MINUTES FORSYTH COUNTY CIVIL SERVICE BOARD THLRSDAVSEPTENEER 12, 2024, AT 10:00 A.M. FORSYTH COUNTY PUBLIC SAFETY COMPLEX 3520 Settingdown Road, Cumming, GA 30028 REGULAR MEETING MEMBERS PRESENT: Jerry Bowman, Chairman; Terry Smith, Vice Chairman; John Mullin, Member; Jack Allen, Alternate Member; Richard Neville, Counsel and Hearing Officer; Kathy Echols, Clerk. GUESTS PRESENT: Steven Leibel, Attorney; Dustin Townsend, Attorney I. Calll Meeting to Order The meeting was called to order by Mr. Bowman at 10:00 a.m. II. Adoption of Agenda There was ai motion by Mr. Smith with a second by Mr. Mullin to adopt the agenda as presented. Motion passed unanimously. III. Adoption of Minutes Regular Meeting - August 8, 2024 There was a motion by Mr. Mullin with a second by Mr. Smith to adopt the minutes of the. August 8, 2024, meeting as presented. Motion passed unanimously. IV. Items for consideration and discussion: (1) Attorney Updates - Richard Neville, General Counsel/Hearing Officer (2) Administrative Updates - Kathy Echols, Civil Service Board Clerk Mr. Neville stated hel had no updates Ms. Echols stated Ms. Clark and she were working on updating the Civil Service (3) Scheduling Conference for hearing date for Michael Downing, Sheriff's Office The Scheduling Conference included Mr. Steven Leibel (attorney representing the Sheriff's Office) and Mr. Townsend (attorney representing Mr. Downing) was held. There was ai motion by Mr. Mullin with a second by Mr. Allen to have thel hearing on October 16th and 17th with the regular meeting on the 16th. Motion passed unanimously. The meeting on October 16th, will be at 9:30 a.m. with thel hearing to follow and will begin on October 17th at 9:00 a.m. Mr. Neville instructed the attorneys to have the original and three copies of any exhibits to present to thel Board sO the Board can review as the attorneys present their cases. He also asked them to mark their exhibits with their clients' initials, such as MD-1 and MD-2 and Forsyth County as FC-1 and FC-2. He asked the attorneys ifeither of them anticipated bringing a court reporter. He stated thel hearing would be recorded, but ift there was going to be an appeal, it would be easier tol have at transcript than have someone try to Policy. He asked that the attorneys let him know ift they were (4) Discussion of scheduling conferences becoming the standard policy for scheduling Discussion was held. Chairman Bowman stated that due to the conflicts in scheduling the current hearing, it makes sense that the Board makei it a standard practice that when an appeal is fell that at the meeting date at which the hearing date would be scheduled that the representatives appear. Mr. Mullin made a motion to have scheduling conferences become standard policy for scheduling an appeal hearing. Mr. Smith seconded the motion.
