TOWN OF DAYTON COUNCIL WORK SESSION September 9, 2024 COUNCIL CHAMBERS, DAYTON TOWN HALL COUNCIL MEMBERS PRESENT: Vice-Mayor Bradford Dyjak, Susan Mathias, Melody Pannell and Bob Wolz. Robert Seward resigned from council effective July 31, leaving his seat vacant. COUNCIL MEMBERS ABSENT: Mayor Jackson and Emily Estes ALSO PRESENT: Jordan Bowman, Town Attorney; Brian Borne, Town Manager; Christine Wade, Deputy Clerk; Meggie Roche, Economic & Community Development Coordinator; Justin Trout, Police Chief; Christa Hall, Treasurer and Jennifer Reppe, Public Works Supervisor. CALL TO ORDER: Vice Mayor Dyjak called the work session to order at 5:05 p.m. and Ms. OPEN SESSION: Vice-Mayor Dyjak started the Work Session with the Sewer Review and asked Town Manager Borne for a staff report. Mr. Borne deferred to Public Works Supervisor Jennifer Reppe. Ms. Reppe stated that the Town code Chapter 26, Article IV, Division 8, Sec. 26-397 currently states that "the maintenance of building sewers shall be the responsibility of property owners or occupants." She stated that there is a need to elaborate or amend this statement to clearly define ownership and responsibility ofboth resident and Town. She provided Council with three different scenarios based on the public comment from August's Work Session. Scenario one reflects the current code, Scenario two was brought upi in August's Work Session, this is where the Town would be responsible for ownership from the Main to the end of the right of way or the easement. Scenario Three is more. how they are currently operating, the ownership boundary is that the resident owns the lateral from their house all the way to the main, however the town would participate in the repairs or replacement within the right ofway. The Town would help with the roadwork, the back filling, and getting the permits tol help alleviate some of the costs for the residents. She shared that the City ofHarrisonburg's Policy was different than our scenarios and that they did a 50/50 split, that the resident does own from the house to the main, it is 100% theirs, it is defined in their code as ownership. They have the option ofa cost sharing program to contract the city to do the repairs. Ifthe homeowner does that, then the City will do a 50/50 cost sharing program with them, just in that right of way. A little different than our scenario here, it would have the Town paying 100% of the cost. Ms. Reppe then asked if there were any questions that she could answer. Councilperson Estes joined the meeting at 5:07 p.m. Ms. Estes was the first to respond tol Ms. Reppe and stated that she thought that Council should go with scenario two and wanted to make sure that the sidewalks and asphalt was taken care of. Ms. Reppe responded with she didn'trecall where we weren't going to pay for the sidewalk, in scenario three that is what we would pay for. We would take over the responsibility, we would cut the road, cut the asphalt, the contractor would have to excavate because we do not have equipment to dig to that depth. We supply the dump trucks to haul it away, they don't have to pay landfill fees, we provide all ofthat and as soon as they are done, we go back in backfill and fix the sidewalk and the roads. Mayor Jackson, joined the meeting at 5:11 p.m. Ms. Reppe reminded the Council that with scenario one, the money has to Wade called the roll for the Town Council. Vice Mayor Dyjak asked for clarification stating that the current Code as written in scenario one, which is the homeowner pays 100%ifwe go verbatim today. Ms. Reppe confirmed that and Town Attorney Jordan Bowman said that that was the reason for this discussion and why its before Council today. He also stated that Mr. Borne and Ms. Reppe identified there were inconsistencies with the code, the current code is more strict and what the Town is doing is a little more lenient, which is consistent with scenario three. Clarification needs to come from the Council as to what they should be doing. ADJOURNMENT: With there being no further work session discussion to come before the Council, Councilperson Wolz made a motion to adjourn. Councilperson Dyjak seconded the motion, and it passed by an all in favor vote of 6-0 with no members absent.
