Regular Meeting Minutes November: 17, 2022 7:15 p.m. 1. Call to order and announce quorum is present. Mayor Cardwell called the meeting to order at 7:25 pm, and announced a quorum was present. Those in attendance were: Mayor Crystal Cardwell, Mayor Pro Tem Christopher Raines, Councilmember Jennifer Hill, Councilmember Richard Sidebottom, Councilmember Nathanial Butler, City Admin Staff Brittany Mayhue, and City Secretary. Jenni Moore. Mayor Cardwell led the pledge and Councilmember Hill led the invocation. 2. Pledge of allegiance and invocation. 3. Mayor Update. Mayor Cardwell and Councilmember Hill participated in a beam signing at Northwest ISD: school. Mayor Cardwell thanked everyone who helped withi the cleanup at thel library and stated that there would be another date coming up for those who wanti to help finish getting it ready to reopen. Mayor Cardwell shared that the senior luncheon was held at the library and turned out very well. Mayor Cardwell stated that she met with NWISD Highschoolers regarding a program thati they offer every year to help students who are transitioning from elementary to middle school or middle school to high school. They would like to use the library for this purpose this year. 4. Public Comments. There were no public comments. 5. Consider and act on the following items: A. Council Meeting Minutes for October 20,2022. B. Accounts Payables for October 2022. Financial Statements for October 2022. D. Staff Reports- Municipal Court, Building Permits, Code Enforcement and Public Works for Councilmember Hill motioned to approve agenda item number! 5a asa whole. Mayor Pro Tem Raines October 2022. second the motion. All approved. Motion was passed. 6. Discuss, consider and act on a request from Octavio Pinedo, regarding building inspections at his Mr. Pinedo: stated that he purchased this home in October 2021, the unpermitted work was already done at this time. He is asking what he needs to doi in order to proceed with finishing the Mayor Pro Tem Raines asked what Mr. Pinedo'srelationship with Sergio Rico is, Mr. Pinedo stated that he does not know Sergio Rico, but then stated Rico is who he purchased the home from. Mayor Pro Tem Raines then informed Mr. Pinedo that Sergio ist the one who did the work without permits and that a cease work order was issued on this property. Mayor Pro Tem Raines stated that the reason that Mr. Pinedo was not told that there were issues and stop work orders for his home is because he came into City Hall asking about 510 McCanne while Sergio was using 512 property located at 5101 McCanne St. home to live ini it. 1 McCanne for the same property. So although he purchased the home as 510 McCanne the issues still remain, even if the previous owner was dishonest about the permitting oft the home. Mayor Cardwell informed Mr. Pinedo that he will need to complete the steps that thei inspectors have laid out in order to proceed. 7. Discuss, consider and act on building repairs due to the flooding of City Hall that occurred on August 22, 2022. Mayor Cardwell stated that the condition of the city! hall office is not up to standards as it was never fixed correctly from the previous flooding. City Secretary Moore stated that there also appears to be a rodent issue again. Mayor Pro Tem stated that we need to contact the company who repaired the roof to have them come fix the problem. Council discussed that the roofi issue needs to be addressed before making repairs to the office. It was stated that there is $22,000set Mayor Pro Tem Raines made a motion to act on the mayor's discretion to spend no more than $22,000 on office repairs once the roof has been repaired. Councilmember Sidebottom second the aside in the current budget for these types of repairs. motion. All Approved. Motion was passed. 8. EXECUTIVE SESSION: a. Pursuant to Section 551.071; Consultation with the attorney regarding pending or contemplated litigation, or a settlement offer; or on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act, re: (i) City of Newark V. City of Rhome City of Rhome back to the City of Newark. (ii) PUC Application for release of certificate of convenience and necessity from b. Section 551.074, Personnel: Deliberation regarding the appointment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee re: (i)o Code Enforcement Officer Mayor Cardwell closed into executive session at 8:16pm. Mayor Cardwell reconvened into open session at 9:12pm. 9. RECONVENE INTO OPEN SESSION. No action taken. 10. Meeting Adjourn.
