloan Park. 10. A meeting was held on July 30 with RECORE LLC, Dewberry Engineering, and Lee County to discuss the project and help finalize project contract terms. To minimize the impact to County operations, the project is to be scheduled targeting a holiday weekend with only two business days anticipated of operational down time when the Government Center will only be on backup power while the primary installation ist taking place. Veteran's Day weekendo of2025 is the target time period fori installation, and functional completion of all work is to be completed in five days. RECORE LLC will be able to complete some work before the equipment is delivered that create some efficiencies in anticipation of the five-day switchover period.
