REGULAR MEETING APRIL 12, 2021 Be it remembered on the 12th day of April 2021 at 10:08 o'clock A.M., there was Begun and Holden a Regular Meeting of the Commissioner's Court in the Courthouse, in the town of Farwell, with the following members present, To-wit: Kirk Frye Charles Wilkins Casey Russell Trey Ellis Sharon May Susie Spring Kenny White Commissioner Pct. #1 Commissioner Pct. #2 Commissioner Pct. #4 Judge County Treasurer County Clerk Commissioner Pct. #3 Absent: When the following was had and done, To-wit: Call to Order 1. Prayer Judge Ellis led the Court in prayer to begin the meeting. 2. Pledge of Allegiance to the American Flag and the Texas Flag The Court pledged their allegiance to the flags of the United States of America and the State of Texas. 3. Open Forum for Public Comments No members of the public were present. 4. Discussion Regarding Nomination of Cargill Meat Solutions Corp. for the Texas Enterprise Zone Program Pursuant to Chapter 2303 of the Texas Government Code Judge Ellis explained the nomination and how it would help Cargill in their business in regard to sales tax. They are planning a 60-70 million dollar expansion to include water reclamation and a parking lot relocation to accommodate the overpass project. In 2018 the County recommended Cargill for this program but they were not approved. There will be a Public Hearing on this issue at 9:30 AM, April 26th prior to the next Commissioners' Court meeting. During the Commissioners' Court meeting a resolution will be considered. 1 Commissioner Wilkins questioned if the program would have any impact on the towns in Parmer County receiving sales tax funds. It will have no impact on the towns. 5. Discussion Regarding Tax Abatement Agreement with Lazbuddie Wind Energy II LLC, Pursuant to Chapter 312 of the Texas Tax Code Judge Ellis informed the Commissioners that the Lazbuddie Wind Project has requested an additional tax abatement for the second portion of their wind project. They have also requested to renew the tax abatement on the first portion of the project. The second tax abatement would be structured the same as the first which is consistent with what was done At 9:00 AM on April 26th prior to the Commissioners' meeting, a Public Hearing will be held. At the Commissioners' meeting subsequent to the public meeting, the tax abatement will be considered for a vote. for past tax abatement projects. 6. Read and Approve Minutes of the Previous Meeting Upon reading of the Minutes of the last meeting, on a motion by Frye, seconded by Russell to approve the Minutes of the Regular Meeting on March 22, 2021 with the correction suggested, the motion passed. 7. Consider Approval and Payment of the Accounts Payable - Sharon May Sharon May reported the Accounts Payable List for March 29th and April 5th and 12th. Motion by Russell, seconded by Frye to approve payment of the Accounts Payables as presented. Motion carried. See attached. 8. Consider Treasurer's Payroll Report-Sharon May Motion by Wilkins, seconded by Frye to approve the Treasurer's Payroll Report for March 31, 2021. Motion carried. See attached. 9. Consider COVID-19 Administrative Leave Policy This is the quarterly review for this policy. Commissioner Wilkins made the motion to continue the policy as is for the next quarter. Commissioner Frye seconded and the motion carried. 10. Consider Burn Ban Upon motion by Frye to extend the Burn Ban for 90 days, seconded by Wilkins, the motion carried. See attached. 2 11. Consider Waterlines and PVC Pipe under County Roads Six requests were made. They are as follows: Water line 44 mile north of CR EE on CR1 15 Water line CR 28 and 44 mile north of CRI D PVC pipeline CRT and CR22 PVC pipeline 3/4 mile west of CR X and CR17 Water line .2 mile south of 3333 on CR11 Water line .6 miles north ofi intersection CR 17 and CR L Each request was considered separately with six different motions to approve all made by Commissioner Russell. All six motions were seconded by Commissioner Frye. All motions passed separately. 12. Consider Any and All Matters Concerning the Parmer County Law Enforcement Center. Sheriff Geries reported 21 inmates as of today. Visitation is allowed in the jail again, following the health guidelines He indicated, the new phone system was working "fairly well" in the established. Sheriff's office. With no further business to come before the court, Commissioner Wilkins moved to adjourn. Commissioner Russell seconded and adjournment was called at 11:14 o'clock A.M.
