JefferyLundy, Councilman Fred Van Hartesveldt, Councilwoman Juanita Bryant, Councilwoman Councilwoman Laronda Eason, Council Sandra B. Marshall, Council HenryHoward Jr., Recorder-Heather Mathis Interim City Clerk I. II. Il. CALLTOORDER 6:31PM. INVOCATION- MAYOR JEFFERY LUNDY PLEDGE ALLEGIANCE IV. ADOPTION OF THE AGENDA Mayor Lundy -Once again we welcome to our meeting at this time Council you have an outline oft today's agenda at this time. We need a motion for agenda is copied Councilwoman- Bryant-excuse me can we addi two things to the agenda? We need and the approval fori the Master plan and we need to advertisement for historic preservation Tisha Horton can write up the ad fort the newspaper. Council Marshall-Sandra Marshall second MayorLundy-dolhave a second with the amendment tot the agenda? Mayor Lundy-now! PUI be ready for the discussion For the master plan we., just got this this master plan contract. Itl has not been looked at by an attorney that! Iknow the city attorneyt that Iknow and so before we even approve a master plan that I'm just going through it with some those Ideal with the cost that the city will be obligated top pay 75,0001 for, Ithink it would not be beneficial for usi tot for ust to put this ont the agenda for approval or out having to look at our city attorney (Eason, Van Hartsvelt and Bryant raised hands) Council' Vanhartevet-tnougnt Mr. Lee was here to discuss the plan Council Bryant-no he went with Mr. Phillips is here his place to1 tatk VanHartesvelt- -Idefendi that this is the part where we're making a decision and it seems appropriate that the person who oversaw this process be here to discuss it and answer questions andi if he's not, Ithink that'sa a reason to delay. I have no problem with the master plan, but we had to be able to hear, and have questions answered fromi the person who actually oversaw1 the process.Idon'tsee Mr. Lee. Bryant- no it was not Mr. Lee. It was Mr. Phillips and he has been before the council Mayor Lundy- let me find out this, so let mei find out this before we move anyt further so that every person gives up ont the counçil has an opportunityt to address (Easonr rising hand )that so that we allow this opportunity not to debate back-and-forth but to hear everybody's points of view everybody on council point of viewv who has something1 to Put Eason- we did receive feedback from the attorneywho went over the contract... twice. toi this debate yes ma'am (tol Ms, Eason) Mayor which attorney did that? Eason, our attorney, Mr. Elliot Mayor Mr Elliot?? Carla, if we're going to spend that kind of money, aren't we: supposed to have bids? and thisi is the only one that brought one Ford, if we had other bits before us before we spend $75,000 Eason- Is not al bid Mayor- Ms. Marshall you had your hand up.. Marshall-well just to be honest about it. We just signed a contract. We signed a contract for a fair that's coming here next week and council member never had any input on it before it went. You know we didn'thave an opportunity to took at it to expect it so I'm tryingt to see, event though the lawyer had an opportunity tol look at the contract as this as well. I'mi trying to see what's the difference that we' re doing here.Imean you did sign a contract fort the fair were here that looked at and Mr. Phillips has been here too and three times has been a presentation and I'mj just trying to see what the difference and Mayor -to) your point, the attorney look at1 thei fair contract right with some amendment to that which included some things that you said you wanted to amend to that that were added to that contract because of the timeframe withi that there was a executive decision that was made that was necessary that was madei for1 the executive decision what ways andi fort the ways of debate. that was signed after attorney was to look at this wasj just permitted to me whenlgotu up on the beach and prior conversations about this master plan. It was said that there will be no calls to the city of Fort' Valleyi in this contract compensation says that to1 the service rendered the developer should accept as complete payment at total of1 fee of $75,000, so if our attorney saw this Bryant -we're not we' re going to eliminate this Mayor welli is our attorney oni the line by chance Bryant - that was eliminated also something about Mayor- this is a contract that brought before the sign councilwoman Bryant Bryant- excuse me, the contract was sent to the attorney. We went over the contract and it was stated eveni in here with Philip and somebodyldon't) know when they came in and presented us the master plan that stated that there will be no cost to the city that will be on the end that's been corrected byt the attorney and no projects should not be done if not approved by the city. Mayor -your point is well taken Bryant- thank you Mayor- but at1 the same time iti is a contract for signatures and its stays. Ijustr read estate $75,000 sO that I'm waiting to see if my city attorney who you all said the contract and gave the approval of that contract andI I've been conversing with emaits all day today and Ihaven't seen this. This just hit up here as we are will knowi in ar minute. Bryant-this is the second copy of this because when het first came, he was outside he came in. He gave us a copy of the master plan. Mayor- they didn't give us ac contract. This is al binding contract. Bryant- exactly but we had the contract int the master plan Mayor- this is the first time I'm seeing this Bryant- No, this