BOROUGH OF FRANKLIN PARK BOROUGH COUNCIL REGULAR MEETING MINUTES WEDNESDAY, SEPTEMBER 18, 2024 The regular meeting of the Borough Council of the Borough of Franklin Park was held on Wednesday, September 18, 2024 at 8:00 p.m. at the Municipal Building, 2344 West Ingomar Road, Pittsburgh, Pennsylvania 15237. The meeting was also held virtually via remote audio and video conferencing. Council President Uday Palled called the meeting to order. BOROUGH OF FRANKLIN PARK BOROUGH COUNCIL REGULAR MEETING MINUTES WEDNESDAY, SEPTEMBER 18, 2024 TREASURER'S FINANCIAL REPORT Mr. Weiskircher summarized the August" Treasurer's Financial Report. The General Fund revenues for the month of August totaled $780,343. Year-to-date total revenues are $7,546,445, which represents 62.04% of the 2024 total budget. The General Fund expenditures for the month of August totaled $710,461. Year-to-date total expenditures are $6,365,962, which represents 41.62% of the 2024 total budget. Dr. Lir moved the August Treasurer's Financial Report POLICE REPORT - Mayor O'Keefe read the Police Report and activity report for the month of August 2024. The police responded to 413 calls for service. Mr. Schwartzmier recommended the Police FIRE COMPANY REPORT Mr. Myslinski read the Fire Company Report for August 2024. The fire company responded to 27 calls for the month and the manpower for the month totaled 517 volunteer be accepted as read, seconded by Ms. Czekaj and carried. ANNOUNCEMENT OF EXECUTIVE SESSIONS ANNOUNCEMENT OF EXECUTIVE SESSION- = Mr. Palled announced that Borough Council held an executive session on September 4, 2024 to discuss police personnel, property acquisition and potential litigation, and Borough Council held an executive session on September 18, 2024 to discuss potential property acquisition and potential litigation. OLD BUSINESS NEW BUSINESS None APPROVAL OF THE BILLS - Mr. Malkin moved Council authorize the payment of the bills, which have been reviewed and approved since the last meeting, seconded by Ms. Czekaj and carried. PUBLIC HEARING- - ORDINANCE NO. 687-2024 AMENDING CHAPTER 212 OF THE CODE OF THE BOROUGH OF FRANKLIN PARK, "ZONING." TO AMEND THE RESIDENTIAL USES AREA AND BULK REQUIREMENTS TABLE AND REVISE GARAGE DOOR STANDARDS FOR MULTIFAMILY BUILDINGS - Mr. Palled turned the meeting over to Mr. Junker to conduct a public hearing. Sherry Wurzel, court reporter, was present to take a verbatim transcript of the hearing. Mr. Junker entered preliminary exhibits into the record. The Planning Commission recommended approval of the ordinance at their meeting last night. Mr. Junker explained that this ordinance makes two amendments to the Zoning Ordinance. One amendment updates the Residential Uses Area and Bulk Requirements Table to change and make uniform the height restrictions for townhomes in the applicable zoning districts. It changes the maximum height of an apartment building from 8 stories to 4 stories and changes the garage door standards for multifamily uses from 50% to 70%. These were part of a review and application for a zoning variance for the townhome development off Lorrick Lane that was previously approved as Cardinal Ridge by Borough Council. The request was to make the garage door requirements more liberal at 70% and to change the height requirement from 2Bt to 3B. As part of those discussions, this matter was referred to the Land Use Committee who reviewed the Residential Uses Area and Bulk Requirements Table to come up with proposed changes that Council has before them tonight, and to consider the change to the garage door requirements that are applicable to all multifamily buildings. Mr. Junker noted that all proper procedures were followed. 