AC Cutler, 893 Legion Drive, stated he had been speaking at Council meetings since August. He stated at the last Council Meeting, he heard comments that were made by individuals involved in the Main Street Program. He stated these individuals came to the downtown area and liked what they saw. He stated these residents do not see things happening and they feel their concerns are dismissed. He stated these residents were disappointed in their representation and their City. PRESENTATION 8.1) Presentation of New Officers 8) Council was introduced to the new Police Officers with the Whiteville Police Department: Sergeant Alex Britt, Officer Joshua Cox, Sergeant Adam Gore, Officer Adam Jens, Officer Bradley Kuhn, and Officer Marco Long. These individuals were administered their Oath. Council congratulated and thanked these individuals. A round of applause was given by all present. PUBLIC HEARING 9) 9.1) Public Hearing-Ordinance. No. 2024-0-97-Text: Amendment Hookah, Vape, and' Tobacco Establishments. Mayor Mann opened the Public Hearing for Ordinance No. 2024-0-97- Text Amendment Hookah, Vape, and Tobacco Establishments. Robert Lewis, Planning Director, stated City of Whiteville staff has submitted a text amendment amending language to Chapter 155, Section(s) $155.065 Table of Permitted Uses, Section(s) $155.066, to add rules and regulations regarding vape stores and shops in the City of Whiteville's zoning jurisdiction. This text amendment is supported by the Columbus County Health Department and will assist them in future accreditations. The Whiteville Planning Board recommended approval Two individuals spoke during this Public Hearing. Kim Smith, Health Director with the Columbus County Health Department, and Ernest Watts, Tobacco Control Specialist, spoke in support of this Text Amendment. Ms. Smith noted that when individuals are purchasing these products, they do not know what is in them. She stated there had been instances where individuals had vaped once and their lungs shut down. Mr. Watts noted there was an issue with underage individuals having easy access to Kratom and Delta-8, which are types of synthetic Mayor Mann asked who controlled the regulations for these products. Chief Ipock stated the Alcohol Law Enforcement - ALE Division is involved. Mayor Pro Tem Williamson expressed concern that these products could be sold to and used by minors. Itwas noted that minors could not legally purchase tobacco products, but they can legally possess Kratom and Delta-8. Mayor Mann opened the Public Hearing for Ordinance No. 2024-0-98- Text Amendment - Permitting Hotel/Motel as SUP in the B-3 Zoning Robert Lewis, Planning Director, stated City of Whiteville staff has submitted a text amendment amending language to Chapter 155, Section(s) $155.065 Table of Permitted Uses, Section(s) $155.066, to add hotels/motels as a special use in the B-3 (Highway Serving Business) zoning jurisdiction and as a permitted use with standards in the B-1 (Central Business) zoning designation. Mr. Brown stated that revenues were on pace. He noted that ABC, Beer, and' Wine revenues would not be received until the fourth quarter. Mr. Brown reviewed individual funds with Council, including Sewer, Sanitation, Water, Storm Water, Powell Bill, WDDC, and Vineland. He Mayor Pro Tem Williamson stated he would like to review this type of information beforehand. It was noted al lot of details go into this type of report and it is challenging. It was also noted that Council could call 10.4) FYE20204 BudgetAmendment: #1 _ABC Store Construction Fund Mr. Brown presented Council with FYE 2025 Budget Amendment #1 - ABC Store Construction Fund Close Out. Mr. Currie stated staff would check this area. Council Member Collier stated he had spoken with Amber Bellamy, The Dream Center. He stated she was inquiring about the status of the property across the street from The Dream Center. Chief Ipock confirmed that the City is working ont this issue. 12) REPORTS 12.1) Manager's Update for October 8, 2024 process for these locations as well. Chief Ipock referenced recent shootings at Sandy Ridge and Burkhead Street. He stated arrests have been made for both incidents, and evictions are in Mr. Currie gave an update on the City's Hurricane Helene response to Western North Carolina. The City sent a crew of three firefighters and a truck to this area. This crew is back now. The City has also assembled a strike team of Public Works and Police, and have registered them to go on a deployment as well. Hal Lowder, Emergency Service Director, has been in contact with several individuals with North Carolina Emergency Management and locals in Lee Worsley with the Central Pines COG is assembling a virtual managers/staff forum for individuals from the West to ask questions regarding hurricanes, etc. from managers in the East who have experience with hurricanes. Mr. Currie stated he had joined this forum to assist in the efforts. Rachel Rivenbark, Human Resources Director, has volunteered through the Human Resources group to help individuals with payroll, FEMA paperwork, etc. Colburn Brown, Finance Director, is also going to assist with this. Mr. Currie noted the City could do this remotely and not have to leave the area. Mr. Lowder stated that the individuals that have returned from their work in Western North Carolina are emotional. He stated the City is mentoring these individuals and welcoming them back. He noted Chief Yergeau was rostering credentialed people to help in the Western part of the State. Mr. Lowder stated Mr. Currie stated he had spoken with management at Provalus. The plans review should be available for review by the end of the week, with a release to bid in October. He stated this company had been good to work with and they were also planning for two more locations in North Carolina.
