REGULAR SESSION MEETING OCTOBER 15, 2024 Be it remembered on the 15th day of October at 10:30 o'clock A.M., there was Begun and Holden a Regular Meeting of the Commissioner's Court in the Courthouse, in the town of Farwell, with the following members present, To-wit: Isabel Izzy Carrasco Kirk Frye Charles Wilkins Kenny White Casey Russell Sharon May Susie Spring Eric Geske, Sheriff Awyna Sanchez, Tax Assessor-Collector Jessica White, Election Clerk Conor Bates-Janigo, Invenergy Gerald Boyd, Consultant to Invenergy Judge Commissioner Pct. #1 Commissioner Pct. #2 Commissioner Pct. #3 Commissioner Pct. #4 County Treasurer County Clerk Also Present: James Clark When the following was had and done, To-wit: 1. Prior to the meeting, a Public Hearing was held on Intention of Parmer County to Designate the Parmer-Lazbuddie Wind Reinvestment Zone #2, Establish the Boundaries Thereof and Provide for an Effective Date, Pursuant to Chapter 312 of the Texas Tax Code. Mr. Clark spoke in opposition to the tax abatement. Call to Order 2. Prayer Commissioner Frye led the Court in prayer to begin the meeting. 3. Pledge of Allegiance to the American Flag and the Texas Flag The Court pledged their allegiance to the flags of the United States of America and the State of Texas. 4. Open Forum for Public Comments There were no comments from members of the public. 1 5. Consider and Act on Approval of Resolution Designating the Parmer- Lazbuddie Wind Reinvestment Zone #2, Establishing Boundaries Thereof and Providing for an Effective Date, Pursuant to Chapter 312 of the Texas Tax Code The reinvestment zone for Lazbuddie Wind Energy LLC was approved in 2019. The reinvestment zone for Lazbuddie Energy II, LLC was approved in 2022. To take action on amending the Tax Abatement Agreement, the Upon motion to approve the resolution designating the Parmer-Lazbuddic Wind Reinvestment Zone #2, establishing boundaries thereof and providing for an effective date, pursuant to Chapter 312 of the Texas Tax Code, by Commissioner Frye. Commissioner Russell, seconded the motion and the vote was unanimous for approval of the resolution. See Resolution must be renewed. attached. 6. Discussion and Possible Action Regarding Amended and Restated Tax Abatement Agreement with Lazbuddie Wind Energy LLC, Pursuant to Chapter 312 of the Texas Tax Code For both amended tax abatements for agenda items 6 And 7, the following information was provided by Mr. Gerald Boyd. A commitment to ten (10) new full-time jobs in the County, a commitment to buy as much of the materials needed locally, a commitment for a road and use agreement and a 20 year commitment to the project. An estimate of approximately 57 million dollars to the taxing entities in Parmer County Upon a motion by Commissioner Wilkins to approve the Amended and Restated Tax Abatement Agreement with Lazbuddie Wind Energy LLC, seconded by Commissioner White, the vote was taken. Commissioner Russell abstained from voting as he has property in this area. The Agreement was approved by a majority vote. See attached. is projected. 7. Discussion and Possible Action Regarding Amended and Restated Tax Abatement Agreement with Lazbuddie Wind Energy II LLC, Pursuant to Chapter 312 of the Texas Tax Code Upon a motion by Judge Carrasco to approve the Amended and Restated Tax Abatement Agreement with Lazbuddie Wind Energy II LLC, seconded by Commissioner Russell, the vote was taken. Commissioner Frye abstained from voting as he has property in this area. The Agreement was approved by a majority vote. See attached. 2 8. Approve Minutes from Previous Meeting Upon motion to approve the minutes from the Regular Meeting on September 23, 2024, by Commissioner Russell, seconded by Commissioner Frye, the motion passed by a majority vote. 9. Consider Approval and Payment of Accounts Payable-Sharon May Sharon May reported the Accounts Payable List for September 26, and October 3, 2024. Motion by Commissioner White, seconded by Commissioner Frye to approve Payment of the Accounts Payable as presented. Motion carried by majority vote. See attached. 10. Consider Treasurer's Payroll Report-Sharon May Commissioner Wilkins made the motion to approve the Treasurer's Payroll Report for September 30, 2024, Commissioner Russell seconded and the motion passed by majority vote. See attached. 11. Consider and Discuss Depositing all or a Portion of the TAC HEBP Surplus Check into the Healthy County Fund Treasurer Sharon May reported that we had received a check from TAC for the surplus funds in the TAC Health and Employee Benefits Pool. The check is in the amount of $27,828.69. She proposed retaining the funds in the County's Healthy County account. These funds are utilized to create more health related programs for employees. This would enable us to continue and expand our Wellness Incentive Program. Judge Carrasco made the motion to deposit the excess funds in the Healthy County account. Commissioner Frye seconded and the motion passed with a majority vote. 12. Consider and Discuss Approval of the Election Cyber Security Plan Approximately four years ago the Secretary of State required each county to develop a cyber security plan. At that time Parmer had a security assessment done by AT&T Cyber Security, the approved vendor for the SOS. At the conclusion of that plan, the County did enhance the server At this time, we would like to complete our written plan for cyber security and remediation thereof by allowing AT&T Cyber Security to complete the process. Jessica White, Election Clerk presented the proposal for AT&T security for election offices. 3 to finish the work for the cost of $27,724.50. Previously, $30,000 of the Commissioner White made a motion to approve the completion of the development of the Election Cyber Security Plan. Commissioner Russell seconded and the motion passed with a majority vote. See attached. 13. Consider Any and All Matters Concerning the Parmer County Law ARPA money has been earmarked for this project. Enforcement Center Sheriff Geske stated that the Parmer County Jail is housing 20 inmates. Seven of the inmates are from Lamb County with 1 from Castro County. The Sheriff stated he expects 5 more from Lamb County by the end of Sheriff Geske said the Parmer County drug dog is now available to all schools in Parmer County and has begun offering the service to the The Sheriff stated he is looking for an ATV and has found one from Kawasakii in Clovis for around $18,000.
