2 son Cous Madison, Virginia 22727 Madison County Joint Planning Commission and Board of Supervisors Meeting Minutes September 4th, 2024 The Madison County Joint Planning Commission and Board of Supervisors meeting was held in the Madison County Administrative Auditorium at 414 N Main Sti in the Town of Madison, Virginia it was called to order by Chairman Carpenter at 7:00 PM. Chairman Carpenter determined there was a quorum and the first order of business was to adopt the agenda and approve the minutes from the August 21st, 2024 Planning Commission Workshop meeting. Asaquorum was established the following members were present; Chairman Stephen Carpenter, Vice-Chairman Pete Elliott, Commissioners: Michael Snider, Jim Smith, James Graves III, Zach Whitman and Nathan Cowan was absent. Also, present were Hannon Wright; County Attorney, Jonathon Weakley; County Administrator (acting Zoning Administrator), Deputy Clerk; Kimberly Turner; and Janet Henshaw. Secretary for the Planning Commission. Brian Gordon: Deputy County Administrator was absent. For the BoS Chairman Clay Jackson, Vice-Chairman Carty Yowell. Supervisors: Jud Buchannan, Dustin Dawson, and. James Jewett were also present. Vice-Chairman Pete Elliott moved to approve the agenda, and Commissioner James Graves III Commissioner Mike Snider moved to approve the minutes and Jim Smith seconded. This motion seconded. This motion was carried by all members saying "Aye". was carried by all members stating "Aye". 1) Public Hearings: A. (Case No. SUP-07-18-24) Trail Bites by Cake Krums- SUP Application Merri Woodward (Lessee) hasf filed a special use permit (SUP) application to operate a general store located at 37 Poor House Road, Criglersville, VA, and further identified by tax map number 21-47C. The property is zoned as Agricultural (A-1) and contains 0.0293 acres. The propertyi isi improved with an existing 312 square foot brick building. The applicant is proposing to operate a general store in the existing building. County Administrator (Acting Zoning Administrator) Jonathon Weakley started off the meeting stating that the application filed with the Lessee will run with the applicant. Grey water allowed to dispose at the Cake Krums restaurant location. RSA is ok. Approval letter from' VDH. The Building Official is not requiring any ADA upgrades. VDH does not require a public restroom because iti is not a sit-down establishment. The property owner is allowing the use of the bathrooms at her Opossum Store location. The applicant is required to provide VDAX permits when in hand. VDOT is also pending, needs to conform to al low commercial volume entrance. Suggests meeting at the location after the workshop. VDOT's concern with proximity of parking toi the Right of Way, from fence to the edge of the pavement is 21 feet. VDOT will come out again for applicant to show their entrance location. Ms. Belfour has commented that she would take down thet fence. County ordinance requires 1 parking space per 200 square feet. Will have 2 spaces, one of which will bel handicap. Jonathon Weakley read through the 10 conditions. Commissioner Mike Snider questioned..was VDOT saying to remove the fence, isi it in their ROW? Jonathon Weakley commented.VDOT did not ask to move thet fence, VDOT asked to move parking out of the VDOT ROW. Chairman Steve Carpenter questioned..do they measure the ROW of the center line? Jonathon' Weakley..yes, the ROW is measured from the center line. Vice Chairman Pete Elliott questioned..is the parking lot for the SUP? Jonathon Weakley stated..only the taxi mapi that is on the application is for the Trail Bites location which County Attorney Hannon Wright commented.condition 7would need to clarify the tax map number(s) isT Tax Map 21-47C. used. Commissioner Zach Whitman questioned.will VDOT require improvements? Jonathon Weakley stated that VDOT is fine with gravel, owner will be responsible for the material. VDOT ROW would be gravel. The applicant will provide a sketch showing entrance and parking. Pete Elliott commented.suggests to table. positive comments/approval. Pete Elliott commented.should bei in the SUP that parking will be on another parcel. Merri Woodward stated as soon as Igeta approvals, would like to open the first of October. Zach Whitman moved to recommend for approval to the BoS with conditional approvals and amending conditional approval. would be another 5 business days. Mike Snider questioned..how does this differ? Pete Elliott recommends to the BoS for approval. Jim Smith seconded the motion. Absent: Nathan Cowan. (Case No. RZ-08-21-24) Madison' Wood Preservers, Inc. - Rezone Application Madison Wood Preservers, Inc has applied to rezone a roughly 3.7lacre parcel from R-2 (Residential) to M-2 (General Industrial). The subject parcel is currently vacant land. If rezoned the applicant intends to expand their receiving department. The parcel is identified on Madison County's Tax Maps as and power line as requested at the May 15, 2024, PC Workshop. 39-95.
