REGULAR MEETING FEBROARY 8, 2021 Be it remembered on the 8th day of February 2021 at 10:02 o'clock A.M., there was Begun and Holden a Regular Meeting of the Commissioner's Court in the Courthouse, in the town of Farwell, with the following members present, To-wit: Kirk Frye Charles Wilkins Kenny White Casey Russell Trey Ellis Sharon May Susie Spring Commissioner Pct. #1 Commissioner Pct. #2 Commissioner Pct. #3 Commissioner Pct. #4 Judge County Treasurer County Clerk Also Present: Deena Leuea JP Pct. 2 Pam Haseloff JP Pct. 3 Rob Pomper, Stateline Tribune When the following was had and done, To-wit: Call to Order 1. Prayer Commissioner White led the Court in prayer to begin the meeting. 2. Pledge of Allegiance to the American Flag and the Texas Flag The Court pledged their allegiance to the flags of the United States of America and the State of Texas. 3. Open Forum for Public Comments Mr. Pomper had no comments. 4. Discuss JP Pct. 1 Vacancy Judge Haseloff stated that she and Judge Leuea wanted to do what was best for the County. They also wanted to do what was legally necessary. Judge Haseloff stated whatever was decided must be approved by Commissioners Court. Judge Ellis stated that the everyday workflow should be addressed by the two JPs. Judge Haseloff stated that they had decided that JP Pct 3 would do all criminal work for Pct 1 and Judge Leuea would do all civil cases for Pct 1. 1 The Judge stated that he had worked with the Postmaster to get the mail Judge Leuea stated that all the tax cases were done in Pct. 2 because the Tax Appraisal Office was located in Bovina and to close that office and move those cases anywhere else would be inconvenient. She indicated that there was a necessity for all three precincts to keep their offices Judge Ellis stated that no decision had been made and the Commissioners would like to wait to see who was interested in filing for Judge Haseloff also informed the Court of issues with the NetData software in both of them doing cases for Pct. 1. There is a workaround Judge Ellis made the motion to accept the JPs plan to have JP Pct. 2 do the civil cases for Pct. 1 and JP 3 do the criminal cases for Pct 1. Commissioner White seconded and the motion passed. forwarded. open. that position in the 2022 election. and NetData is working to resolve the issue. Judge Haseloff brought up the issue of compensation. Judge Ellis made the motion for compensation to be tabled until he could talk to legal Commissioner Wilkins brought up the issue of maintenance in the office ofJP Pct 1. He stated several ceiling tiles need replacing. Judge Ellis said counsel, Wilkins seconded and the motion passed. he would follow up on this issue. 5. Read and Approve Minutes of the Previous Meeting Upon reading of the Minutes of the last meeting, on a motion by Frye, seconded by Russell to approve the Minutes of the Regular meeting on January 25, 2021 with the corrections suggested, the motion passed. 6. Consider Approval and Payment of the Accounts Payable - Sharon May Sharon May reported the Accounts Payable List for February 3rd and 8th. Motion by Wilkins, seconded by Russell to approve payment of the Accounts Payables as presented. Motion carried. See attached. 7. Consider Treasurer's Report-Sharon May Motion by Frye, seconded by White to approve the Treasurer's Payroll Report for January 31, 2021. Motion carried. See attached. 2 8. Consider Permanent School Fund Lease Extension Judge Ellis reported that he and Jeff Actkinson, County Attorney had a conference call with Carl Stroud and Henry Green of Basin Oil and Gas. Judge Ellis stated that Basin Oil and Gas had convinced the County that the seismic study was worthless to the County. The County in the best interest of the School Districts could not accept the lease extension for nothing. Judge Ellis proposed an extension of the lease at no cost for the certainty that Basin Oil and Gas would commit to drilling a viable oil or gas well by the extension time of November 2022 or pay the County $150 The Commissioners discussed this issue and agreed that that was a reasonable alternate. Judge Ellis then called Henry Green sO that the Mr. Green opposed this proposal, stating he could not guarantee a viable well. Discussion ensued. Judge Ellis then stated that the extension could take place for $150 per acre payment. Again, discussion ensued. At the conclusion, Mr. Green stated that the company would do what they could by November 2021 which is the date on which the existing lease ends. The Commissioners agreed and the discussion ended. per acre. Commissioners: could participate in the discussion. 9. Consider Dam Inspection Report Judge Ellis presented the watershed inspection report from the Natural Resources Conservation Service dated December 3, 2020. Inspections were done on Running Water Draw site 2 and 3. On site 2, it was noted that the west side of the dam may need repair. See attached. Upon motion by Frye to approve the report, seconded by White, the motion passed. 10. Consider Bonds for Parmer County Elected Officials and Employees The following bonds were presented for approval: Commissioner Kenny White County Attorney Jeff. Actkinson Sheriff Randy Geries District Clerk Deputy Rose Longley Upon motion by Frye, seconded by White to approve all of the above bonds, the motion passed. Bonds are filed in the office of the County Clerk. 3 11. Consider Water and Gas Lines under County Roads Three applications were received for placement of two water lines and one gas line under county roads. Henry Clark applied for a water line from SE to NW across the intersection of CR L and CR 21. David Norton applied for a water line 2551 feet North of Hwy 60 on CR 4 and a gas line 2192 feet North of Hwy 60 on CR 4. Upon motion by Russell, seconded by Wilkins to approve all of the applications, the motion passed. See attached. 12. Consider Any and All Matters Concerning the Parmer County Law Enforcement Center. Sheriff Geries presented the State required Racial Profiling Report for 2020. He discussed the results, indicating all of the statistics followed the ratio of races present in the County. See attached. Upon motion to accept the report by White, seconded by Russell, the motion passed. Sheriff Geries reported 26 inmates as of today. He indicated that 6 inmates from Deaf Smith County are now housed in the Parmer County Jail. With no further business to come before the court, Commissioner White moved to adjourn.