is not thei first time you're seeing this contract Mayor- First time I've seen this contract Bryant-we hadi ith before Mayor- any other discussion?. butIthink. at some point the challenges have to come in up heret from the bench complaint at this complaint likei that sO thaty we can some point beyond being able to hear. Pm hoping to hear from the attorney, because you said that they said that this was an acceptable contract, and I'm saying Ijust got This right now l'mj just looking ati itj just seeni it briefly andj just noticing that the city and thei taxpayers $75,000 and then being told there would be no cost on the back end but this goes even deeper than that when you start trying to read (Bryant raise hand )and Bryant- we need to wait till the attorney gets on here so1 that he can give us thet facts and Howard- my1 thing is mayor We can't! keep stalling. because this it can put a contract that will get started while waiting on the decision for1 the payment of 75000 Bryant- we can also puti int the contract that there is no upfront fee andi ify youv weret told seeing things that need1 to come off here hei is not on the line as ofyet? that we was no upfront money Mayor -whoi told y'all that? Bryant -Phillip He said that the money that they would make, they will come back here that can be scratched out of the contract. (Fred raise hand) There's al lot of things need Vanhartsevelt-Ad contract can't be changed by oft the signatures. The contract has to be changed to be agreed upon by both of the signatures if the developers are willing to write in that we don't have to pay then that's finel but we have to handle thati from them. to get started City Hall, etc., etc. etc..... Secondly, can we vote on1 these two pieces separately? Bryant- of course that's how enter them separately Mayor- Well, we on the master plan now, and so1 the dialogue part the debate parti is you knowy you know we have rights the University of Georgia program putting together been put together that will address some of our changes that are gonna bet taking place with Fort Valley with citizens input from the community and sO we've beent told and Idone heard myself, and I've been asking that from the beginning part of this up to now how much would this cost this citizen the city off fort valley and nowi browsing throughy you all have even with the different perspectives about the need that we keep prolonging these are tax players dollars so1 to make sure that legals followed rather than continue to make eternity decisions at the last minute without because we've been working ont the agenda Bryant -OKIwould tike tol would likei to retract that addition until the attorney comes on part ofi it since Tuesday the line Eason-he just he should be on. He's on, on the line. Bryant- that way! he can go over the contract he know the contract and the master plan VanHartesvett-lhave a question Lawyer Elliot mayor and council VanHartvelt- like the mayor saidi if this is a valid contact that doesn't mean this contracti represents City was told what's going to happen obligated under the law to execute he's not gonna say whether or not (E Bryant well let's just ask! him) that's what we were told ori if the proposal well we can ask him well that's what lawyers do Lawyer-Counci Mary Lundy, Mayor and counselor members Mayor-yes Council- yes Lawyer-this is Jim Elliott's let mej just sayt this, Ireceived a copy of the contract this morning. Iwas able to review. early this afternoon. Ihad some problems with the version Iwas sent something involving fiber optics al long-term commitment thatl don'tidon't: think is allowed for under the state law and understand that section has been removed ori is being removed again? I'mj just acting on when I'mi told. but what would Iwill say regarding the master plan provision part of the contract, and to your point mayor does provide for a $75,000 fee specified services whether those services are what the city needs or want that's not something within my preview but the contract is legally binding upon both parties if you adopt it to provide the services that are provide the service service that are forth fori in our opposition, always is to review the legal aspects of a contract, but we can'ta address the business aspect we would defer to you to determine whether what the other party commits to do is within what you want them to do for that amount of money VanHartsevel-t's al binding contract what we understood from the proposal from Mr. Phillips Iremember being told there will be no upfront cost are the lawyer saying that if you signed this contracty you're going to have to pay the $75,000 and there's no one here to explain why the change Lawyer- -1 that's correct that's correct Bryant lwould like to remove itt from the agenda until Mr. Phillips can come in and explain itt to the mayor and counsel to explain why he said there is no charge and there is a charge sO we can strikei it off the agenda for tonight, butIstill wanti to leave the historic preservation Fred-there has to be a second for that the second has to agree Eason: 2nd Fred you have to sayyou agreed to removing that part of the motion Bryant raised hand Easonl... Marshall lagree to remove that part about their approval for the master plan Mayor ok that would be removed from today's agenda our next part is a motion to amend for1 the historic preservation an ad places in the paper our next parti in motion tot for historic ad to be placed Marshall-/motion Howard 2nd Mayor-copy after that