MEETING MINUTES August 7, 2024 Carroll County Planning and Zoning Commission Location: Reagan Room, 003 Michael Kane, Vice Chair Ralph Robertson Peter Lester Matthew Hoff Tom Gordon III, Ex-officio Steven Smith Members Present: Janice R. Kirkner, Chair Members Absent: Richard. J. Soisson, Alternate Present with the Commission were the following persons: Mary Lane, Bureau of Comprehensive Planning; Christopher Heyn, Department ofl Planning and Land Management; Michelle Ostrander, Attorney; Daphne Daly, Planning Commission Secretary; and, Denise Mathias, Clerk. CALLTOORDER/WELCOME Madam Chair Kirkner called the meeting to order at approximately 6:00 PM. PLEDGE OF ALLEGIANCE ESTABLISIIMENT OF QUORUM Ms. Mathias took attendance and noted that six members were present, and a quorum was established. REVIEW AND APPROVALOF AGENDA On motion ofl Mr. Kane, seconded by Mr. Hoff and carried, the Agenda was approved. REVIEW ANDAPPROVALOF MINUTES On motion of Mr. Lester, seconded by Mr. Kane and carried, thel Minutes from June 18, 2024, were approved. ADMINISTRATIVE REPORT A. ADMINISTRATIVE MATTERS Ms. Daly advised of a couple of dates for the commission members. August 22, 2024, the Board of County Commissioners, along with State Delegates, will be holding a Listening Session for the PSEG project at Shipley Arena from 6:00 pm - 8:00 pm. OTHER October 15, 2024 Ms. Daly reported that she will be having a Master Plan work session with the Board of County Commissioners (Board) on August 29,2024and that a joint Work Session with the Planning & Zoning Commission and the Board will be held on September 17, 2024, after Ms. Daly reported that a new. TEXT AMENDMENT: DEVELOPER'S RIGHTS AND RESPONSIBILITIES AGREEMENTS (DRRA's) Secretary Daly introduced the DRRA discussion for final review. Madam Chair Kirkner asked for clarification on the meaning of proposed section 151.003 (D)("If comprised in whole or in part of a non-residential development..."). Ms. Daly explained this Mr. Robertson asked for clarification on the appeals process ifany party has a grievance related to it. Attorney Ostrander explained that ift there is a dispute, it will be resolved through the Courts. Aj judge's decision on the matter could change the agreement or keep it intact. The signatories to the agreement then could determine ifthe changed agreement still meets the original intent and, if Commissioner Gordon asked what jurisdictions around Carroll are using DRRAS. Carroll County has a couple of towns that allow and/or use DRRAS. Frederick County revised its legislation related to DRRAS after some Court cases. Howard County and several Eastern Shore counties Secretary Daly then focused the discussion on the remaining question of whether to include language related to a requirement for enhanced benefits. This language was the major point that came outofthel Frederick County changes to their legislation. Discussion then centered on whether the County should require a public benefit above and beyond what normally would be required through the development process, as a way ofensuring the County would be getting some kind of benefit in exchange for freezing development regulations at the time of the agreement. GENERAL PUBLIC COMMENT: Attorney Kelly Schaeffer-Miller stated that the County will always get a benefit from a DRRA because otherwise they would not sign the agreement. She questioned whether additional language related to Enhanced Public Benefits is necessary. 2 Planning and Zoning Commission Official Minules October 15, 2024 MASTER PLAN WORK SESSION Secretary Daly provided a presentation on the purpose, requirements, and supporting documents ofthe Master Plan. She noted that the public'si input on important issues and ideas will be gathered throughout the different phases ofthe project. Communication will be essential to getting feedback Secretary Daly then provided an update on the implementation oft the 2014/2019 Master plan. The Vision Statement and Goals highlight the overall direction: to direct development to appropriate areas such as designated growth areas; protect the County's agricultural heritage and environmental resources; and efficiently provide facilities and services. There are 93 separate recommendations in the Master Plan document. Of the recommendations containing some level of implementing, the County has fully implemented 17 recommendations. About 1/3 have had some level of implementation, and 15 recommendations are being implemented in an ongoing throughout the County and coordinating with the towns and other stakeholders. way. Discussion: Mr. Robertson stated that zoning should be held as is in Carroll County. This makes the quality of life much better.
