REGULAR MEETING NOVEMBER 23, 2020 Be it remembered on the 23rd day of November 2020 at 10:06 o'clock A.M., there was Begun and Holden a Regular Meeting of the Commissioner's Court in the Courthouse, in the town of Farwell, with the following members present, To-wit: Kirk Frye Kenny White Charles Wilkins Casey Russell Trey Ellis Sharon May Susie Spring Commissioner Pct. #1 Commissioner Pct. #3 Commissioner Pct. #2 Commissioner Pct. #4 Judge County Treasurer County Clerk Also Present: Carl Stroud, Basin Oil and Gas, LLC Larry Setle, Texas Road and Signs Don Dorsey, Texas Road and Signs Jeff Actkinson, County Attorney When the following was had and done, To-wit: Call to Order 1. Prayer Judge Ellis led the Court in prayer to begin the meeting. 2. Pledge of Allegiance to the American Flag and the Texas Flag The Court pledged their allegiance to the flags of the United States of America and the State of Texas. 3. Open Forum for Public Comments No members of the public audience had any comments at this time. 4. Consider 1 Year Extension on the Permanent School Fund Lease in Gaines and Andrews Counties Carl Stroud, Land Manager for Basin Oil and Gas discussed the year in review for oil and gas profits. He proposed a seismic study to fully develop the approximate 15,000 acres of Parmer County land and insure long term income for the county. 1 His company would pay for the study but needs the one year extension to complete the study. The lease at present expires in 2021. He is asking Discussion ensued with the Judge asking Jeff Actkinson for his opinion. The County Attorney proposed that the County receive some sort of compensation for the one year extension. He proposed the seismic study be exclusive to the County. Mr. Stroud felt this to be an agreeable term. Discussion also led to the proposal that if the study were not complete by November of 2022 that the company would pay the County $150.00 per Commissioner White made the motion to allow the one year extension to the lease with the stipulation that Parmer County retains exclusive right to the seismic study data and if the study is not complete by November 2022, that the company pays the County $150.00 per acre. Judge Ellis for the extension without any payment to the County. acre. seconded the motion and the motion passed. 5. Discuss Texas Road and Sign Company Don Dorsey and Larry Setle discussed their product to control dust and stabilize dirt or gravel roads. He provided examples of how this cuts the maintenance time and expense on County Roads. 6. Read and Approve Minutes of the Previous Meeting Upon reading of the Minutes of the last meeting, on a motion by Russell, seconded by Frye to approve the Minutes of the Regular meeting on November 9, 2020, the motion passed. 7. Consider Approval and Payment of the Accounts Payable - Sharon May Sharon May reported the Accounts Payable List for November 16th and 23rd 2020. Motion by Wilkins, seconded by White to approve payment of the Accounts Payables as presented. Motion carried. See attached. 8. Consider Treasurer's Report-Sharon May Motion by Frye, seconded by White to approve the Treasurer's Payroll Report for November 13, 2020. Motion carried. See attached. 2 9. Consider Resolution Authorizing the Execution ofan Agreement to Contribute Funds and Designation of the Texas Department of Transportation as the Agency Responsible for the Development of US Hwy. 60 and Appropriating Funds Upon motion by Commissioner Russell, seconded by Commissioner Frye toa approve this resolution, the motion passed unanimously. 10. Consider Request from Farwell ISD for Permanent School Funds Judge Ellis informed the Court that Farwell ISD was requesting $178,035.97 but all that remains in the fund for Farwell ISD is $90,113.07. Wilkins made the motion for payment of the $90,113.07 remaining in the fund. Russell seconded and the motion passed. See attached. 11. Consider Request from the Bovina ISD for Permanent School Fund Upon motion by Wilkins to approve the $117,114.38 requested, seconded by White, the motion passed. See attached. 12. Consider Any and All Matters Concerning the Parmer County Law Enforcement Center. Sheriff Geries presented a report on jail occupancy. See attached. He reported that the injured jailor is back to work. He also indicated that He discussed the installation of the two metal/temperature detectors at to date, no inmates have contracted COVID. the jail and on the second floor of the Court House. Commissioner Wilkins discussed issues with the buyback of the CAT grader Judge Ellis discussed the annual Christmas dinner for the County employees. It was decided to cancel this year due to the high incidence of COVID in the since he purchased a John Deere. County at this time. 3 With no further business to come before the court, Commissioner White moved to adjourn. Commissioner Russell seconded and adjournment was called at 12:05 o'clock P.M.