motion we need to add that to be amended to the agenda all the favor let that be brought the wordl ALLSAIDI Mayor-Get to the agenda, now we will review let me say this the agenda Has been reviewed with the proper amendments next we have Fred- you need motion to approve the amended agenda Mayor -need motion to approve the amended agenda Fred-Imotion Mayor- do we have a second Marshall- 2nd Mayor- ok 2nd alli ini favor sayl ALLISAIDI Mayor motion carries, thank you Sir team work make the dream work next item on the agenda the review of the minutes item number five you should have the minutes iny your packet from the work session meeting in March need approval of that of the minutes Carla-Imotion Mayor- dolhave a second? There's no need. we don'thave to go in executive session. Thisi is public information. Mayor-let me hit the gabble so1 that! Ican once again ask that we respect each other we're going to allow, the chair to recognize who's going to say something sO that wayy we don't get in a debate (Bryant raise hands) Mayor- we're on Dr. Fred' Van Hartsevlet and then we were acknowledge you Dr. VanHartesvelt what were you saying? Fred-WMAZ had a profile of whichicompletely don't agree with, But the objects are there we impulsively hired Jonathan Harris, and found out there was al lot of baggage now impulsively hiring Mr. Lee, who Iwould sayi is at friend, but we're doing thatimpulsively) just like we did with Mr. Harris if there's anything they speak toi the Public concerns that we make another mistake we need toi follow the process. we need an application. A background check. any chance for the council tot talk to the candidate. we could do that with Mr. Lee or we can do that with some of the or one of the candidates that from GMAI see Miss Stanley is ap pair here. Online. Atl least she can provide us with a neutral outside candidate what to simply with no no process simply because some people like him to make that choice is a mistake. Bryant- show me a policy which what you saw on TV which thaty you were discussing that should be discussing executive session And Iwould like to make a motion to move to executive session so that we can discuss your concerns Eason-Isecond Mayor-wait we have emotion oni the floor that's noti for executive session the discussion part ofiti is we're talking about item number two Bryant- motion to go executive session Eason -right Mayor- youg guys are out of order Bryant- you called me Mayor yes I'm saying by trying to goi ini to move away is to go to executive session. We need bad positions int the past and look where has gotten us back howwe've done in the past we get GMA we do before we go on with one person. (Bryant and Howard raise hands.) Mayor- the chair recognizes Marshall Marshall-I respect my counsel. This man has been working for the city for the last three years from my understanding therefore, if anything came up, all of that should've came in with the last three years. and! Ithink it'sr really disinfection for us to sit here and discuss the way they were doing now in1 the public therefore, he' s not a rehire he's not a. He's already hired. He's! been with the city for three years upon the woods. He was al he assistant. There was no backlash or discussion att that point when he was was assistedi therefore, you know we need to end this respectfully to Mr. Garrett Lee and any other employees in the city for valley to sit here and talk about our employee on this bitch is verydisrespecttu. Thank you Mayor points will noted let me say this Ity was under the recommendation of council to reach out to GMA1 the council The council asked to do such that night when Miss Stanleyi in the audience that was implemented (Bryant raises hand) posted by those things by council. Bryant, they gave us a listto choose fromi from GMA and we have had the opportunity to see that list... Bryant- this needs to be discussed in private... Mayor -well this is, we. seen those things but how soon we start we start forgetting that we asked for those things when other entities without any kind of any kind oflcalli it relationships conflict of interest things oft that nature that wej just overlooked all of that we Bryant- Wheny'all suggested that that Steve be appointed, we overlooked all of that we Mayor- what I'ms saying is we asked for that to happen we reach out to them for that we reach out to GMA1 for seven different different things and then once again whatever we came about who knows it gets toi this point that we want to amend the agenda and things like that to keep satisfying too whatever the reason behind it let mej just say this on record there's 's some ongoing things taking place and them ongoingt things taking place have nothing to do with today's vote on what we're trying to doj just know that just know those kind oft things and so I'm a record to saying just that to the media to anyone else that there are: some ongoing things that has nothing to do with anything other than making sure that things that are being which are being reported that they are being carried out (Bryant raise Bryant-would like to make a motion to appointment Mr. Gary Lee as interim city just gonna take were int the resolution is the samei thing his hand)G Go head administrator Mayor- that's already on the floor Fredd -That's on the floor Bryant- it's been over 10 minutes Mayor -is still on1 the floor...only in discussion any further discussion now we're ready for the vote all int favor for appointing, GaryLee and city and minerals, etc..
