SPECIAL MEETING OCTOBER 26, 2021 Be it remembered on the 26th day of October 2021 at 10:06 o'clock A.M., there was Begun and Holden a Special Meeting of the Commissioner's Court in the Courthouse, in the town of Farwell, with the following members present, To-wit: Kirk Frye Kenny White Charles Wilkins Casey Russell Trey Ellis Sharon May Susie Spring Commissioner Pct. #1 Commissioner Pct. #3 Commissioner Pct. #2 Commissioner Pct. #4 Judge County Treasurer County Clerk Also present: Randy Geries, Sheriff Rob Pomper, State Line Tribune Charlotte Marrufo, District Attorney's Office Eric Geske, Chief Deputy When the following was had and done, To-wit: Call to Order 1. Prayer Commissioner White led the Court in prayer to begin the meeting. 2. Pledge of Allegiance to the American Flag and the Texas Flag The Court pledged their allegiance to the flags of the United States of America and the State of Texas. PUBLIC HEARING: A public hearing was conducted beginning at 10:44 AM in regard to the County's 2021 Redistricting Project to obtain public discussion, participation and input regarding potential options for the redrawing and revision of the County Commissioner's precinct boundaries to comply with federal law and other authority. No members of the public had any comments at this time. 3. A discussion only will occur, and no final action will be taken, regarding the County's 2021 Redistricting Project, including: (a) the County's redistricting obligations based on the 2020 US Census data to redraw and revise the County's commissioner precinct boundaries to comply with federal law and other authority; (b) consideration, with public discussion, participation and input, regarding potential options for the redrawing and revision of the County's commissioner precinct boundaries to comply with said authority; and (c) all related project matters, including documents, analysis, and scheduling. Charles Kimbrough and Shirley Perez from the law firm representing the County in this effort participated through web-ex and phone call. Mr. Kimbrough reminded the court of the discussion at the last meeting to include the one person one vote rule and the fact that according to that, the Commissioner precincts are out of balance. The County deviation is He discussed the question of where the County could adjust to achieve the desired deviation percentage. A consensus was reached that the line Ifp precinct 3 were to give all ofits' area in the town of Bovina and some area to the southwest of Bovina, the deviation of 7.01% could be achieved, thus meeting the 10% or less deviation criteria. In reviewing the road miles and responsibilities, neither would have to change. It would also be advantageous for the city of Bovina to be in one precinct. In addressing both ethnicity and voters by age eligible to vote, this change also meets the federal law and other authority for precinct lines. Thus, the proposed redrawing of the precinct 2 and 3 line was agreed upon as the proposed redistricting to present to the public. 14.79% and should be 10% or less. dividing precinct 2 from precinct 3 should be considered. The public hearing was closed at 11:25 A.M. 4. Open Forum for Public Comments No one from the public had comments. 5. Read and Approve Minutes from the Previous Meeting. Upon motion to approve the minutes by White with the noted corrections, seconded by Russell, the motion passed. 6. Consider Approval and Payment of the Accounts Payable - Sharon May 2 Sharon May reported the Accounts Payable List for October 26th. Motion by Frye, seconded by Wilkins to approve payment of the Accounts Payables as presented. Motion carried. See attached. 7. Consider Treasurer's Payroll Report-Sharon May Motion by Frye, seconded by Russell to approve the Treasurer's Payroll Report for October 15, 2021. Motion carried. See attached. Consider Quarterly Treasurer's Report Sharon May reported the receipts and expenditures from July,1, 2021 to September 30, 2021 inclusive. See attached. Upon motion by White to approve the report, seconded by Wilkins, the motion passed. 8. Consider District Attorney's Forfeiture Report Charlotte Marrufo reported for the District Attorney. She explained the report which is attached. Upon motion by Russell to approve the report, seconded by Frye, the motion passed. 9. Consider Indigent Defense Grant Program Resolution Judge Ellis explained that this is something that the Court does yearly to apply for grant money to pay attorney fees for indigent defendants. Upon motion to adopt the resolution, by Wilkins, seconded by Frye, the motion passed. See attached resolution. 10. Consider continuing Education Hours for Justice of the Peace #3 Justice of the Peace, Pct #3, Pam Haseloff, requested the court approve her recent continuing education hours. Upon motion by White to approve the four hours, seconded by Frye, the motion passed. See attached. 11. Consider COVID-19 Administrative Leave Policy for the Fourth Quarter Upon motion by Wilkins to approve the existing COVID-19 leave policy for another quarter, seconded by Frye, the motion passed. 12. Consider Any and All Matters Concerning the Parmer County Law Enforcement Center. Sheriff Geries reported 37 inmates as of today. One is still housed in Lubbock and several are being housed for Deaf Smith County. 3 He reported booster shots for the Moderna vaccine would be given Friday at the Sheriff's Department. With no further business to come before the Court, Commissioner White moved to adjourn. Commissioner Russell seconded and adjournment was called at 11:35 o'clock A.M.