2 BOROUGH OF FRANKLIN PARK BOROUGH COUNCIL REGULAR MEETING MINUTES WEDNESDAY, SEPTEMBER 18, 2024 The following provided public comments regarding proposed Ordinance No. 687-2024: Ethan Fellheimer, 121 Seventh Street, Pittsburgh, PA 15222 is the owner of the property. The request was for 3B, a basement plus three living levels. It was never intended to be a! 5-story building. They also asked for extra width on the garage door to accommodate two vehicles. Mr. Fellheimer asked Council to enact the ordinance tonight with the garage door amendment, but without the height amendment, so they Mr. Junker noted that Council held a public pre-meeting prior to this meeting to review the agenda, and there were discussions regarding the public hearing and proposed ordinance. He then supplemented his list of preliminary exhibits with Borough Exhibit I, which will be the meeting minutes of the pre-meeting once they are done and approved next month. Mr. Junker then summarized Ordinance No. 687-2024. Mr. Malkin asked if Council could focus only on the garage door portion of the amendment. Mr. Junker responded that the Legislature did puti in a process under the optional Section 108 ordinance notification allowing an additional legal advertisement to alert the public that the ordinance has been enacted, and if you have a procedural claim, or procedural validity challenge, you have 30 days from the second advertisement with which to file. Ift there is a desire to make changes to the ordinance, but not go through all of the procedures again, Council could consider a motion to enact the ordinance, but strike Section 1 which includes the changes to the Table and advertise under the optional Section 108 ordinance Mr. Craig Schweiger, 1552 Barrington Drive is the owner by virtue of a contract for a development that Mr. Junker and Council discussed the options including: (1) Enact the ordinance "as is"; (2) Motion to table the ordinance and refer it back to the Land Use Committee for consideration of changes to the Table with respect to townhome heights; (3) Amend the ordinance Table on the fly with respect to a motion to amend; (4) Strike Section 1 and refer the Table back to the Land Use Committee for further review and move forward with Sections 2, 3 and 4 regarding the garage door amendment, subject to a Mr. Myslinski cautioned that Council should be very careful making changes for one developer. Mr. Myslinski moved to table Ordinance No. 687-2024 and redirect itt to the Land Use Committee to define the term attic and discuss conformity within the Table. The motion failed for al lack of a second. Mr. Schwartzmier indicated that Council needs to clarify the height requirement and asked about revising the Table. He wants to be sure we are making amendments consistently. and appropriately. Ms. Czekaj and Mr. Malkin indicated that they would have no problem proceeding with the garage door amendments and would like to send the Table revisions back to the Land Use Committee for further review. Mr. Malkin stated that the Committee could also look at the apartment building height Mr. Malkin moved to enact Ordinance No. 687-2024 amending Chapter 212 of the Code of the Borough of Franklin Park, "Zoning," to amend the residential uses area and bulk requirements table and revise garage door standards for multifamily buildings, but strike Section 1 regarding the amendments to the residential uses area and bulk requirements table and refer that Section back to the Land Use Committee, seconded by Ms. Czekaj. Mr. Myslinski voted No. The motion carried. SECOND PARTIAL PAYMENT TO MCCANDLESS FRANKLIN PARK AMBULANCE AUTHORITY - Dr. Li moved to authorize the second partial payment of the annual donation to the McCandless-frankin Park Ambulance Authority in the amount of $24,309.00. Mr. Schwartzmier moved to table the motion until ai future meeting, seconded by Ms. Czekaj. Mr. Myslinski clarified that Council discussed this matter during the pre-meeting and noted that there are some changes being proposed to the. Ambulance Authority funding structure. Council would like tor review thati information before moving forward. The REJECT BID RECEIVED FOR CLOVER HILL GOLF COURSE EXTERIOR RENOVATIONS PROJECT Mr. Malkin moved to reject the sole bid received for Contract No. 24-PK1 Clover Hill Golf Course Clubhouse Exterior Renovations Project, to authorize the return of the bid bond, and to authorize PURCHASE RECYCLED PLASTIC CEDAR BENCHES FOR ACORN PARK IMPROVEMENTS PROJECT Mr. Myslinski moved to authorize the purchase of seven (7)6' recycled plastic cedar benches for the Acorn Park Improvements Project through George Ely Associates of Carlisle, PA, ata total cost of $7,510.00 under COSTARS Contract No. 014-E23-299, seconded by Ms. Czekaj and carried.
