REGULAR MEETING JANUARY 27, 2020 Be it remembered on the 27th day ofJanuary 2020 at 10:01 o'clock A.M., there was Begun and Holden a Regular Meeting of the Commissioner's Court in the Courthouse, in the town of Farwell, with the following members present, To-wit: Kirk Frye Charles Wilkins Kenny White Casey Russell Trey Ellis Sharon May Susie Spring Commissioner Pct. #1 Commissioner Pct. #2 Commissioner Pct. #3 Commissioner Pct. #4 Judge County Treasurer County Clerk When the following was had and done, To-wit: Call to Order 1. Prayer Commissioner Frye led the Court in prayer to begin the meeting. 2. Pledge of Allegiance to the American Flag and the Texas Flag The Court pledged their allegiance to the flags of the United States of America and the State ofTexas. 3. Open Forum for Public Comments No members of the public were in attendance. 4. Read and Approve Minutes of the Previous Meeting Motion by Frye, seconded by Russell to approve the Minutes from the January 13, 2020 Regular Meeting with one correction. Motion passed. 5. Consider Approval and Payment of the Accounts Payable - Sharon May Sharon May reported the Accounts Payable List for 2019 bills paid on January 10th, 24th, and 25th. Motion by White, seconded by Wilkins to approve Payment of the Accounts Payable for 2019. Motion carried. See She then reported the Accounts Payable List for January 21st and 27th attached. 1 Motion by Frye, seconded by Russell to approve payment of the Accounts Payable for 2020. Motion carried. See attached. 6. Consider Treasurer's Report-Sharon May Motion by White, seconded by Russell to approve the Treasurer's Payroll Report for January 15th. Motion carried. See attached. 7. Consider Closing County Road Bland Portion of CR29 Commissioner Frye stated that Cattle Town manager, Dennis Dewbre requested that County Road B1 and a portion of CR29 be closed (see attached). Cattle Town owns the land that surrounds the road. The County has not maintained that road for a number of years as the run off from the feedyard flows through the roadway. The general public does not utilize the roadway as it runs through the Cattle Town property. After discussion, Judge Ellis made the motion to proceed with the closing of County Road B1 between County Road 28 and County Road 29 and County Road 29 between B1 and County Road C. Commissioner Frye seconded and the motion passed unanimously. 8. Consider Interlocal Agreement Regarding Proceedings and Costs for Court Ordered Mental Health Services This agreement provides for an equitable cost sharing arrangement between Potter County and the 25 counties within the Texas Panhandle Center, the local mental health authority for the Texas Department of Health and Human Services, and the counties of their service area who Upon a motion by Frye, seconded by Wilkins to accept this agreement, are in need of emergency mental health services. the motion passed. See attached agreement. 9. Consider Road Use Agreement This Agreement was presented in the December 23, 2019 meeting and it was decided at that time to not take action until all Commissioners had reviewed the Agreement. The Agreement is between the Lazbuddie Wind Energy LLC and the County. See attached. It will also be used in any future endeavors of this type in the County. The Agreement was endorsed by James Wester, the county's attorney from Underwood Law Firm. 2 Upon motion by Judge Ellis, seconded by, Commissioner Frye to approve this agreement, the motion passed with Commissioner Russell abstaining. 10. Consider Purchase of a Pickup for Use in Precinct #3 Commissioner White presented two bids for a Ford pickup. See attached. Upon motion by Judge Ellis seconded by Commissioner Wilkins to accept the lower of the two bids, the motion passed. 11. Consider Re-scheduling the Commissioner's Court from Monday, February10, 2020 to Friday, February 7, 2020. Due to travel time for Commissioners to the continuing education V.G. Young Institute of County Government School for Commissioners Courts the motion was made by White, seconded by Frye to move the Regular Meeting to Friday. Motion carried. 12. Consider Any and All Matters Concerning the Parmer County Law Enforcement Center Deaf Smith County.
