REGULAR MEETING SEPTEMBER 14, 2020 Be it remembered on the 14th day of September 2020 at 10:05 o'clock A.M., there was Begun and Holden a Regular Meeting of the Commissioner's Courtin the Courthouse, in the town of Farwell, with the following members present, To-wit: Kirk Frye Charles Wilkins Casey Russell Trey Ellis Sharon May Susie Spring Kenny White Commissioner Pct. #1 Commissioner Pct. #2 Commissioner Pct. #4 Judge County Treasurer County Clerk Commissioner Pct. #3 Absent: When the following was had and done, To-wit: Call to Order 1. Prayer Judge Ellis led the Court in prayer to begin the meeting. 2. Pledge of Allegiance to the American Flag and the Texas Flag The Court pledged their allegiance to the flags of the United States of America and the State of Texas. 3. Open Forum for Public Comments No members of the public were in attendance. 4. Update on Extension Activities Wendy Case and Janelle Duffey gave the Court an update on the activities of the Extension Office. See attached. 5. Read and Approve Minutes of the Previous Meeting Upon reading of the Minute of the last meeting, on a motion by Frye, seconded by Russell to approve the Minutes from the August 24, 2020 Regular Meeting, motion passed. 1 6. Consider Approval and Payment of the Accounts Payable - Sharon May Sharon May reported the Accounts Payable List for September 3rd and 14th 2020. Motion by Frye, seconded by Wilkins to approve payment of the Accounts Payables as presented, with the exception of the Warren Cat invoice for Pct #2 that Commissioner Wilkins will investigate. Motion carried. See attached. 7. Consider Treasurer's Report-Sharon May Motion by Russell, seconded by Judge Ellis to approve the Treasurer's Payroll Report for August 31, 2020. Motion carried. See attached. The Treasurer also presented the option for the County to accept the IRS payroll tax deferral for 4 months or to reject it. After discussion, upon motion by Wilkins, seconded by Frye to not participate in the tax deferral, the motion passed. 8. Consider County Participation in the Right of Way Agreement for the Overpass at Cargill Kylan Francis, Steve Perez and Dan Richardson all from the Texas DOT were present to discuss the right ofway agreement and County contribution of funds for this project. Texas DOT has approved the project and Cargill has put up 10.5 million for the project. The County's share would be $75,600. A discussion was held in relation to the placement of the overpass and the contribution of monies. The Judge reminded the court that in the initial discussion with Cargill and DOT that the County stated that they did not have the monies available for this project. Kylan stated that Cargill could pay the County and the County could pay the State but that the agreement and payment must be After discussion, the Judge agreed to contact Cargill and discuss this with them and if necessary, call a Special Meeting for the Commissioners to discuss this with Cargill. Therefore, no action was taken on this item. between the County and the State. 9. Consider Request from Bovina ISD for Permanent School Fund Bovina ISD presented invoices for $83,656.78 to be disbursed from the Permanent School Fund. Upon motion by Wilkins, seconded by Frye to approve the request, the motion passed. See attached. 2 10. Consider Any and All Matters Concerning the Parmer County Law Enforcement Center Sheriff Geries presented the Sheriff's fees for 2021 for approval by the Court. There is no change from last year. He stated that approval must be done yearly and reported to the State. Upon motion by Frye, seconded The Sheriff reported 17 inmates at present. He also stated that he has The new generator has been installed. The Sheriff is exploring what the cost to have the old generator moved to the Courthouse will be. He reported the plan to convert a cell in the female area to negative pressure looks feasible with the COVID CARES Act grant. by Russell to approve the fees, the motion passed. two openings for dispatcher.
